AGENDA ITEM WORDING: Discussion of misdemeanor probation services and direction on
whether to pursue bringing these services in-house through a request to Court Administration of the
16th Judicial Circuit to run the program or continuing with the current privatization of services
through the competitive solicitation process.
ITEM BACKGROUND: F.S. 948.15 provides for misdemeanor probation services to be provided
by a private or public entity. The County currently has a contract with a private company for
misdemeanor probation services, which will expire on September 1, 2019. This agenda item seeks
direction from the Board on whether County staff should pursue bringing the services in-house or
proceed with seeking proposals from private vendors through the County's competitive solicitation
process.
Under the current contract, the County does not allocate funding for misdemeanor probation service
as the contractors collect and retain a monthly cost of supervision fee in the amount of$50.00. The
number of persons on probation varies, but ranges in Key West from 200 to 430, in Marathon from
60 to 230 and in Plantation Key 200 to 275 and approximately 560 to 765 in total.
If directed, County staff would need to determine what the costs would be to run the program and
the ultimate goal is for the program to pay for itself from the collection of the cost of supervision
fees imposed while on probation. While it is anticipated that the program would eventually pay for
itself, there will be a need for a budget allocation to begin the program. While the prior private
vendors have not been insufficient, by bringing the services in-house there is a potential for the
County to have more oversight of the program and to provide an improved service. In some other
jurisdictions, Court Administration operates misdemeanor probation services. County staff, if
directed, would seek to pursue such an arrangement with Court Administration.
Misdemeanor probation services are generally for minor offenses in which the defendant is placed
on probation for a period is up to 1 year by a County Court Judge. Please be advised that felony
offenders sentenced in Circuit Court and placed on probation are supervised by the Florida
Department of Corrections, which is separate from misdemeanor probation services contemplated
