On March 15 , 1988 , the Board of County Commissioners adopted
Resolution No. 127-1988 authorizing the Mayor to execute an
Agreement by and between the Department of Health and
Rehabilitative Services , Food Distribution Office, and Monroe
County (Nutrition Program) concerning use of donated food com-
modities by the Monroe County Nutrition Program.
Attached hereto are two certified copies of the subject
Resolution and two original copies of the Contract which have now
been executed and sealed on behalf of the County. It is our
understanding that you will handle obtaining the remaining
necessary signatures . As soon as this has been accomplished,
please be sure to furnish the undersigned with a fully-executed
copy.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, AUTHORIZING THE MAYOR

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Mayor is hereby authorized to
execute an Agreement by and between the Florida Department of
Health and Rehabilitative Services, Food Distribution Office, and
Monroe County (Nutrition Program), a copy of the same being
attached hereto, concerning use of donated food commodities by
the Monroe County Nutrition Program.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 15th day of March, 1988.

AGREEMENT
For Distribution and Use of Donated Commodities in Eligible Programs
In order to effectuate the program of the United States Department of Agricul-
ture (USDA) for the.donation of food, commodities, the Florida Department of
Health and Rehabilitative Services, Food Distribution Office, hereinafter
referred to as the "Distributing Agency" and:

Hereinafter referred to as the "Recipient Agency" do covenant and agree as
follows:
The Distributing Agency will distribute those donated food commodities made
available by the United States Department of Agriculture to eligible programs in
accordance with Sub Chapter B - General Regulations and Policies - Food Distri-
bution set forth by the United States Department of Agriculture. A copy of the
HRS Food Distribution Regulations for State of Florida Distribution is attached
and made a part of this Agreement. The USDA and the Distributing Agency reserve
the right at any time to modify or amend any of the provisions of this Agreement
and the Regulations attached, upon giving written notice to the Recipient Agency
and giving reasonable time, to conform its operations to any such amendments and
modifications.
The Recipient Agency. agrees to accept donated food commodities for use in ac-
cordance with the Agreement, Regulations, and any amendments and to couiply with •.
all the provisions and with any instructions or procedures issued in connection
with this. Agreement.
This Agreement shall become effective on.the date executed and approved and
shall continue in effect until terminated as provided herein. Either party may,
by giving 15 days written notice, terminate this Agreement. HOWEVER, upon re-
ceipt of evidence that the Recipient Agency is not fully couplying with the
terms and conditions of the Agreement, the Distributing Agency may terminate the
Agreement immediately by written notice to the Recipient Agency EXCEPT that any
termination of this Agreement for non-compliance with Title VI of the Civil
Rights Act of 1964, shall be in accordance with applicable laws and regulations.

remaining in possession or control of the lecipient Agency.
