ITEM BACKGROUND: The Monroe County Mayor declared a State of Local Emergency on September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community." At 9:10 a.m. on September 10, 2017, Hurricane Irma made landfall near Cudjoe Key as a Category 4 Hurricane with maximum sustained winds of 130 mph. Significant damage has occurred to the housing stock. The damage caused by Hurricane Irma has displaced a large population of County residents, which has greatly increased the demand for repairs and replacement housing. Due to this increased demand coupled with the limited resources and labor market, timeframes for repairs and redevelopment are being projected beyond the duration allowed for Temporary Emergency Housing by the Monroe County Comprehensive Plan and Monroe County Code. In addition, there is demand for temporary housing for emergency relief workers involved in reconstruction activities. ANALYSIS: Pursuant to Monroe County Land Development Code Section 103-1(e), temporary emergency housing may be provided for temporary occupancy by emergency relief workers involved in reconstruction activities subject to certain conditions and approval of a resolution of the BOCC authorizing the placement and duration of the temporary housing for relief workers. LDC Sec. 103-1(e)(7): The only persons permitted to reside for any period in temporary emergency housing for relief workers are individuals who are gainfully employed on a fulltime basis in completing cleanup and Packet Pg. 1160 G.4 reconstruction efforts following a natural or manmade disaster. All residents of temporary emergency housing for relief workers who were not permanent residents of the county prior to first occupying such housing facilities will be required to evacuate in accordance with local evacuation orders. Residents of any temporary emergency housing for relief workers who were permanent residents of the county prior to first occupying such housing facilities may not remain in temporary emergency housing for relief workers during any period when a local evacuation order is in effect. The proposed resolution specifies the location, duration, type of temporary emergency housing and gainful employment of emergency relief workers. The Applicant has requested approval for the temporary placement of twenty (20) construction trailers for a duration of 36 months. The relief workers are proposed to work on six `associated projects' listed below. 1. Little Palm Island Demo and Wastewater Treatment Plant-Parcel ID 4 00107880-000000 `The Relief work at this site includes the demolition of structures damaged by the storm, removal of debris from the property, re-nourishment of beach sand depleted by the storm, installation of necessary rip rap, and installation of a Wastewater Treatment plant.' 2. Dolphin Marina Demo- Parcel ID 4 00113590-000000 `The Relief work at this site includes the demolition of structures damaged by the storm, removal of debris from the property; Site work infrastructure required for restoration, and a new parking lot and drainage.' 3. St. Bede's Demo& Sitework-Parcel ID 4 00065090-000000 `The Relief work at this site includes the removal of trees and foliage, the necessary installation of water and sewage enhancements, site restoration and preparation, grading and drainage.' 4. NAS Boca Chica Irma Repairs- Metal Building-Parcel ID 4 00122490-000000 `The Relief work associated with this site is the removal of a building that was detrimentally damaged during Irma.' 5. Dagny Johnson State Park Restoration-Parcel ID 4 00081980-000300 `The Relief work associated with this property includes the refilling of an existing quarry pit, which was damaged during Irma and subsequently emptied.' 6. Bahia Honda State Park Restoration-Parcel ID 4 00106091-000000 `The relief work associated with this property includes the demolition, restoration, and site preparation of property damaged during Irma, building a new bathroom facility, rebuilding and restoring a roadway that was damaged during Irma, building a new parking lot, and replacing necessary rip rap.' Therefore, the above listed projects meet the requirements to have emergency temporary relief worker housing. Packet Pg. 1161 G.4 PREVIOUS RELEVANT BOCC ACTION: On October 18, 2017 at a regular meeting in Marathon, the BOCC approved Ordinance 022-2017 amending Chapter 103-1 "Temporary Housing" to allow temporary emergency housing on parcels with an already issued, unexpired building permit for the construction of a dwelling unit; to allow the temporary emergency housing to connect to central sewer, onsite system or utilize holding tanks; to allow one temporary emergency housing unit for each lawful dwelling unit occupied by County residents who have been displaced by natural or manmade disaster damages; and to allow the placement of temporary emergency housing on vacant residential properties limited to travel trailers, RVs or similar sheltering units provided and licensed by FEMA. On February 21, 2018 at a regular meeting in Key West, the BOCC approved Resolution 091-2018 amending Resolution 218-2017 to allow for additional time that temporary emergency housing is authorized on mobile home park sites and RV park sites.
