AGENDA ITEM WORDING: Approval of a Task Order with Bender & Associates, Architects
(Bender)in the amount of$81,200.00, for architectural design, structural engineering and permitting
for the replacement of the Higgs Beach Park Restroom. This project will be funded by a two-phase
TDC Grant.
ITEM BACKGROUND: The Higgs Beach Park restroom has endured many years of use and
environmental deterioration. In 2017, prior to Hurricane Irma, a contract for architectural services
was approved to produce two conceptual designs for the renovation (not replacement) of the
restroom. Neither of the presented conceptual designs were deemed acceptable. Hurricane Irma
inflicted additional damage to the restrooms and the feasibility of a renovation no longer made
financial logic. A complete replacement of the Higgs Beach Park restroom can be accomplished
within the footprint of the existing facility. However, because the location is in a high velocity (VE)
flood zone, significant geotechnical studies, structural and coastal engineering are required to meet
all environmental and building permit requirements. The proposed task order provides for these
services to be performed under an architectural and engineering continuing services contract with
Bender.
PREVIOUS RELEVANT BOCC ACTION: 12/19/18 - BOCC accepted TDC approval of a grant
for Phase I—Higgs Beach Restroom project in the amount of$456,000. 12/19/18 —BOCC approved
an architectural and engineering continuing services contract with Bender.

HIGGS BEACH PARK RESTROOM FACILITY
In accordance with the Consultant Agreement for Professional Architectural and Engineering
Services, made and entered into on the 19th day of December, 2018 between MONROE
COUNTY, hereinafter referred to as the "County," and BENDER & ASSOCIATES U
ARCHITECTS, P.A., hereinafter referred to as "Consultant," where professional services are
allowed if construction costs do not exceed Two Million and 00/100 Dollars ($2,000,000.00), or 0
for study activity if the fee for professional services for each individual study under the contract as
does not exceed Two Hundred Thousand and 00/100 Dollars ($200,000.00), hereinafter referred
to as the"Agreement" the parties enter into this Task Order. 0
All terms and conditions of the Agreement apply to this Task Order, unless this Task Order 0
amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically U)
referenced in this Task Order and the amendment, addition, or modification shall be precisely

This Task Order is effective on the of 2019.
WHEREAS, the County desires full architectural services to design and construct a new restroom
facility at Higgs Beach Park, replacing the existing facility. The desire is to place the new facility
in the same location as the existing structure. Therefore, the new restroom will be in a VE-10
velocity zone, so the structure and components must be able to be permitted as such. The County
desires a design that is architecturally compatible with the West Martello Fort and a design based U-
on a beachfront architecture theme. The design services will include a schematic design, code 0

analysis report, updated land survey, coastal engineering analysis, structural design, geotechnical

analysis, civil site engineering design as well as mechanical, electrical and plumbing design. W

NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the
parties agree as follows: 00

1. In accordance with Article 11, SCOPE OF BASIC SERVICES, of the Agreement, the

a. Consultant shall update the 2010 site survey for Higgs Beach Park. �

b. Consultant shall complete coastal engineering services that include a 100-year
storm recession analysis to determine the local scour elevations and wave loads
exerted on the proposed structures members. E

c. Consultant shall complete preliminary structural designs for two buildings located
on grade that resist hydrodynamic and hydrostatic loads and anchored to avoid E
floatation, collapse or lateral movement of the structures. 0
d. Consultant shall complete geotechnical services that include subsurface U)
information, laboratory testing and geotechnical engineering recommendations for
the proposed facility. The geotechnical exploration will include two standard
penetration test borings to depths of 30 feet below the existing ground with
continuous sampling performed to 10 feet and then samples will be collected at 5-
foot intervals. The boreholes will be grouted at the end of the drilling and the U
samples will be transported to the laboratory and examined and tested. The findings
along with an engineering analysis with recommendations will be compiled into an 0
engineering report. as
e. Consultant shall perform code checks that include zoning review and provide one
schematic design comprised of plans, sections and elevations, architectural 0
renderings and construction cost estimates for an approximately 1,000 square foot
restroom facility. 0
f. Consultant shall conduct meetings with stakeholders to review the options and U)
summarize the findings; then prepare and submit the final schematic design for
approval. 0
g. Based on the County approved schematic design, the Consultant shall prepare
0
construction design documents, including architectural, structural, mechanical-
electrical-plumbing(MEP) and civil engineering documents. The Consultant shall
deliver 65% complete documents and 100% complete documents for review and
approval.
h. The Consultant shall provide support services during the bidding phase, including
response to bidders' requests for information (RFI), development of addenda and
bid review and recommendations. U_
i. The Consultant shall provide support services during the construction phase, 0

including response to RFIs, submittal review and project closeout.

2. In accordance with Article VII,paragraph 7.1.1 of the Agreement, the County shall pay the
Consultant a lump sum fee of Eighty-One Thousand Two-Hundred and 00/100 Dollars
($81,200.00)paid on a percent complete basis for the following phases:
a. Survey — consisting of signed and sealed site survey - $1,500.00 upon document 00

b. Coastal Engineering Analysis—consisting of a 100-year storm recession analysis—
$5,170.00 upon review and approval by the Director of Project Management.
c. Structural Design — preliminary structural design for one schematic design �

included in the above total of$81,200.00.
