Jacobs shall immediately submit any deviations from the County's standard terms and conditions to the County for review by the County's Purchasing Manager or their representative and such deviations shall not be accepted by Jacobs unless Jacobs receives express written approval thereof from the County's Project and/or Purchasing Manager or their representative. All documents issued by Jacobs hereunder shall be signed by Jacobs for the County if so directed. The ownership and title of all items purchased hereunder shall pass directly from the selling party to the County, and Jacobs shall at no time be a party to such transaction other than as agent of the County. The County shall have the unilateral right to have the cominitment authority of Jacobs, its employee or this limited agency LO authorization in its entirety revoked and cancelled at any time, with or without cause. City, County, and/or State agencies, other than plan revisions requested by such agencies, are included. • Government Agency cost for all building and engineering permit fees are not included in this proposal. The following task will be performed as part of the bid phase services: • Coordinate with the County Purchasing Department and the Airport to advertise for bids. • Coordinate with the County to provide electronic copies of the bid documents to prospective bidders • Prepare for and attend a project pre-bid conference Page 4 of 6 Packet Pg. 1272 • Prepare responses to address requests for information from prospective bidders • Prepare and coordinate the issuing one(1)addendum with the County purchasing department. • Revise bid documents as necessary for the addendum • Review bids for responsiveness • Prepare a bid tabulation • Make a recommendation for award based on review of the bid information submitted. QUALIFICATIONS AND ASSUMPTIONS For the purpose of providing a stipulated fee amount, this proposal has been based on the following qualifications and assumptions: LO • Design shall be based on site walk through and assessment report. Ir- • Permit issuance related work such as processing plans through City, County, C14 It- and/or State agencies, other than plan revisions requested by such agencies, are 0 z included. • Government Agency cost for all building and engineering permit fees are not included in this proposal. 0 • Construction Administration Services are not included. -19 U) • Proposal is based on the existing electrical systems having adequate capacity to properly serve the improvements.No major modifications to the existing electrical systems are included in this proposal. • MEP including lightning protection design is not included. • Structural engineering is limited to the roof elements required to support the proposed roofing systems. It is assumed the existing framing and decking are LO adequate to receive the new roof or roof repairs. EE&G's Statement of Services and Fee are presented below: U) STATEMENT OF SERVICES EE&G will provide environmental consulting and testing services to conduct limited asbestos renovation surveys of the interior and exterior areas of these 4 conjoined T-Hangars and stand alone Antique Hangar as specified by the Client. LO Task I —Asbestos Inspection 0 (n An EE&G asbestos inspector will conduct a walk-through of the building to visually assess a. suspect friable and nonfriable asbestos-containing materials (ACM)for condition, homogenous U) areas,and functional spaces. Upon receipt of notice to proceed, EE&G will collect up to 50 bulk 0 samples total from the renovation areas and transport the samples to our in-house asbestos laboratory for analysis. The estimate of 50 samples maximum assumes sampling of each homogenous area (HA) in the subject interiors and exterior areas of the five structures as per provided plans. E Task 2-Laboratory Analysis Bulk samples will be analyzed for asbestos content by polarized light microscopy (PLM) at EE&G's in-house asbestos laboratory. The laboratory analysis report will be included in the final asbestos survey report. EE&G anticipates that 50 samples will be adequate to complete the survey of the building. As per United States (US) Environmental Protection Agency (EPA) regulations, any liable materials found to contain less than 10%asbestos by visual estimation, may require analysis by the objective Point Count Method for confirmation of asbestos content. EE&G recommends only samples that are less than 1% (1 sample of 3) for this analysis. Task 3—Asbestos Closeout Package For each project, EE&G will prepare a final written report containing our findings, and recommendations, based upon the results of the inspection. Field diagrams and/or photographs will be provided in the report. The report will be reviewed and signed by a Licensed Asbestos Consultant. For an additional fee, EE&G can provide additional consulting services for the removal of identified friable ACM, nonfriable ACM, including bid assistance, contractor selection, and final air clearance monitoring. LIMITATIONS AND ASSUMPTIONS' The following limitations and assumptions apply to this proposal: 17 LO Ir- • EE&G may be required to collect roof and/or exterior samples to satisfy survey requirements. Although EE&G can temporarily patch sample holes, EE&G assumes no 0 responsibility for voiding of any roof warranties or for the integrity of the roof or temporary patch. EE&G recommends patching be conducted by a roofing contractor to maintain any roof warranty in force. 19 • Our fee is based on the collection and analysis of up to a maximum 50 samples. U) • The Owner of the prope rty,rty, or the Owner's authorized representative, will provide on- call,complete access to all areas of the building. • Some building materials may not be accessible or exposed due to renovation/modification activities that have occurred since original building construction. Any drawings and specifications developed pursuant to this Agreement are instruments of service, and as such the original documents, tracings, and field notes are and remain the property of EE&G regardless of whether the work for which they were prepared is executed. In the event that legal action is instituted to enforce any of the terms of this Agreement, the party which does not prevail shall pay the legal expenses of the prevailing party, including attorneys fees. f. The parties hereto each binds itself, its successors, executors, administrators and assigns to the other party to this Agreement and to the successors, executors, administrators and assigns of such other party in respect of all covenants of this Agreement. g. EE&G's liability for services to be rendered under this Agreement shall be limited to$250,000, unless Client pays for the assumption of additional liability by EE&G as a separate line item in Article 3,Basis of Compensation. h. If applicable, Client agrees that EE&G shall not be responsible for liability caused by the presence or release of hazardous substances at the site. The Client will either make others responsible for liabilities due to such conditions, or will indemnify and save harmless EE&G LO from such liability.
