AGENDA ITEM WORDING: Approval to file a circuit court action to obtain a court order
authorizing the County to make all reasonable repairs including, and up to demolition which are
required to bring the unoccupied property located at 773 — 775 Pirates Road, Little Torch Key,
Monroe County, Florida owned by the Federal National Mortgage Association (FNMA) into
compliance and further authorization to initiate litigation against the property owners to enforce the
lien arising from code compliance case number CE16090097.
ITEM BACKGROUND:
This property is the subject of a Code Compliance case for the failure to remedy the unsafe
conditions, violating two (2)Unsafe County Ordinances, in 2016. Unsafe letters were mailed to the
property owner on October 6, 2016 and December 22, 2016. Since no action to correct the
violations was taken, a hearing was held on March 30, 2017 and the Special Magistrate found the
property in violation as cited and imposed a compliance date of April 20, 2017 with daily fines to
accrue if compliance was not achieved. The Final Order was recorded as a lien on June 15, 2017.
As a result of additional complaints, research revealed that as a result of Hurricane Irma, this
property was posted as destroyed on October 7, 2017. Therefore a referral was made to the Building
Official to document current conditions. Consistent with the attached policy approved by the BOCC
on June 15, 2011, the Building Official inspected the property whereby he determined that the
structure created an unsafe condition for the neighborhood and deemed the structure uninhabitable.
The structure is not occupied.
On December 10, 2018 research revealed a Certificate of Title recorded in the Clerk's office on
November 20, 2018 transferring the property to Federal National Mortgage Association (FNMA)
and a hearing was scheduled to obtain a new Final Order in the name of the current owner(FNMA),
to record the lien, and to amend the Final Order to reflect the additional violation as per the Building
Officials report dated June 21, 2018. The hearing was held on December 10, 2018 and the property
owner was represented by an attorney.
The motion was granted and the Special Magistrate further ordered that the County is hereby

authorized to make all reasonable repairs including demolition which are required to bring the
property into compliance and charge the Respondent(s)with the cost of repairs incurred by the
County, the costs of prosecution incurred by the County and any fines Ordered in this matter..
The ORDER AUTHORIZING A NEW FINAL ORDER AND ORDER AUTHORIZING
RECORDING OF THE ORDER AS A LIEN AND ORDER AUTHORIZING AMENDMENT OF
THE FINAL ORDER TO REFLECT ADDITIONAL VIOLATIONS DUE TO HURRICANE
IRMA and the associated FINAL ORDER was recorded as a lien on February 15, 2019.
As a result of additional complaints, staff requested another inspection by the Building Official on
April 11, 2019. Consistent with the attached policy approved by the BOCC on June 15, 2011, the
Building Official inspected the property whereby he determined that the structure created an unsafe
condition for the neighborhood and deemed the structure uninhabitable. As a result a letter citing
four(4)Unsafe County Ordinances was mailed to the property owner on May 1, 2019 giving the
property owners 30 days to comply.
Additionally, a NOTICE OF MOTION TO AUTHORIZE FORECLOSURE AND/OR MONEY
JUDGMENT/NOTICE OF HEARING was mailed certified mail on April 11, 2019. The return
receipt was signed on April 16, 2019. The hearing was held on May 30, 2019 and no one was
present for the respondent. The Special Magistrate imposed an ORDER AUTHORIZING
FORECLOSURE.
Staff has received no response, and the unsafe structure remains in place.
As of June 21, 2019 the fines have accrued for 213 days for a fine total of$159,750.00, and will
continue to accrue at $750 per day until compliance is achieved. Additionally,per F.S. §162.07(2),
if the local governing body prevails in prosecuting a case before the enforcement board, it shall be
entitled to recover all costs incurred in prosecuting the case before the board and such costs may be
included in the lien authorized under s. 162.09(3). To date these costs are $820.73 and continue to
accrue until the case is closed.
The county has exhausted all other mechanisms available to persuade the property owner to achieve
compliance. The subject property, in its current condition,presents a threat of fire or windstorm
hazard, deemed as a safety concern for the health, welfare and safety of property, residents, wildlife,
waterways, as well as impairing the quality of life for all surrounding properties
PREVIOUS RELEVANT BOCC ACTION:
On June 15, 2011 the BOCC approved a process and procedure for the removal of unsafe,
unoccupied, non-homestead structures of protect the health, safety and welfare of Monroe County
citizens.

To resolve this Code Violation you must obtain the necessary permits to cover the required work in
progress. If alteration of the existing building layout increasing or decreasing the floor area, structural
repairs or alterations, installation of new windows or doors, new electrical,plumbing or mechanical is
planned, a design professional must furnish the building department with plans for examination of the
alterations.

ITEM BACKGROUND:The overarching goal of Code Compliance is to protect the health safety and welfare
of property owners within Monme County by obtaining compliance with building and other codes established
by the Commission.At times,the normal administrative hearing process for Code Compliance does not provide

Because the Code Compliance administrative heating process doesn't always produce commplianc% due to its
inherent limitations,which doesn't achieve ultimate removal of unsafe struct<ues,staff is requesting this policy
be approved so the County can protect nadents and citizens from unsafe conditions.This process would allow
County attorneys to seek Board approval to proceed to a court to obtain a determination that e)dsting unsafe,
unoccupied, non hamrestead properties should be demolished. The Board budgeted $60,000 to accamVlish
demolition of these types of structures when property owners will not demolish on their own. The cost of
demolition would be liened against the property. co

Demolition Process
1. Once an order of demolition has been granted by the Court or the Special Magistrate and that
order has become final,the Code Compliance Director will place an item on the agenda for the
next BOCC meeting requesting the authorization of expenditure of fiords to demolish the
offending structure.
2. Once the BOCC approves the expenditure of funds for the demolition of a property,the Code
Compliance Department will issue a RF0 gr BM for demolition contractors. Z`
3. The: RFO or RFP will include as a minimum the demolition of the offending structure
and the hauling away of all associated debris. The Board may,at its sole discretion,may waive c�
any dumping fees at the County's transfer station.
