AGENDA ITEM WORDING: Approval of Amendment 1 to the Florida Boating Improvement
Program (FBIP) Grant Agreement for the Gulf View Boat Ramp on Big Coppitt Key. Amendment 1
extends the expiration date of the grant agreement in order for the County to complete construction.
ITEM BACKGROUND: Monroe County executed a Florida Boating Improvement Program
(FBIP) grant agreement with the Florida Fish and Wildlife Conservation Commission (FWC) for
improvements to the Gulf View Boat Ramp on Big Coppitt Key. The grant agreement expired June
30, 2019 and needs to be extended in order to complete the project which was delayed. Amendment
1 will extend the grant agreement Phase I activities until March 31, 2021.
PREVIOUS RELEVANT BOCC ACTION: 3/23/16 — BOCC approved a resolution confirming
support of improvements to the Gulf View Boat Ramp in order to apply for grant funding from
FBIP. 2/21/18 — BOCC approved a grant agreement with FBIP for the Gulf View Boat Ramp
improvements 2/20/19 — BOCC approved a contract with Charley Toppino & Sons, Inc. for
construction of the Gulf View Boat Ramp improvements.

FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION
AMENDMENT NO. 1 TO AGREEMENT
This Amendment to Agreement No. 16060 , referred to as the Original Agreement, is entered into
by and between the FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION, whose
1 address is 620 South Meridian Street, Tallahassee,Florida 32399-1600,hereafter"Commission,"and
Monroe County, FEID#59-6000749,whose address is 1100 Simonton Street, Key West, FL 33040, '
hereinafter"Grantee", collectively,"Parties"and amends that agreement entered into between FWC and
the Grantee dated March 20, 2018.
In consideration of the mutual benefits set forth herein and in the Amended Agreement,the
parties agree to amend the Amended Agreement, as follows,which amendments shall govern to the
exclusion of any provision of the Amended Agreement to the contrary:

1, Section 3. AGREEMENT PERIOD, of the Original Agreement, is hereby amended to read
as follows:
A. Agreement Period and Commission's Limited Obligation to Pay. This Agreement is
made pursuant to a grant award and shall be effective upon execution by the last Party to sign,
and shall remain in effect through 03/31/2041. However, as authorized by Rule 68-1.003,
F.A.C., referenced grant programs may execute Agreements with a retroactive start date of
no more than sixty (60) days, provided that approval is granted from the Executive Director
or his/her designee and that it is in the best interest of the Commission and State to do so. For
this agreement,the retroactive start date was not approved.The Commission's Grant Manager co
shall confirm the specific start date of the Agreement by written notice to the Grantee. The
Grantee shall not be eligible for reimbursement or compensation for grant activities performed
prior to the start date of this Agreement nor after the end date of the Agreement. For this
agreement, pre-award costs are not eligible for reimbursement. If necessary, by mutual
agreement as evidenced in writing and lawfully executed by the Parties, an Amendment to
this Agreement may be executed to lengthen the Agreement period.
2. Attachment A, Scope of Work, Section 2. A., Term of Agreement, of the Original
Agreement, is hereby amended to read as follows:
A. Term of Agreement: The term of the Agreement includes two phases: Phase I, Project
Construction, and Phase II, Project Site Management The term of the Agreement includes
two phases: Phase I, Project Construction, and Phase II, Project Site Management. During
Phase I, the County (Grantee) shall complete the tasks and provide the deliverables described
in this Scope of Work. All Phase I activities must be completed by March 31,2021.
During Phase II, which includes the remaining term of the Agreement, the Grantee shall
maintain the project site as a recreational boating access facility open to the public on a first-
come, first-served basis.

View Boat Ramp Repair and Dock Installation" submitted to the U.S. Fish and Wildlife Service
(Service) CFDA Program 15.605 is approved, effective May 24, 2019. This award is made under
the authority of the Dingell-Johnson Sport Fish Restoration Act of 1950, 64 Stat. 430, as amended,
16 U.S.C. 777-777n; and 50 CFR Part 80-Administrative Requirements,Pittman Robertson Wildlife
Restoration and Dingell-Johnson Sport Fish Restoration Act as amended July 24, 2008. For a
complete list of this program's authorizing legislation, go to: https://www.cfda.gov and search by the
CFDA Program number. This award is made based on Service approval of your organization's
application package, hereby incorporated by reference into this award. Funds under this award are
to be used to repair erosion on the sides and at the end of the ramp on the Gulf View Boat Ramp and
construct a concrete accessory boarding boat dock(5 feet by 52 feet long). The purpose of this
amendment is to allow an additional 24-months to complete grant objectives.

The performance period of this award is October 1, 2017 through June 30, 2021. If you need more
time to complete project activities, you must submit an Amendment request to extend the
performance period to the Wildlife and Sport Fish Restoration(WSFR)Program Chief at
program_rwsfr s. ov before the end of the stated performance period (see Performance
Period Extensions section in enclosure). Only allowable costs resulting from obligations incurred
during the performance period may be charged to this award. All obligations incurred under the
award must be liquidated no later than 90 calendar days after the end of the performance period,
