#06/21/2019 Agreement TASK ORDER FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES BETWEEN MONROE COUNTY AND BENDER& ASSOCIATES ARCHITECTS, P.A. FOR PUBLIC DEFENDER'S OFFICE —316 SIMONTON STREET TENANT IMPROVEMENTS - PROGRAMMING In accordance with the Agreement for Professional Architectural and Engineering Services, made and entered into on December 19, 2018 between MONROE COUNTY, hereinafter referred to as the "County," and BENDER& ASSOCIATES ARCHITECTS, P.A., hereinafter referred to as "Consultant," where professional services are allowed if construction costs do not exceed Two Million and 00/100 Dollars($2,000,000.00), or for study activity if the fee for professional services for each individual study under the contract does not exceed Two Hundred Thousand and 00/100 Dollars ($200,000.00) ("Agreement") the parties enter into this Task Order. All terms and conditions of the Agreement apply to this Task Order, unless this Task Order amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically referenced in this Task Order and the amendment, addition, or modification shall be precisely described. These additions apply only to the project referenced in this Task Order. S'1" This Task Order is effective on the 2-1 of J u✓t°�— 2019. WHEREAS, the County has entered into a contract to purchase the property and included buildings at 316 Simonton Street,Key West("Property") for the purpose of providing office space for the Public Defender's Office of the 161h Judicial Circuit of Florida("PDO"); and WHEREAS, the County desires professional architectural and engineering services to plan, program and design tenant improvements at the Property. The County recognizes that the parcel is within the Historic District of the City of Key West and that one or more of the buildings on this parcel are historic and therefore protected under the land use plan and ordinances of the City of Key West. The County desires the tenant improvements to meet City of Key West and Historic Architectural Review Commission (HARC) requirements, while also serving the office space needs of the PDO The initial phase will include planning support, an assessment of the programmatic needs of the PDO, basic measurements of the existing buildings and grounds at the Property and a Report of Findings. Future phases may include full architectural design services which may include engineering analysis, structural design, civil site engineering design and mechanical, electrical and plumbing design. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: Page 1 of 2 1. In accordance with Article I1, SCOPE OF BASIC SERVICES, of the Agreement, the Consultant will perform services as described below: a. Programming. The Consultant shall meet with the Public Defender to establish the programmatic needs for the space, including offices, storage, IT, Break Rooms, restrooms, and all other components of a well-designed office utilizing all existing buildings. b. Existing Conditions Measurements. The Consultant shall measure the existing spaces and produce measured plans, sections and elevations and photos in preparation for eventual construction drawings. c. Final Report of Findings. The Consultant shall prepare a final report of findings that will include the program and floor plan for the proposed office. The report will include a summary of the information collected, the existing conditions information, a check of applicable building codes, as well as summary recommendations. 2. In accordance with Article VII,paragraph 7.1.1 of the Agreement, the County shall pay the Consultant a lump sum fee of Nine Thousand Five Hundred and 00/100 Dollars($9,500.00) paid on a percent complete basis for the Scope of Basic Services listed in Paragraph #1 above. All other Terms and Conditions of the Task Order shall remain in accordance with the Agreement and as amended.
