ITEM BACKGROUND: The final engineer's project cost estimate, prior to bidding was $2,506,412.00. The project was advertised for construction bids on August 31, 2018. Two bids were received on October 25, 2018, with American Empire Builders, Inc. (AEB) being the low responsible/responsive bidder at $1,960,000.00. The Florida Department of Transportation (FDOT)provided concurrence to award to AEB on November 1, 2018 and is funding $1,760,000 toward the construction cost. The Tourist Development Council (TDC)is funding $200,000 toward the construction cost. After bid award and construction notice to proceed was issued, the Construction Engineering and Inspection (CEI) services firm, WSP USA, INC. and the contractor discovered a plan error on the weight calculation for the bid item 460-1-15 - structural steel rehabilitation. On March 1, 2019, Metric Engineering, Inc., the Engineer of Record (EOR), WSP USA, INC. and staff conducted a site visit to verify this discrepancy and assess any other unaddressed rehabilitation issues. An initial field report was provided by the FOR on March 20, 2019, but additional questions and discrepancies required a subsequent detailed analysis. On April 1, 2019, the FOR provided a revised steel rehabilitation bill of materials for the project which is documentation to this Change Order 1. AEB provided a negotiated line item price for the bid item, reduced from $75.00 per pound as originally bid to $60.75 per pound. The Florida Department of Transportation (FDOT) provided concurrence with this Change Order 1. No additional funding is available from the FDOT for change orders: per Section 3.01 of the LAP Agreement, "the Agency agrees to bear all expenses in excess of the total cost of the project and any deficits involved". Staff will be submitting a TDC application due on April 24, 2019 to fund work Packet Pg.404 C.6 under this change order. The Pigeon Key Ramp (FDOT bridge 4 904480) was built in 1938 and is a contributing resource to the Pigeon Key Historic District which is listed on the National Register of Historic Places (NRHP). The ramp connects the Old Seven Mile Bridge to Pigeon Key, providing the primary access to and from the island. The ramp has deteriorated and requires substantial rehabilitation. The ramp replacement construction plans maintain the overall appearance and basic design of the original structure. In February of 2017, the Monroe County Planning Department provided Historic Preservation Resolution HP5-17, approving a special certificate of appropriateness to rehabilitate and substantially replace the Pigeon Key Ramp. In March of 2017, the Florida State Historic Preservation Officer (SHPO) provided a no adverse effect concurrence for the rehabilitation of the Pigeon Key Ramp. In March of 2014, the BOCC entered into an agreement with the FDOT for repairs to the Old Seven Mile Bridge 2.2 mile segment that connects Knights Key to Pigeon Key. These repairs are in progress. PREVIOUS RELEVANT BOCC ACTION: February 20, 2019 — the BOCC approved a Florida Department of Transportation (FDOT) Supplemental Local Agency Program (LAP) Agreement transferring $90,000.00 in funds from construction to construction engineering and inspection services; increasing the County match in the amount of$9,910.00; and extending the grant expiration date to December 31, 2019. February 20, 2019 — the BOCC approved Amendment 1 to the WSP USA, Inc. Construction and Engineering Inspection Services contract in the amount of $22,149.19, to add an Archeological Monitoring position as required by the SHPO, for a revised total contract amount of$305,398.09. December 19, 2018 — the BOCC approved the construction contract award with American Empire Builders, Inc. for construction of the Pigeon Key Ramp Rehabilitation Project in the amount of $1,960,000.00. September 19, 2018 — the BOCC approved a contract with WSP USA, Inc for Construction Engineering and Inspection Services (CEI) for the Pigeon Key Ramp Rehabilitation Project in the amount of$283,248.90. July 18, 2018 — the BOCC approved negotiations with WSP USA, Inc., the highest ranked respondent for Construction Engineering and Inspection Services for the Pigeon Key Ramp Rehabilitation Project. January 17, 2018 — the BOCC approved a LAP agreement with the FDOT in the amount of $2,075,000.00 to include construction and construction engineering and inspection services for the Pigeon Key Ramp Rehabilitation Project. July 20, 2016 — the BOCC approved Amendment 1 for a lead survey to the contract with Metric Engineering, Inc. for Engineering Design and Permitting Services for the Pigeon Key Ramp Rehabilitation Project and the transfer of funds between tasks resulting in no increase to the contract. April 15, 2015 — the BOCC approved a contract with Metric Engineering, Inc. for Engineering Design and Permitting Services for the Pigeon Key Ramp Rehabilitation Project in the amount of $205,959.71. This gives a section with the same weight and a stronger section it is also much similar to make connections between column and cap and base. We also used this section for the repair of the columns which should reduce labor. We have anticipated the replacement of all connection at the top of the columns in Pier 1 (per our field visit). We have replaced all base plates with 24x12x3/4 plates two 7/8" inch diameter. Anchor bolts per base. New connection angles are also included.
