RESOLUTION NO. 138 -1997
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, EVIDENCING THE BOARD'S APPROVAL OF FIVE ORDERS
OF DETERMINATION OF VESTED RIGHTS PROMULGATED BY THE VESTED
RIGHTS HEARING OFFICER PURSUANT TO THE VESTED RIGHTS HEARING HELD
ON MARCH 27,1997 IN RE: EDWARD, VeETTA, AND VALERIE BALDWIN/VICKI
JACHOWSKI/VIVIAN ETMANCZYK; DANIEL AND BARBARA COCKERHAM;
GARY AND JEANNE ZARET; WANDA VAN BRUNT GAUSE; AND JOHN S. ELY
WHEREAS, on January 4, 1996, the Monroe County Year 2010 Comprehensive Plan became
effective; and
WHEREAS, development applications "in the pipeline" as of January 4, 1996 are subject to a
determination of vested rights pursuant to Policy 101.18.1 of the Plan; and
WHEREAS, a hearing for determination of vested rights was held before the County's Vested
Rights Hearing Officer, Mr. Randy Sadtler, Esq., on March 27, 1997; and
WHEREAS, pursuant to the hearing held on March 27, 1997, the Hearing Officer has
promulgated five Orders for Determination of Vested Rights regarding applications for
development in Monroe County; NOW THEREFORE
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA
that
Section 1. The Board hereby adopts this Resolution as evidence of its approval of the
Orders of the Vested Rights Hearing Officer, promulgated pursuant to a Vested Rights Hearing
held on March 27,1997 for the following development applicants: EDWARD, VeETTA AND VALERIE
BALDWIN/VICKI JACHOWSKI/VIVIAN ETMANCZYK; DANIEL AND BARBARA COCKERHAM; GARY AND
JEANNE ZARET; WANDA VAN BRUNT GAUSE; AND JOHN S. ELY.
