AGENDA ITEM WORDING:
Approval of a resolution setting the time and place of January 16, 2014, 3:00 p.m. at the Harvey
Government Center in Key West for a public hearing to consider a request for the abandonment of a
portion of the right-of-way of Second Street on Stock Island that is located between Blocks 23 and 24
in Maloney Subdivision (Plat Book 1, Page 55). [The 2014 BOCC meeting dates will be determined at
the December 11, 2013 BOCC meeting]
ITEM BACKGROUND:
The petitioner has requested abandonment of a portion of the right-of-way of Second Street, as
described above, in order to improve access to and from nonresidential developments on Block 23
(Murray Marine) and Block 24 (proposed CVS). The petition involves the segment of Second Street
that is north of Laurel Avenue and south of the Overseas Highway(US 1).
Currently, vehicular access to/from Second Street to the Overseas Highway (US 1) is prohibited. If the
abandonment is granted by the BOCC, the petitioner would have to receive additional approval from
the Florida Department of Transportation to open access from the then-abandoned segment of Second
Street to US 1.

SOUTH RIGHT-OF-WAY LINE OF OVERSEAS HIGHWAY,
BOUNDED ON THE EAST BY THE WEST LINE OF BLOCK
23, MALONEY SUBDIVISION, ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK 1 PAGE 55 OF
THE PUBLIC RECORDS OF MONROE COUNTY, FLORIDA
AND BOUNDED ON THE SOUTH BY THE NORTHERLY
RIGHT-OF-WAY LINE OF LAUREL AVENUE, AND
BOUNDED ON THE WEST BY THE EAST LINE OF BLOCK
24 OF SAID MALONEY SUBDIVISION.
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter streets,
alley-ways,roads or highways,
WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public hearing
after publishing due notice of said hearing in accordance with said Chapter,now,therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Board will hold a public hearing on January 16,
2013, at 3:00 P.M. at the Harvey Government Center at Historic Truman School, 1200
Truman Avenue, Key West, Florida, to determine whether or not the Board will renounce and
disclaim any right of the County and the public in and to the following described streets,
alley-ways, roads, or highways as delineated on the hereinafter described map or plat,to-wit:
"A portion of Second Street on Stock Island, Monroe County, Florida, lying and being in
Section 35; Township 67 South, Range 25 East, bounded on the North by the South Right-of-Way
line of Overseas Highway, also known as State Road No. 5 and U.S. Highway No. 1 as shown on
State Road Right-of-Way Map Section #90020, Sheet 12 of 138 and bounded on the East by the
West line of Block 23, MALONEY SUBDIVISION, according to the plat thereof, as recorded in
Plat Book I at Page 55 of the Public Records of Monroe County, Florida and bounded on the
South by the Northerly Right-of-Way line of Laurel Avenue, and bounded on the West by the East
Line of Block 24 of said MALONEY SUBDIVISION, and being more particularly described as
follows:
Begin at the Southwest corner of said Block 23, said point lying on the North Right-of-Way
line of said Laurel Avenue; thence North 00°1235"East along said West line of Block 23, also
being the East Right-of-Way line of Second Street for 210.09 feet to the Northwest corner of said
Block 23 being a point on said South Right-of-Way line of Overseas Highway, also known as State
Road No. 5 and U.S. Highway No. ],- thence South 80°50'25" West along said South Right-of-Way
line for 50.68 feet to the Northeast corner ofsaid Block 24; thence South 00°12'35" West along
said East line of Block 24, also being the West Right-of-Way line of Second Street for 201.75 feet
to the Southeast corner of said Block 24; thence South 89°41'29"East along the North Right-of-
Way line of Laurel Avenue for 50.00 feet to the Point of Beginning."
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of the Board held on the 11`h day of December 2013.

Monroe County Code Section 19-1 -Abandonment of rights-of-way states:
(a) No dedicated and accepted right-of-way in the county shall be abandoned where:
(1) the right-of-way terminates on a body of open water;or
(2) the right-of-way provides access to the public to land ono water,or
(3) the abandonment would preclude a way for the public to maintain access to the water.
(b) In all other cases of abandonment,no right-of-way shall be abandoned unless there is an agreement to
do so by all affected property owners. For purposes of this subsection, an affected property owner is
the owner of property which,if the right-of-way is abandoned,will:
(1) Have access that is currently used by that property owner eliminated;
(2) Have the only platted access eliminated;
(3) Have the paved area adjacent to that property increased for tum-around purposes;or
(4) Be increased in size.
(c) A road may be abandoned only at the terminal portion of the road and in its full width unless the
abandonment will comply with the County Code requirements for road,turn-around,and fire-rescue
access and one of the following circumstances exists:
(1) An adjacent lot owner has on the platted right of way or within a setback a substantial
structure which predates the Special Session Law 59-1578 pertaining to maps,plats and right
of way.The to "substantial structure'specifically does not include wood or metal fences,
sheds or tiki huts or other items not listed which are accessory structures.

purpose-
(d) The board of county commissioners considers these a restriction on the rights of individuals who
desire to abandon properties in accordance with F.S. §336.09.

Florida registered surveyor — 12 sets (At a minimum, survey should include a legal description of the
roadway; elevations; location and dimensions of all existing structures, paved areas and utility structures;
roadways and easements; and all bodies of water on the site and adjacent to the site. The portion of the
roadway to be abandoned should be marked with diagonal lines and the petitioner's property should be
clearly delineated);
Letters of "No Objection" from all utility companies (Florida Keys Aqueduct Authority (FKAA);
Florida Keys Electric Cooperative (FKEC) or Keys Energy Services; telephone utility, gas utility, cable
utility,wastewater treatment authority,etc.);
Letters of-No Objection"from all affected property owners(an affected property owner is a)one who
would have a means of access to his or her property closed off as a result of the abandonment even though
he ors may not actually use the right-of-way prior to abandonment or b)one whose property abuts the
portion of the roadway to be abandoned);
IF A CUIDE-SAC OR -T-TYPE" TURNAROUND IS REQUIRED to be constructed, it will be the
responsibility of the Petitioner, if the road to be abandoned will result in an existing rock or paved road
being shortened. See Monroe County Code §9.5-296(p). Your petition should specifically state your
agreement to construct either the cul-de-sac or"T-type"turnaround per County Standard Specifications and
Details. (Should you need additional information regarding this matter,please contact the Monroe County
Engineering Department directly by phoning(305)292-4427).
If applicable,the following must be submitted in order to have a complete application submittal:
Notarized Agent Authorization Letter (note: authorization is needed from all owner(s) of the subject
property)
If deemed necessary to complete a ftdl review of the application, the Planning & Environmental Resources

limitation, electric power, water, sewer, telephone, gas, cable and other electric communication services to the
same extent as is common within this area as to height,width and degree,upon request for such service or by the

provided to the County before the petition is presented to the BOCC.

Road Abandonment Petition Additional Pages
Petitioner seeks the abandonment and the County should grant the road abandonment for
the following reasons:
This Road Abandonment Application is being filed by Keys Federal Credit Union ("Credit
Union')and Murray Marine Sales and Services, Inc. ("Murray Marine")to abandon a portion of
2'd Street on Stock Island, Monroe County, Florida ("Abandoned Property"). The proposed
Abandoned Property is located between Laurel Avenue and dead ends prior to US 1.
Historically, 2nd Street was connected directly to US I. Murray Marine also had an entrance
directly adjacent to the 2nd Street entrance to USI. In the 1970s, the Florida Department of
Transportation closed 2"d Street as an entrance to US I due to the proximity to the entrance to
Murray Marine when US I was expanded from I lane to 2 lanes. It has been closed ever since.
The Credit Union owns property located at 5610 Overseas Highway, Stock Island, Monroe
County, Florida("Credit Union Property"),which is located directly to the West of the proposed
Abandoned Property. Murray Marine owns property located at 5710 Overseas Highway, Stock
Island, Monroe County, Florida ('Murray Marine Property"), which is directly East of the
proposed Abandoned Property. US I is directly North of the road proposed to be abandoned, but
US I does not connect to 2d Street. Monroe County has jurisdiction over Laurel Avenue. No
other property owner is adjacent to, or abuts the proposed road to be abandoned.
Murray Marine Property currently has two access points directly to US I. One on the East Side
of the Murray Marine Property and the other is located on the West side of the property directly
adjacent to Second Street. According to communications with FDOT's permitting agent,
Infrastructure Corp. of America, Murray Marine's West entrance is a non-conforming US I entry
way due to its proximity to the East Entrance and the downslope to the parking area. In essence,
Murray Marine's West entrance is too close to the East Entrance and does not have a proper turn
off sufficient to provide vehicles time to de-accelerate when entering into the parking area. The
Florida Department of Transportation has offered to pay a portion of the cost to reconfigure
Murray Marine's entrance. The West entrance is required to be reconfigured should Murray
Marine undertake any redevelopment of its property. Murray Marine desires to relocate its
entrance way onto 2nd Street, but must have 2"d Street open to US I to accomplish its desired
reconfiguration.
The Credit Union is currently under contract to sell its property to Boos Development Group,
Inc. ("Boos") to be redeveloped into a CVS pharmacy pursuant to Development Order P 03-12.
Recently, Boos, on behalf of the Credit Union, applied for access to Yd Street, on the West side
of the Credit Union. The entry way access to Yd Street was denied by the Director of
Engineering. The Director of Engineering's denial was appealed to the Monroe County Board of
County Commissioners ("BOCC")and was subsequently denied by the BOCC on September 17,
2013. Credit Union has applied for a minor deviation to its Development Order to allow for
access to the Credit Union property on 2 d Street and Laurel Avenue. However, the 2 d Street
and Laurel Avenue access points would not have direct ingress and egress to USI, an important
aspect of a commercial retail business.
Moreover, access to US] from 2"d Street would provide a public purpose to residents of Stock
Island. The access to USI would alleviate traffic on P Street and allow residents and businesses
located along 2 d Street and Laurel Avenue direct access to their properties. It would also
provide direct access to Maloney Avenue without having to first traverse MacDonald Avenue. It
will also provide more access for emergency services both to and from US].
If 2d Street is not abandoned, Murray Marine may not relocate its entrance to 2d Street, leaving
in place the non-conforming access point to USI, nor can 2d Street be opened to allow direct
access to the proposed CV S pharmacy.

Dear Mr. Smith,
This is to acknowledge at the above referenced party has begun a coordination process with
EnergyKeys Services(KEYS).
Our Engineering Department has completed a preliminary review of the project submittal and
they have found the following as a part of their review.
• The Electrical High Voltage Underground Service will be providedl
number 1, which Is off of Third (3) Street.
• There are existing utilitypoles within the proposed foot print of the building.
The removals f these polesare the responsibilityof the owner/developer. KEYS
will disconnect the electrical service to them upon request.
• There is a down guy and pole located at pole n ( -1 ) which
plansthe appear to indicate tha need to have removed. If thisis the case, the
cost of the removal and/or relocation is the responsibility of theOwner/
Developer. If you wish to pursue this relocation/removal, we will need a formal
writtenrequest for this work and full payment prior to the start of the work being
scheduled. ate the cost at around $20,000.00. Our Engineering
Department will prepare a more detailed report which will have the actual costs
in greater detail.
• KEYS will require signed easements for the high voltage system for this project
as well as all necessary easementsi regard a main feeder that runs
along the existing road should this road a a private road If rCounty
grantsrequest to vacate/abandoned tha road.
• Please keep In mind that our current schedule Is running 12 weeks from the date final
approval and design Is made. In some cases, the electrical work schedule will not begin
until payment is received In advance of any work being scheduled.
• Is the developer considering any onsite energy management systems as load control?

I have reviewed the above-referenced application for abandonment of a portion of 2nd Street on
Stock Island The apl)licant has indicated [fiat they will provide confirmation that the adjacent
property owners will execute an agreement to keep the vacated portion of 2nd Street as a road,
which addresses nay concern about the proposed access drive to the CVS site on 2nd Street.
The Engineering Department has no further comments and does not object to the proposed
abandonment.
