01/15/1991 Final Meeting January 15, 1991 Property Appraisal Adjustment Board Courtroom B, Monroe County Courthouse Annex Key West A Meeting of the Property Appraisal Adjustment Board took place on January 15, 1991 at 1: 00 p.m. in Courtroom B, Monroe County Courthouse Annex, 500 Whitehead Street, Key West, Florida. Present and answering to roll were Commissioner Douglas Jones, Commissioner Jack London and Mayor Wilhelmina Harvey, and representatives of the Monroe County School Board , Dr . Geraldine Caron and Mrs. Ruth Alice Campbell. Also present was Danny Kolhage, Clerk; Nancy Cohen, Deputy Clerk ; Ervin Higgs, Property Appraiser ; Mary Greenwood, Assistant County Attorney; and Staff of the Property Appraiser 's Office . Mary Greenwood, Assistant County Attorney, read an opening statement to the Board concerning the obligations of the Property Appraisal Adjustment Board. Ms. Greenwood read from section 12D10. 003 (5) (a) of the Administrative Code and F. S. 194. 032. The-Board proceeded to discuss the pending lawsuit brought by Property Appraiser Ervin Higgs. Chairperson Harvey addressed those petitioners in the audience and requested any petitioner who wished to address the Board to sign up with the Clerk. After a brief discussion of the agenda items, it was decided that any action taken would exclude those petitions listed below: 003-Nathan Eden 010-Bruce Bryant/Lazy Lakes 055 & 056- Gilbert ' s Resort 114-Safe Harbor Marina 151- Key West Resort Golf Course 164 & 165-Larry & Max Puyanic H003-Shrimp Culture Inc. H043-Bartholomew Hovanic H049-Perry Killin H103-Gerald Fuchs Motion was made by Commissioner Jones and seconded by Commissioner Caron to approve agenda item A-1 (attached hereto) . Roll call vote carried unanimously. Motion was made by Commissioner Jones and seconded by Commissioner Caron to approve agenda item A-2 (attached hereto) . RQ11 call vote carried unanimously. After brief discussion of agenda item B-3 (attached hereto) , it was decided that the Board need not take any official action inasmuch as the Property Appraiser had already acted on those petitions. Ervin Higgs, Property Appraiser, brought to the Board 's attention petition H-002 which was a part of agenda item B-2, and noted that it was not a homestead but a request for agicultural exemption. Motion was made by Commissioner Harvey and seconded by Commissioner Jones to reconsider petition H-002-1990 as it was a request for agri- • * cultural exemption. Motion carried unanimously. Motion was made by Commissioner Jones and seconded by Commissioner Campbell to approve agenda item A-2 consisting of H-056, H066, H082 H083 and H102. Motion carried unanimously. Motion was made by Commissioner Jones and seconded by Commissioner London to deny the requested agricultural sta- tus of petition H-002, Melvin and Delores Brewer for Lime Grove Business, as the petitioner had failed to overcome the presumption of correctness of the Property Appraiser ' s Office. Roll call vote on the motion was taken with the following results: Commissioner Caron Yes Commissioner Campbell Yes Commissioner Jones Yes Commissioner London Yes Mayor Harvey No Motion carried. Motion was made by Commissioner Campbell and seconded by Commissioner Caron to approve agenda item B-1, (attached hereto) . Motion carried unanimously. The Board briefly discussed petition 134-1990, Jeffrey L. Mandler for Barnett Bank, listed on agenda item B-2 (attached hereto) , with Property Appraiser Ervin Higgs and Special Master Jim Flenner . Charlton Courtney and Phil White of the' Property Appraiser ' s Office discussed the methodology used in assessing petition 134-1990. Motion was made by Commissioner Jones and seconded by Commissioner Caron to deny the Special Master 's assessment of petition 134-1990 and reinstate the Property Appraiser ' s assessment, as the petitioner had failed to overcome the presumption of correctness . Roll call vote was unanimous. Motion was made by Commissioner Jones and seconded by Commissioner Caron to approve those remaining agenda items on B-2 petitions 107, 135, 137, 138, 147 and 186. Roll call vote was unanimous. Motion was made by Mayor Harvey and seconded by Commissioner Caron to approve agenda item B-3 (attached hereto) . Roll call vote was unanimous. Motion was made by Commissioner Campbell and seconded by Commissioner Caron to approve those bills sub- mitted by the Special Masters as presented, under agenda item C (attached hereto) . Roll call vote was unanimous. Special Master Raymond Bishop addressed the Board and requested that the Board approve those bills submitted by the Special Masters for today' s hearing. Motion was made by Commissioner Caron and seconded by Commissioner Jones to approve those bills submitted for today ' s hearing. Motion carried unanimously. Attorney Hugh Morgan addressed the Board concerning petition H-003-1990, Shrimp Culture, Inc. The Board entered into a discussion with Special Master Jim Flenner , Assistant County Attorney Mary Greenwood, and Property Appraiser Ervin Higgs concerning Ms. Greenwood's memo on the Pisciculture Industry and F. S. 193. 461 (5) . Mr . Morgan read for the record Doyle Conner 's decision on the agricultural industry, and an opinion by the Attorney General regarding catfish farming as agricultural industry. Motion was made by Commissioner London and seconded by Commissioner Jones to approve the request for agricultural exemption on petition 411 cultural exemption. Motion carried unanimously. Motion was made by Commissioner Jones and seconded by Commissioner Campbell to approve agenda item A-2 consisting of H-056, H066, H082 H083 and H102. Motion carried unanimously. Motion was made by Commissioner Jones and seconded by Commissioner London to deny the requested agricultural sta- tus of petition H-002, Melvin and Delores Brewer for Lime Grove Business , as the petitioner had failed to overcome the presumption of correctness of the Property Appraiser ' s Office . Motion was made by Commissioner Campbell and seconded by Commissioner Caron to approve those bills sub- mitted by the Special Masters as presented, under agenda item C (attached hereto) . Petitioner H043-1990, Bartholomew Hovanic, addressed the Board concerning his request for homestead exemption. Jim Flenner and Phil White addressed the Board concerning the Special Master ' s decision to deny. Motion was made by Commissioner Jones and seconded by Commissioner Campbell to deny the request as the petitioner had not over- come the presumption of correctness . Roll call vote was unanimous. Petitioner H049-1990, Perry Killin, addressed the Board concerning the Special Master ' s decision to deny the homestead exemption on his property. After brief discussion, motion was made by Commissioner Campbell and seconded by Commissioner Caron to approve the petitioner ' s request, subject to the receipt of a letter from the Appraiser ' s Office in Indiana stating that Mr . Killin did not have a homestead in that State . Motion carried unani- mously. Petitioner H103-1990, Gerald Fuchs addressed the Board concerning the Special Master ' s decision to deny the homestead exemption on his property. After brief discussion, motion was made by Commissioner Jones and seconded by Commissioner Caron to grant the petitioner 's homestead exemption, pending the receipt of a letter within thirty days from the Appraiser 's office in Indiana stating that Mr . Fuchs did not have a homestead in that State. Motion carried unanimously. Petitioner 003-1990, Nathan Eden addressed the Board . Special Master Jim Flenner and the staff of the Property Appraiser ' s office briefly discussed the assessment on Mr . Eden 's property. Mayor Harvey questioned the Property Appraiser 's staff on the method used to assess the subject property. The Property Appraiser 's staff agreed to discuss the assessment with Mr . Eden and try to resolve the petition before the end of today' s meeting . THE FOREGOING PETITION 003-1990 WAS CONSIDERED LATER IN THE MEETING. Property Appraiser Ervin Higgs addressed the Board and requested that petitions 114-1990, Safe Harbor Marina, and 151-1990, Key West Resort Golf Course, be postponed as Attorney John Dent was not present to represent the Property Appraiser 's Office. Attorney Jim Hendricks, Mary Greenwood and Jim Flenner addressed the Board concerning petition 151-1990. Motion was made by Commissioner Jones that the petition for non-taxable exemption be granted on the basis • that the property does serve the public of Key West and the Lower Keys. Motion died for lack of a second. Motion was made by Mayor Harvey and seconded by Commissioner Jones to postpone as the attorney for the Property Appraiser was not present. Roll call vote was taken with the following results : Commissioner Caron Yes Commissioner Campbell Yes Commissioner Jones Yes Commissioner London No Mayor Harvey Yes Motion carried. Property Appraiser Ervin Higgs addressed the Board regarding the settlement that had been reached between his office and petitioner 003-1990, Nathan Eden. Motion was made by Commissioner Jones and seconded by Commissioner Campbell to find the value of the property to be $322, 589. 00, as agreed upon by the petitioner and the Property Appraiser 's Office. Roll call vote was unanimous . Petitioner 114-1990, Safe Harbor Marina/Roger Bernstein, addressed the Board concerning his petition. Special Master Ray Bishop addressed the Board concerning his decision of denial on the petition. After discussion, the Board directed the Clerk to the Board to furnish copies of any information provided by the petitioner to the Board for their review prior to the next meeting. Motion was made by Commissioner Jones and seconded by Mayor Harvey to postpone the hearing on petition 114-1990 (Alex ' s Junkyard) . Roll call vote was unanimous. Petitioner 010-1990, Bruce Bryant/Lazy Lakes, addressed the Board concerning the Special Master ' s decision of denial. Phil White of the Property Appriaser ' s office addressed the Board . Motion was made by Commissioner Jones and seconded by Commissioner London to assess the property at $700, 000. 00 based on the sale price and the fact that the actual income generated on the property does not come anywhere near the income that was used by the Property Appraiser , and that the Petitioner presented evidence that overcame the Property Appraiser ' s presumption of correct- ness . Roll call vote was unanimous . Petitioner 055 and 056-1990, Dan O'Gorman/Gilberts Resort and Marina, addressed the Board . Agent for the petitioner , Juan Figueras, also addressed the Board. Carl Hamp of the Property Appraiser 's office addressed the Board concerning the methods used in assessing the property. Motion was made by Commissioner Jones and seconded by Commissioner Caron to appraise the petitioner ' s property at $1,909, 507. 00 using the actual income figures that the petitioner produced and based on the income approach that the petitioner had overcome the presumption of correctness of the Property Apraiser 's office. Motion to amend was made by Commissioner Campbell to include the wording "and a large percentage of other marinas were assessed using the income approach" . Motion to amend was accepted by the maker and the seconder . Roll call vote was unanimous. Larry Puyanic addressed the Board concerning his petition 164 and 165-1990, Tavernier Town Shopping Center . After discussion between the petitioner , the Board, and the Special Master concerning the subject property, motion was made by Commissioner Jones and seconded by Commissioner Caron to deny the appeal on Petitions 164 and 165 and uphold S the Property Appraiser ' s appraisal. Roll call vote was una- nimous. Motion was made by Commissioner Jones and seconded by Commissioner London to reconsider petition 174-1990 as the applicant was not present to sign a request sheet to address the Board at the beginning of the hearing. Motion carried unanimously. Petitioner 174-1990, John Brier , addressed the Board concerning the Special Master ' s denial of his petition. Special Master Jim Flenner and Phil White from the Property Appraiser 's Office addressed the Board. Motion was made by Commissioner Jones and seconded by Mayor Harvey to uphold the Property Appraiser 's assessment based on the income analysis available . Roll call vote was unani- mous. Attorney Hugh Morgan addressed the Board and requested that Petition H003-1990 be reconsidered by the Board. Motion was made by Commissioner Jones and seconded by Commissioner Campbell to reconsider petition H003-1990 due to additional information made available. Roll call vote was unanimous . Attorney Morgan addressed the Board concerning the issue of whether or not shrimp farming should be treated as an agricultural purpose under F. S. 193. 461. After discussion, motion was made by Commissioner London and seconded by Commissioner Jones to reverse the Special Master 's decision based on the interpretation of the Florida Statute and the Attorney General' s opinion. Roll call vote was taken with the following results : Commissioner Caron No Commissioner Campbell No Commissioner Jones Yes Commissioner London Yes Mayor Harvey Yes Motion carried. Motion was made by Commissioner Campbell and seconded by Mayor Harvey to authorize the Tax Collector to release the bills on those petitions that the Board had decided on today, with the exception of those two items that were postponed.
