All properties abutting the requested right-of-way of Old State Road 4A and Loop Road are owned by the applicant; the properties are leased and managed by the Florida Fish and Wildlife Conservation Commission (FWC). The request is being made by the applicant in order to be consistent with FWC's management plan and will improve and increase appropriate passive recreational opportunities such as hiking, biking, birding, other wildlife viewing, paddle boarding, snorkeling, and nature photography. The applicant has submitted a road abandonment application in order to be consistent with FWC's management plan and to improve and increase appropriate passive recreational opportunities such as hiking, biking, birding, other wildlife viewing, paddle boarding, snorkeling, and nature photography. Currently, the northern southern portion of Old State Road 4A and Loop Road are closed to vehicular traffic but open to public access. Additionally, the properties abutting the requested portion to be abandoned are undeveloped and will remain so as they are State owned and leased by FWC. Monroe County Code Section 19-1 - Abandonment of rights -of -way states: (b) No dedicated and accepted right-of-way in the county shall be abandoned where: (1) the right-of-way terminates on a body of open water; or • The right-of-way does terminate on a body of open water, however, the applicant states the right-of-way will remain open to the public for recreational use. (2) the right-of-way provides access to the public to land on open water; or • The right-of-way does provide access to the public to land on open water, however, the applicant states the right-of-way will remain open to the public for recreational use. A site visit performed by County Staff on August 23, 2019 indicated areas which provide the public access to open water. A deed restriction requiring public access to open water to be maintained in perpetuity is required. The applicant has submitted draft language for the deed restriction (see attached). The abutting properties are owned by the applicant and is not used for access by other properties. (2) Have the only platted access eliminated; • The requested abandonment is for a portion of right-of-way which is closed off to vehicular access and is not used for access by other properties. (3) Have the paved area adjacent to that property increased for turn -around purposes; or • There is not a requirement for a T-turnaround. (4) Be increased in size. • The affected property will increase in size by 39.87 acres, however, there is no objection to this increase. Based on the criteria above, the applicant, TIITFF is the only "affected property owner" for the proposed abandonment and is in agreement.
