AGENDA ITEM WORDING: Approval to accept donation of a less than fee interest in Lot 30,
Sugarloaf Shores Plat No. 2 Section C (PB 3-53) with parcel number 00166120-000000 for density
reduction purposes and authorization to execute tax forms acknowledging receipt.
ITEM BACKGROUND: This acquisition is proposed pursuant to BOCC Resolution 438-2018 (the
Less Than Fee Acquisition Program) to protect property rights, to reduce density, and to reduce the
County's potential liability for takings suits.
The subject property consists of an 11,500 square foot canal lot on Sugarloaf Boulevard on the ocean
side of Sugarloaf Key near mile marker 17. The property is designated Tier 3 — Infill Area and is
zoned Improved Subdivision.
Provided the transaction closes in 2019 and the County acknowledges receipt of the donation on IRS
form 8283, the property owners are offering to retire the development rights for dwelling units and
detached habitable space on the property as a donation. The Planning and Environmental Resources
Department has confirmed the property has the potential to be developed with one dwelling unit. In
order to satisfy the requirements of Resolution 438-2018, the Donors will need to execute an
appropriate deed so that Lot 30 is titled identically with their home on the adjoining lot (Lot 29).
The current market land value indicated on the Monroe County Property Appraiser's website for Lot
30 is $138,219. If this transaction were a purchase instead of a donation, the County would have
paid a price of $99,999. The estimated closing costs for this transaction will be approximately
$1,250.
Once the proposed transaction closes, the Donors will continue to own the lot and may use it in
conjuction with their existing house on their adjoining parcel but will be precluded from developing
the lot with a dwelling unit or other detached habitatable space.
PREVIOUS RELEVANT BOCC ACTION: The Board budgeted funds for purchases which are
intended to reduce density and to reduce the County's potential exposure to property rights' related
lawsuits through voluntary purchases.

This letter shall confirm Michael's conversations with you and with Mark Rosch at the Monroe
County Land Authority.

We would like to participate in Monroe County's Less Than Fee Program. We own a house on
Lot 29, Sugarloaf Shores Plat No. 2 Section C and we also own the adjoining lot described as Lot
30, Sugarloaf Shores Plat No. 2 Section C. It is our understanding that pursuant to Monroe U)
County Resolution 438-2018, Lot 30 qualifies for the Less than Fee Program and that Monroe
County could pay$99,999 to purchase and retire the right to build a residential unit on the lot.

The Monroe County Property Appraiser has placed the market land value at$138,000 as of
August 21, 2019.
Instead of selling the residential building right on Lot 30, we are offering to donate the right
provided the transaction closes in 2019 and Monroe County acknowledges receipt of the
donation on IRS form 8283.
