MONROE COUNTY VALUE ADJUSTMENT BOARD
FINAL HEARING
Wednesday,January 12, 1994

The Final Hearing of the 1993 Monroe County Value Adjustment Board convened
at 9:00 a.m.,on the above date, in the Chapel at the Public Service Building on Stock
Island. Present and answering to roll call were Commissioners Frank Butler, Earl
Cheal, Shirley Freeman, Andy Griffiths and Mary Kay Reich. Also present were Danny
L. Kolhage, Clerk; Ruth Ann Jantzen, Deputy Clerk; Randy Ludacer, County Attorney;
Ervin Higgs, Property Appraiser; John Dent, Attorney;Special Masters Ray Bishop and
Jim Flenner, and County Staff.
Due to the fact that Chairman Mary Kay Reich was suffering from laryngitis,
Vice Chairman Andy Griffiths assumed the role of Chairman. Mr. Kolhage informed
the Board the meeting was duly advertised in all three local newspapers.
Motion was made by Commissioner Freeman, seconded by Commissioner Butler
to approve the Minutes of the October 23, 1993 Organizational Meeting of the Value
Adjustment Board. Motion carried unanimously.
Motion was made by Commissioner Cheal, seconded by Commissioner Freeman,
to approve the recommendations of the Special Masters for all 1993 Homestead
Petitions. Motion carried unanimously.
The following petitioners were present to present their petition(s) to the Board:
Petition #031-1993 - Present was Christopher H. Chapin, petitioner. After
discussion, motion was made by Commissioner Cheal, seconded by Commissioner
Butler, to uphold the recommendation of the Special Master. Motion carried
unanimously.
Petition #020-1993 - Present were Henry Morgenstern, petitioner, and Erol Vural,
attorney, representing Mr. Morgenstern. After discussion, motion was made by
Commissioner Cheal, seconded by Commissioner Butler, to remand this petition back to
the Property Appraiser's office for further review to determine proper assessment.
Motion carried unanimously.
Motion was made by Commissioner Freeman, seconded by Commissioner Cheal,
to clarify the letter sent to all petitioners regarding their hearing dates, noting that
petitioners must submit all material to be considered by the Special Masters and the
Value Adjustment Board directly to the Clerk's office for distribution. Motion carried
unanimously.

Motion was made by Commissioner Freeman, seconded by Commissioner Cheal,
directing the Clerk to draft the subject letter to be approved by the Value Adjustment
Board before being sent to petitioners. Motion carried unanimously.
Petition #047-1993, #048-1993 and 049-1993 - Present were Harry Woolley,
representing Barnett Bank, and Jeffrey Mandler, attorney. Motion was made by
Commissioner Cheal to uphold the Special Master's recommendation. Motion died for
lack of a second. Motion was made by Commissioner Butler to return the petitioner's
assessment back to the Property Appraiser's office for re-evaluation. Motion died for
lack of a second. Motion was made by Commissioner Butler, seconded by Commissioner
Griffiths,to change the assessment to $2,600,000.00for all three petitions. After further
discussion, the motion and second were withdrawn. Motion was made by Commissioner
Butler, seconded by Commissioner Freeman, to modify Petition #048-1993 to an
assessment of$2,600,00.00,and uphold the assessment on Petitions 047-1993 and 049-
1993. Roll Call was taken with the following results.
Commissioner Butler - Yes
Commissioner Cheal - No
Commissioner Freeman - Yes
Commissioner Griffiths - Yes
Commissioner Reich - Yes
Motion carried.
Petition #045-1993, #046-1993 - Petitioner was represented by Jeffrey Mandler,
attorney. After discussion, motion was made by Commissioner Griffiths, seconded by
Commissioner Cheal, to accept the Special Master's recommendation. Motion carried
unanimously.
Petition #050-1993 - Petitioner was represented by Jeffrey Mandler, attorney.
After discussion, motion was made by Commissioner Freeman, seconded by
Commissioner Cheal, to reduce the Special Master's recommendation by $50,000.00.
Roll Call was taken with the following results:
Commissioner Butler - No
Commissioner Cheal - No
Commissioner Freeman - Yes
Commissioner Griffiths - Yes
Commissioner Reich - No.

the Special Master's recommendation. Roll Call was taken with the following results:

Motion carried.
Petition #039-1993 - Petitioner was represented by Jeffrey Mandler, attorney.
After discussion, motion was made by Commissioner Reich, seconded by Commissioner
Butler, to uphold the Special Master's recommendation. Roll Call was taken with the
following results:
Commissioner Butler - Yes
Commissioner Cheal - No
Commissioner Freeman - Yes
Commissioner Griffiths - Yes
Commissioner Reich - Yes
Motion carried.
Petition #127-1993 - Present were petitioners Ramon and Patricia Rodriguez and
Jimmy Rodriguez. Commissioner Cheal left the meeting at 3:10 p.m. During discussion,
Commissioner Griffiths announced that he had a conflict of interest with this petition
and would not vote on its disposition. After discussion, motion was made by
Commissioner Butler, seconded by Commissioner Freeman, to uphold the Special
Master's recommendation. Roll Call was taken with the following results:
Commissioner Butler - Yes
Commissioner Cheal - Absent
Commissioner Freeman - Yes
Commissioner Griffiths - Abstained
Commissioner Reich - Yes
Motion carried.
Motion was made by Commissioner Freeman, seconded by Commissioner Butler,
to approve the Refund List presented. Motion carried unanimously.

Motion was made by Commissioner Freeman, seconded by Commissioner Butler,
to approve all expenditures of the 1993 Value Adjustment Board, including all Special
Master's invoices and all advertising invoices. Motion carried unanimously.
It was noted that the vote on the Certification of the Tax Roll must be held at a
later date. Mr. Kolhage advised the Board that in order to provide the Value
Adjustment Board members with complete information concerning the petitions, all
material submitted to the Special Master, during the Special Master Hearings, must
also be given to the Clerk to insure that all information received is included in the
Board's packets. The Board unanimously agreed.
There being no further business, the meeting was adjourned.
