Thursday,January 5, 1995
The Final Hearing of the Monroe County Value Adjustment Board
convened at 10:00 a.m.,on the above date, in the Chapel, located at the Public Service
Building, 5100 Junior College Road, Stock Island. Present and answering to roll call
were County Commissioners Shirley Freeman, Wilhehnina Harvey and Chairman Mary
Kay Reich; Monroe County School Board members Frank Butler and Andy Griffiths.
Also present were Danny L. Kolhage, Clerk; Ruth Ann Jantzen, Deputy Clerk; Randy
Ludacer, County Attorney;John Dent, Attorney,representing the Property Appraiser;
and Patricia Dowling,Deputy Appraiser; Special Masters Raymond Bishop, Thomas D.
Wright,Esq.,and James Flenner; and members of the public.
Motion was made by Commissioner Harvey and seconded by Mr. Butler
approving the Minutes of the October 11, 1994 Organizational Meeting, and the October
19, 1994 Special Meeting of the Value Adjustment Board. Motion carried unanimously.
County Attorney Randy Ludacer addressed the Board and discussed the
Notice of the Hearing and a notice from the Florida Department of Revenue.
Motion was made by Commissioner Freeman and seconded by
Commissioner Harvey granting approval of the Special Master's Recommendations for
the 1994 Homestead Petitions. Motion carried unanimously.
Erol Vurol,Attorney,addressed the Board regarding Petition No. 116-1994,
whereby his client, J. Allen Smith, agreed with the recommendation of the Special
Master and complimented the Property Appraiser's staff.
Jeffrey Mandler, representing petitions 045-1994, 046-1994, 047-1994, 048-
1994 and 051-1994 addressed the Board.
Motion was made by Commissioner Freeman and seconded by Mr.
Griffiths granting approval of the Special Master's Recommendations for the 1994 Real
Property Petitions, excluding petitions 034-1994, 045-1994, 046-1994, 047-1994, 048-1994
and 051-1994. Motion carried unanimously.
Motion was made by Mr. Butler and seconded by Commissioner Harvey
granting approval and authorizing refunds designated on the 1994 Refund List. Motion
carried unanimously.

Vaclav Persl, petitioner 034-1994, addressed the Board. Special Master
Thomas D. Wright,Esq.,addressed the Board. Attorney John Dent addressed the
Board. Motion was made by Commissioner Harvey to reduce the taxable assessment on
petition 034-1994 by $35,000.00. After discussion, motion was withdrawn. Motion was
made by Commissioner Freeman and seconded by Mr. Griffiths to uphold the Special
Master's recommendation on petition 034-1994. Motion carried unanimously.
Motion was made by Mr. Butler and seconded by Commissioner Harvey to
reconsider petitions 041-1994 and 054-1994. Motion carried unanimously.
Jeffrey Mandler, representing petitions 046-1994, 047-1994 and 048-1994,
Barnett Bank, Kennedy Drive Branch, addressed the Board. Thomas Wright addressed
the Board. Attorney John Dent addressed the Board. Motion was made by Mr. Butler
and seconded by Commissioner Freeman to uphold the Special Master's
recommendation on petitions 046-1994, 047-1994 and 048-1994. Roll call vote was taken
with the following results:

Motion failed.
After further discussion with the County Attorney,motion was made by
Mr. Butler and seconded by Commissioner Freeman to uphold the Special Master's
recommendation on petitions 046-1994, 047-1994 and 048-1994. Roll call vote was taken
with the following results:

Commissioner Harvey No

Motion carried.
Victor Heyman, representing Michael and Susan Birrell, petition 041-1994,
addressed the Board. Special Master James Flenner addressed the Board. Attorney
John Dent addressed the Board. Motion was made by Commissioner Freeman and
seconded by Mr. Butler to uphold the Special Master's recommendation for petition 041-
1994. Motion carried unanimously with Commissioner Harvey absent.

Attorney David P. Horan, representing petition 054-1994, Ocean Key
House, addressed the Board. John Dent addressed the Board. Special Master James
Flenner addressed the Board.
Motion was made by Commissioner Freeman and seconded by Andy Griffiths to uphold
the Special Master's recommendation for petition 054-1994. Roll call vote was taken
with the following results:

Motion failed.
Motion was made by Frank Butler and seconded by Commissioner
Freeman to reduce the Tangible Property Tax on petition 054-1994 to $1,621,707.00.
Roll call vote was unanimous
Attorney Jeffrey Mandler, representing petition 051-1994, Banner Tire, and
Mr.Rodriguez, addressed the Board. Attorney John Dent addressed the Board. Special
Master Thomas Wright addressed the Board. Motion was made by Commissioner
Freeman and seconded by Mr. Griffiths to not uphold the Special Master's
Recommendation on petition 051-1994. Roll call vote was taken with the following
results:

Andy Griffiths Yes
Commissioner Harvey Yes

Motion carried.
Motion was made by Commissioner Freeman to defer petition 051-1994
back to the Property Appraiser for additional information. Motion died for lack of a
second. Attorney John Dent addressed the Board. Special Master Thomas Wright
addressed the Board. The Board recommended to Mr. Rodriguez to get as much
documentation regarding ground contamination reports as possible to the Property
Appraiser for re-evaluation. After further discussion, motion was made by Mr. Butler
and seconded by Commissioner Harvey to establish an assessment of$200,000.00 for
petition 051-1994. Roll call vote was unanimous.

Motion was made by Commissioner Harvey and seconded by Mr. Butler
granting approval and authorizing execution of the Certification of the 1994 Tax Roll
with the adjustments approved by the Value Adjustment Board. Motion carried
unanimously.
Motion was made by Chairman Reich and seconded by Commissioner
Harvey to pay all late bills including final payment to each Special Master, and
payment for advertising the notice of the Final Hearing. Motion carried unanimously.
There being no further business to come before the Board, the meeting was
adjourned.
