10/22/1993 Organizational Meeting MINUTES MONROE COUNTY VALUE ADJUSTMENT BOARD ORGANIZATIONALMEETING Friday, October 22, 1993 County Attorney's Law Library 310 Fleming St.,Key West The Organizational Meeting of the 1993 Monroe County Value Adjustment Board convened at 1:35 p.m.,on the above date, at the County Attorney's Law Library, located at 310 Fleming Street, Key West. Present and answering to roll call were Commissioners Earl Cheal, Shirley Freeman and Mary Kay Reich; School Board Members Frank Butler and Andy Griffiths. Also present were Danny L. Kolhage, Clerk; Ruth Ann Jantzen, Deputy Clerk; Randy Ludacer, County Attorney;Ervin Higgs, Property Appraiser; John Dent, Attorney,and County Staff. Nominations were opened for Chairman of the 1993 Value Adjustment Board. Motion was made by Commissioner Freeman to nominate Commissioner Cheal. Mr. Griffiths nominated Commissioner Reich. The Board proceeded to ballot on the two candidates on the basis of the lowest point total being the individual selected, with the following results: Butler Cheal Freeman Griffiths Reich Total Cheal 1 2 1 2 2 8 Reich 2 1 2 1 1 7 On the basis of the above ballot, the Board selected Commissioner Reich to be Chairman of the 1993 Value Adjustment Board. Nominations were opened for Vice Chairman of the 1993 Value Adjustment Board. Commissioner Reich nominated Mr. Griffiths. There being no other nominations, Andy Griffiths was elected Vice Chairman of the 1993 Value Adjustment Board. Mr. Kolhage gave the Clerk's Report on petitions filed. 152 Real Property Petitions were filed and 5 Homestead Petitions were filed for a total of 157. Breakdown by area included 60 petitions from the Upper Keys, 13 petitions from the Middle Keys, and 84 petitions from the Lower Keys and Key West. Motion was made by Commissioner Cheal, seconded by Mr. Butler to hold the Statutory Filing Fee at $15.00 for each petition filed. Motion carried unanimously. Value Adjustment Board Organizational Meeting October 22, 1993 Page 2 Motion was made by Commissioner Freeman, seconded by Mr. Butler to approve Special Master Fee's of$125.00 per hour for time present at hearings only. Motion carried unanimously. Motion was made by Commissioner Freeman, seconded by Mr. Butler to approve Raymond Bishop and James Flenner as Special Masters for the 1993 Value Adjustment Board. Mr. Kolhage discussed the schedule of the Special Masters Hearings. Mr. Bishop's Hearings will be held on November 15th and 16th at the Key Largo Library and November 17th at Key Colony Beach City Hall. Mr. Flenner's Hearings will be held on November 18th at Courtroom A in Key West, and November 19th at the "Chapel" located at the Public Service Building on Stock Island. The Board discussed a letter from Commissioner Cheal, dated March 10, 1993, suggesting it would be more cost effective to hire a part-time Clerk to record information on the petition forms used by the Special Masters at the Special Master Hearings. After discussion, it was suggested that the Petitioners fill out the form when they enter the Hearing chambers and present them when they go before the Special Master. The Clerk has agreed to implement this procedure and report back to the Board at the final hearing. The Board discussed a letter from Robert Greene requesting a list of the names and addresses of anyone who has filed a petition for value adjustment. The Clerk informed the Board that as the names are part of the Public Record, he is obligated to give the requested information, but will advise all petitioners in their Notice of Hearing that this was done. The Board also discussed a letter from William Sanchez Associates, Inc.,proposing a free Orientation Program and Cost Benefit Analysis addressing VAB office and hearing procedures. Motion was made by Commissioner Cheal, seconded by Commissioner Reich to take no action on this proposal. Motion carried unanimously. The Board agreed to meet for the Final Hearing of the 1993 Value Adjustment Board on December 9, 1993 at 9:00 a.m.at a location to be determined.
