FOR HIGGS BEACH PARK RESTROOM FACILITY In accordance with the Consultant Agreement for Professional Architectural and Engineering Services, made and entered into on the 19th day of December, 2018 between MONROE COUNTY, hereinafter referred to as the "County," and BENDER & ASSOCIATES ARCHITECTS, P.A., hereinafter referred to as "Consultant," where professional services are allowed if construction costs do not exceed Two Million and 00/100 Dollars ($2,000,000.00), or for study activity if the fee for professional services for each individual study under the contract does not exceed Two Hundred Thousand and 00/100 Dollars ($200,000.00), hereinafter referred to as the"Agreement"the parties enter into this Task Order. All terms and conditions of the Agreement apply to this Task Order, unless this Task Order amends, adds,or modifies a provision or an Article of the Agreement of which will be specifically referenced in this Task Order and the amendment, addition, or modification shall be precisely described. These additions apply only to the project referenced in this Task Order. This Task Order is effective on the a ofVS"1 2019. WHEREAS,the County desires full architectural services to design and construct a new restroom facility at Higgs Beach Park,replacing the existing facility. The desire is to place the new facility in the same location as the existing structure. Therefore, the new restroom will be in a VE-10 velocity zone, so the structure and components must be able to be permitted as such. The County desires a design that is architecturally compatible with the West Martello Fort and a design based on a beachfront architecture theme. The design services will include a schematic design, code analysis report, updated land survey, coastal engineering analysis, structural design, geotechnical analysis, civil site engineering design as well as mechanical, electrical and plumbing design. Additional services will include bid phase support and construction administration. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES, of the Agreement, the Consultant will perform services as described below: a. Consultant shall update the 2010 site survey for Higgs Beach Park. b. Consultant shall complete coastal engineering services that include a 100-year storm recession analysis to determine the local scour elevations and wave loads exerted on the proposed structures members. Consultant shall complete preliminary structural designs for two buildings located on grade that resist hydrodynamic and hydrostatic loads and anchored to avoid floatation, collapse or lateral movement of the structures. d. Consultant shall complete geotechnical services that include subsurface information, laboratory testing and geotechnical engineering recommendations for the proposed facility. The geotechnical exploration will include two standard penetration test borings to depths of 30 feet below the existing ground with continuous sampling performed to 10 feet and then samples will be collected at 5- foot intervals. The boreholes will be grouted at the end of the drilling and the samples will be transported to the laboratory and examined and tested. The findings along with an engineering analysis with recommendations will be compiled into an engineering report. e. Consultant shall perform code checks that include zoning review and provide one schematic design comprised of plans, sections and elevations, architectural renderings and construction cost estimates for an approximately 1,000 square foot restroom facility. f. Consultant shall conduct meetings with stakeholders to review the options and summarize the findings; then prepare and submit the final schematic design for approval. g. Based on the County approved schematic design, the Consultant shall prepare construction design documents, including architectural, structural, mechanical- electrical-plumbing(MEP) and civil engineering documents. The Consultant shall deliver 65% complete documents and 100% complete documents for review and approval. h. The Consultant shall provide support services during the bidding phase, including response to bidders' requests for information (RFI), development of addenda and bid review and recommendations. i. The Consultant shall provide support services during the construction phase, including response to RFIs, submittal review and project closeout. 2. In accordance with Article VII,paragraph 7.1.1 of the Agreement,the County shall pay the Consultant a lump sum fee of Eighty-One Thousand Two-Hundred and 00/100 Dollars ($81,200.00)paid on a percent complete basis for the following phases: a. Survey— consisting of signed and sealed site survey - $1,500.00 upon document review and approval by the Director of Project Management. b. Coastal Engineering Analysis—consisting of a 100-year storm recession analysis— $5,170.00 upon review and approval by the Director of Project Management. c. Structural Design — preliminary structural design for one schematic design sufficient to provide construction cost estimates — $2,750.00 upon review and approval by the Director of Project Management. Geotechnical Services — consisting of subsurface information, testing and a geotechnical engineering recommendations with report-$7,700.00 upon document review and approval by the Director of Project Management. e. Schematic Design — consisting of plans, sections, elevations, renderings and estimates for one schematic design, inclusive of client meetings with stakeholders for review and input - $6,200.00 upon review and approval by the Director of Project Management. f. 65% Construction Documents — architectural, structural, MEP and civil engineering documents - $24,240.00 upon review and approval by the Director of Project Management. g. 100% Construction Documents — architectural, structural, MEP and civil engineering documents - $21,620.00 upon review and approval by the Director of Project Management. h. Bidding Phase — support services, including addenda and response to RFIs - $2,790.00 upon review and approval by the Director of Project Management. i. Construction Phase— support services, including site visits, response to RFIs and submittal reviews-$9,230.00 upon review and approval by the Director of Project Management. 3. In accordance with Article VII, paragraph 7.3, the County shall pay the Consultant for allowable, pre-approved reimbursable expenses a Not-To-Exceed-Amount of Eight Hundred Ten and 00/100 Dollars ($810.00) upon submittal of valid invoices, subject to review and approval by the Director of Project Management. This expense amount is included in the above total of$81,200.00. All other Terms and Conditions of the Agreement remain unchanged.
