AGENDA ITEM WORDING: Approval of a resolution rescinding Resolution No. 231-2019 and
amending Section 1.03 b) Sounding Board of the BOCC Administrative Procedures as approved by
the Commission at the September 18, 2019 meeting.
ITEM BACKGROUND: On August 21, 2019, the Board adopted a resolution amending Section
1.03 b) Sounding Board of its Administrative Procedures. Following adoption of the resolution, the
Clerk executed Resolution No. 231-2019 and the resolution was duly recorded in the Clerk's minutes
by number, recorded in the official records of the County. The Board's Administrative Procedures
were revised, effective upon adoption of the resolution on August 31, 2019, to reflect the
amendments to Section 1.03 b)pursuant to Resolution 231-2019
At its next meeting, which was held on September 18, 2019, a Motion to Reconsider the Board's
approval of Resolution No. 231-2019 was approved by the Board. Following subsequent discussion,
a motion was approved by the Board to:
• remove the new language setting frequency limitations on the same individual
appearing on Sounding Board on the same topic;
• remove the new language placing Sounding Board items at the end of the agenda;
• return the language that Sounding Board items must be scheduled for a time
approximate for public convenience; and
• keep the amended 5 minutes/3 minutes time limits for speakers addressing the Board
on Sounding Board item
In order to properly record the Board's action on September 18, 2019 in its official records, this item
rescinds Resolution No. 231-2019 and adopts a new resolution adopting the Board's amendments to
Section 1.03 b) Sounding Board of the Board of County Commissioners Administrative Procedures
to read as follows:.
b) Sounding Board: A separate section of the regular meeting agenda will be
reserved for Sounding Board. Sounding Board must be scheduled for a time

approximate for public convenience. The purpose of the Sounding Board is to
allow individuals to address the County Commission on a matter pertaining to
County government, excluding matters in litigation and complaints against
specific personnel. The initial speaker on an item - whether representing him
or herself, or a non-profit organization - may address the County Commission
for a period up to five minutes. Subsequent speakers who are speaking for
themselves on the same item may speak for three minutes. Individuals who
wish to utilize Sounding Board must contact the County Administrator's
Office in writing in order to be scheduled on the agenda, must specify the
subject matter of the presentation, and must submit the request to the County
Administrator's Office by the agenda deadlines established by the Board each
year. No action may be taken by the County Commission on an item on the
Sounding Board agenda.

WHEREAS, questions of order, the methods of organization and the conduct of business
of the Monroe County Board of County Commissioners (hereafter `BOCC") are governed by
Robert's Rules of Order (Newly Revised, 2011 Edition), except as provided by the BOCC
Administrative Procedures; and
WHEREAS, the BOCC Administrative Procedures were last revised on May 15, 2013
by adoption of Resolution No. 150-2013; and

WHEREAS, Section 1.03 1) Sounding Board of the BOCC Administrative Procedures
provides process and timelines for submission of requests to appear on Sounding Board, time
limits for the Sounding Board speaker and subsequent speakers who speak on the Sounding
Board item, scheduling of Sounding Board times and location on the agenda; and

WHEREAS, due to the increased frequency of Sounding Board requests for times that
conflict with presentations and discussions on other important items, the BOCC desires to
update the BOCC Administrative Procedures with respect to the Sounding Board; and
WHEREAS, the local governing bodies for other public entities in Monroe County cv
routinely provide for a public comment, which is akin to Sounding Board, at the end of their
respective agendas;

Sounding Board item on that same topic for six months. No action may be
taken by the County Commission on an item on the Sounding Board agenda.
Section 2. Effective date. This resolution shall become effective immediately upon
adoption.

certain." The Mayor should however, conduct the meetings in such a
manner that the agenda schedule is followed as closely as circumstances

sponsored by the County Administrator or a County Commissioner.

d) Appeals of the Planning Commission decisions before the County
Commission shall be limited to 20 minutes of oral argument for each party and
the appellant may reserve 5 minutes for rebuttal.

e) When necessary, the Board of County Commissioners shall convene
as the Board of Appeals to consider such appeals as may be required. Such
hearings shall be scheduled for a time certain on the day it is advertised by the co
County Attorney. Such appeal shall be scheduled on the agenda. The Board
shall consider the appeal and by motion adopt a resolution affirming or denying
said appeal and all such motions shall include authorization for the Chairperson
of the Board to execute said resolution when prepared.
f) Tabled items: An agenda item under consideration by the County
Commission may be removed from the table (tabled) by a majority vote of those
Commissioners present. A motion to table any item that has received a second
shall be voted upon without discussion. The effect of such a vote is to remove
the item from consideration by the Commission. The item may be placed back
3 on the table and considered by the Commission by a majority vote of the
Commission but only if such vote takes place during the course of the meeting of
