W Martello Tower Sea Wall Repair 04/23/2019 TASK ORDER FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES BETWEEN MONROE COUNTY AND CPH, INC. FOR SEA WALL REPAIR PROTECTING THE WEST MARTELLO TOWER In accordance with the Consultant Agreement for Professional Architectural and Engineering Services ("Agreement"), made and entered on December 19, 2018, between MONROE COUNTY, hereinafter referred to as "County'" and CPH, INC., hereinafter referred to as "Consultant", wherein professional services are allowed if construction costs do not exceed $2,000,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $200,000.00. All terms and conditions of the Agreement apply to this Task Order, unless the Task Order modifies an Article of the Agreement of which will be specifically referenced in this Task Order and the modification shall be precisely described. These additions apply only to the project referenced in this Task Order. This Task Order is effective April —f , 2019. The Sea Wall protecting the West Martello Tower sustained damage due to high winds, storm surge, and flooding caused by Hurricane Irma in September, 2017. The damages to the wall include cracking, undermining, spawling, and rip rap repair. The damages must be documented prior to beginning any design or restoration efforts to restore the wall to pre-Hurricane Irma conditions. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement the Consultant will perform services as described below: 1. Consultant shall evaluate and document the wall damage resulting from Hurricane Irma. The detailed repair evaluation will require surveying including a topographic survey, structural assessment, prepare and process permit applications (FDEP & U.S. Army Corps of Engineers), construction drawings referring to recommendations and specifications for repair, and project coordination including construction administration during the repair of the Sea Wall. Page 1 SCOPE OF SERVICES A. SURVEYING Too rat hic Surve : Perform a Topographic Survey as per Rule Chapter 5J-17 of the Florida Administrative Code in compliance with the Standards of Practice of Surveying and Mapping of the State of Florida.. 0 25' topographic grid and 5' on each side of the seawall for approximately 700' (see "Survey Site Exhibit"for limits). • Survey will be based on NAVD 88 datum. M Horizontal and vertical locations at 25' grid along existing roadways up to the centerline of roads. The following related services are not included in the scope of this proposal, and may or may not be required, but can be provided at an additional fee: ALTA/NSPS Lana Title Survey, Boundary Survey, Underground Utility Location/Designation, Wetland Delineation/Location, Tree Location, As-built Survey, Platting, Sketch and Descriptions and Ordinary High Water/Mean High Water. ENVIRONMENTAL SERVICES CPH, Inc. has been requested to prepare and process permit applications with the Florida Department of Environmental Protection(FDEP)and the I .S. Army Corps of Engineers(ALOE) to restore the Higgs Beach Seawall to prevent further erasion and stabilize the shoreline. The County will repair the existing seawall. Mitigation is not a consideration of this permit process. FDEP Perrni tin CONSULTANT shall prepare ecological elements of the SWERP Permit application and environmental report. ➢ Conduct a survey and document the resources within, and adjacent to, the project area. ➢ Conduct one (1)pre-application with this FDEP. ➢ Coordinate with the Client and the Project Engineer as may be required in the preparation of the ecological elements of the Statewide Environmental Resource Permit (SWERP) Individual Permit application to FDEP. ➢ Prepare written responses to one (1) Request for Additional Information (RAI) Letter by the FDEP regarding ecological elements of the ERP application prepared by CONSULTANT. .!UPS. Atu rr�_ 9fC9M8Af Erg irwe P" rrwitt�"ag CPH shall prepare and submit an application to the ACOE. ➢ Prepare the ACOE application forms and provide supporting information to meet the ACOE requirements. ➢ Provide a narrative description of direct, indirect and adverse cumulative impacts anticipated as a result of impacts to the wetlands. ➢ Archaeological and Historical Resources: CPH will submit all archaeological/historical information as prepared by others with the ACOE application. Archaeological study if required will be provided as an additional service. ➢ CPH will prepare draft responses to one (1) Request for Additional Information (RAI) Letter requested by ACOE regarding environmental comments. C. STRUCTURAL SERVICES Assessment Site Mkt And Report- An assessment site visit will be performed to gather information related to the existing wall conditions. A report will be submitted with findings and recommendations. Sea 'Wall R r r_recommendations and CD's- After all issues have been identified we will provide repair and/or retrofitting details for the sea wall and will submit construction drawings and specifications. D. PROJECT COORDINATION CPH, as the project Civil Consultant, will take the lead in coordinating the overall scope of work,, including monitoring the scheduling of the services in relation to project submittal milestones, and assembly of submittal packages for the regulatory agencies. CPH will Page 4 schedule and preside over team coordination meetings (as necessary), and will prepare and maintain a 'Project Master Schedule'. This task will be performed and billed as a lump sum service. Refer to the Compensation section of this proposal for the proposed fee. CLIENT-FURNISHED INFORMATION It is understood that CPH will perform services under the sole direction of the CLIENT. In the performance of these services, CPH will coordinate its efforts with those of other project team members as required. The CLIENT shall provide CPH with project-related technical data including, but not limited to, the following: • Project size, location, identification number, and building program. • Current title commitment and any existing boundary and topographic surveys and: plats. If CPH is not performing surveying services as part of the contract, CLIENT to provide current boundary and topographic information in AutoCAD 14 or more recent version, or DXF format. • Previous Environmental investigation reports. • Previous Geotechnical investigation reports. • Master plan or development plans for the overall project. Preferably in AutoCAD 14 or more recent version, or DXF format. • Any other pertinent information concerning this project to which the CLIENT may have access. Page 5 2. In accordance to the Agreement Article III Paragraph 3.2 if additional services are required,the County shall request such services in writing and the Consultant shall respond with a fee proposal to perform the requested services. 3. In accordance to the Agreement Article VII, `paragraph 7.1.1, the County shall pay the Consultant, upon delivery of the detailed damage description evaluation, a lump sum of twenty- six thousand two hundred and fifty dollars and zero cents($26,250.00)paid on a percent complete basis for the following phases: a. Surveying - $4,250.00 upon document review and approval by the Director of Project Management. a. Environmental-$8,000.00 upon document review and approval by the Director of Project Management. b. Structural- $10,500.00 upon document review and approval by the Director of Project Management. c. Project Coordination/Construction Administration -$3,500.00 upon final acceptance 4. The undersigned shall accomplish Final Completion of the Project Assessment within Ninety (90) calendar days thereafter.
