12/19/1988 Hearing Property Appraisal Adjustment Board Monday, December 19, 1988 Key West A meeting of the Property Appraisal Adjustment Board convened at 9 : 00 a.m. on the above date at 310 Fleming Street, Key West. Present and answering to roll call were Dr . Geraldine Caron, Commissioner Doug Jones , Mr . Richard Padron, Commissioner John Stormont and Chairman Michael Puto. Also present were Danny L. Kolhage, Clerk ; Diana Gene Collins , Deputy Clerk; Ervin Higgs , Property Appraiser ; John Dent, Attorney for the Property Appraiser ; Randy Ludacer , County Attorney; Calvin Allen, Assistant County Attorney; and Staff from the Property Appraiser ' s office. The Board recognized Special Masters Jim Flenner and Flo Chabin in the audience. Raymond P. Bishop was delayed due to a flat tire. Motion was made by Commissioner Stormont and seconded by Mr . Richard Padron to grant Homestead Exemptions to H-37 (Fuchs) and H-50 (Hoch) . Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Dr . Caron to deny remaining Homestead Petitioners per attached list, marked as Exhibit "A" . Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Mr . Richard Padron to pay for the Special Masters ' invoices attached , marked as Exhibit "B" . Motion carried unanimously. The Board entered into a discussion regarding Petition #001-1988 (Maxwell) . The Petitioners addressed the Board and stated why they had requested the agricultural exemption for the entire tract. John Dent indicated to the Board why the agricultural exemption could not be on the whole parcel, but only on the used portion of the tract. Motion was made by Commissioner Stormont and seconded by Commissioner Jones to approve the Special Master ' s recommendation of 1. 5 acres to be agricultural exempt. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Mr . Padron to deny the remaining 3. 17 acres. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Jones to approve the Special Masters recommendations to decrease the following assessments : 057-1988 - Gladys Mulberg $607, 091. 00 to $473, 944. 00 104-1988 - Southernmost Affiliates, Ltd. , c/o John Pelzer , Esq. $15, 903, 116. 00 to $14, 402, 803. 00 Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Jones to uphold the Property Appraiser ' s assessment of the Petitioners who did not appear • for their hearings , per attached list, marked as Exhibit "C" . Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Jones to uphold the assessment by the Property Appraiser ' s Office of Petitioners 2, 19, 42, 43, 44, 56, 58, 59 , 64, 65, 68, 69, 70, 71, 72, 85, 94, 111, 114, 115, 116, 129, 134 and 145-1988. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Dr . Caron to decrease 124-1988 (O'Gorman) to $2, 523, 550. 00. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Mr . Padron to decrease 127-1988 ( (Weller) to $354 , 243. 00. Motion carried unanimously. Petitioner Samuel Scherer (024-1988) addressed the Board. Motion was made by Commissioner Jones and seconded by Commissioner Stormont to assess at the 1987 assessment of $53, 155. 00. Roll call vote was taken with the following results: Dr . Caron Yes Commissioner Jones Yes Mr . Padron No Commissioner Stormont No Mayor Puto No `lotion failed. Motion was then made by Commissioner Stormont and seconded by Mr . Padron to refer back to Special Master for re-hearing. Motion carried unanimously. Attorney Charlene Grant, representing Thomas Lupo (020-1988) , addressed the Board. Motion was made by Mr . Padron and seconded by Commissioner Stormont to return to Special Master for re-hearing. Motion carried unani- mously. The Board was advised that new evidence could be received by the Board and Special Master at re-hearing prior to the full hearing in front of the Property Appraisal Adjustment Board. Charlene Grant, representing Petitioner Lupo (025-1988) , addressed the Board. Motion was made by Commissioner Jones and seconded by Commissioner Stormont to return to Special Master for re-hearing with 020-1988. During discussion, Clerk told the Board that the previous notion had to be withdrawn if the Board was to reconsider the Petitions . Motion was then made by Commissioner Jones and seconded by Dr . Caron to reconsider the previous Petition (020-1988) . Motion carried unanimously. Flo Chabin, Special Master for the Middle Keys , was asked by the Board how she arrived at her recommendations . There had been an agreement with the Property Appraisal Office to go out to re-measure and re-evaluate the property. She stated that she agreed with the Property Appraiser ' s findings . Motion Baas then made by Commissioner Jones and seconded by Dr . Caron for the assessment to stand at $1, 025, 500. 00 on Petition 020-1988. Roll call vote was unanimous . The Board then discussed Petition 025-1988. Flo Chabin was asked how she arrived at her recommendation. After discussion with Property Appraiser ' s office , Motion was made by Commissioner Jones and seconded by Dr . Caron to uphold the assessment of $643, 078. 00. Roll call vote was taken with a unanimous esult. The Clerk advised the Board they were in receipt of locuments that were sent Federal Express by Petitioners Akers and Henning (047, 048, 050, 051, 052, 053 and 055-1988) with a letter dated 12/13/88. The Board advised the Clerk to return the documents , inasmuch as new evidence could not be admitted at this hearing. Sara Cook, repre- • senting the Petitioners , addressed the Board regarding this natter . Motion was made by Commissioner Stormont and seconded by Dr . Caron to uphold the assessment. Motion carried unanimously. Frank Greenman, attorney reprsenting Pirates Cove Villas (133-1988 through 138-1988) , after discussion of the Board , motion was made by Commissioner Jones and seconded by Commissioner Padron to uphold assessment. Motion carried unanimously. Mike Halpern, attorney representing Petitioner Hawk 's Cay Investors , Ltd. , addressed the Board. Motion was made by Commissioner Jones and seconded by Mr . Padron to send Petition #139-1988 back to the Property Appraiser ' s Office for them to use actual income figures and recompute the assessment. Roll call vote was taken with the following results : Dr . Caron Yes Commissioner Jones Yes Mr . Padron Yes Commissioner Stormont No Mayor Puto Yes Motion carried . Frank Greenman, attorney, addressed the Board on behalf of Petitioners Brier (132-1988) . Motion was made by Commissioner Jones and seconded by Mr . Padron to send back to Property Appraiser ' s office for reassessment. Roll call vote was taken with the following results : Dr . Caron No Commissioner Jones Yes Mr . Padron Yes Commissioner Stormont No Mayor Puto Yes Motion carried . Mike Halpern, attorney for MaryLin Johnson (060-1988) , addressed the Board. Commissioner Jones stated that he would have to abstain from this matter due to a conflict of interest. The County Attorney ruled on the conflict and stated that Commissioner Jones should not vote. Motion was made by Dr . Caron and seconded by Commissioner Stormont to accept the Special Master ' s recommendation of $150, 000. 00. Roll call vote was taken with the following results : Dr . Caron Yes Mr . Padron Yes Commissioner Stormont Yes Mayor Puto No Motion carried . Arthur Lujan, (102-1988) agent for Laureen Moore, requested the Board to grant a continuance to another hearing so that he could introduce additonal information. Motion was made by Commissioner Jones and seconded by Commissioner Stormont to return to Special Master for re- hearing. Roll call vote was taken: Dr . Caron No Commissioner Jones Yes Mr . Padron Yes Commissioner Stormont No Mayor Puto Yes • Motion carried. Petitioner Jody Joiner (123-1988) addressed Board and stated that he filed the proper returns as advised him by John Dent. Ralph Smith (125-1988) addressed the Board. Motion was made by Commissioner Jones and seconded by Mr . Padron to refer back to Special Master for rehearing. Roll call vote was taken with the following results: Dr . Caron No Commissioner Jones Yes Mr . Padron Yes Commissioner Stormont No Mayor Puto Yes Motion carried. During recess , Petitioner Joiner (123-1988) approached the Board to state that the Property Appraiser ' s Office and he had reached an agreement; they had reduced the assessment to $89 , 999 . 00 and he had accepted the reduction.
