Original demand for settlement was $205,000. The parties agreed on a settlement of$66,750.00, inclusive of attorney fees and costs for two dates of accident (6/12/1996; 6/8/2010) contingent on BOCC approval. There is no excess reimbursement on either date of accident as these claims did not exceed the self-insured retention. Initially,he experienced back and neck pain due to an accident on June 12, 1996. Subsequently,on June 8,2010,the claimant injured his right shoulder, lower back and neck. The claimant retired on May 28,2011. In terms of the June 12, 1996 date of accident, $3,850.38 of indemnity benefits have been paid. In terms of the June 8,2010 accident,no indemnity benefits have been paid however he received compensation of $4,632.00 for a Permanent Impairment Rating(PIR). Medical benefits amount to approximately$1,500 per year at this time.Medical costs over the life of this claim are expected to be at least$50,000. It is however, important to note that if the claimant begins to conduct a job search he could potentially seek permanent total disability(PTD)eligibility under either of the two dates of accident.This would expose the County to at least double of what we are recommending settlement for with this Agenda Item. It is believed that it is in the County's best interest to settle these claims in the amount of$66,750.00 inclusive of attorney fees and costs.
