8 A RESOLUTION BY THE MONROE COUNTY BOARD OF
9 COUNTY COMMISSIONERS AUTHORIZING THE
10 PLACEMENT, LOCATION, DURATION, TYPE OF
11 HOUSING AND GAINFUL EMPLOYMENT OF RELIEF
12 WORKERS PURSUANT TO MONROE COUNTY LAND
13 DEVELOPMENT CODE SECTION 103-1(e) FOR
14 PROPERTY LOCATED AT 157 TOPPINO INDUSTRIAL

18 WHEREAS, the Board of County Commissioners is the legislative body of Monroe
19 County,Florida; and
20
21 WHEREAS, the Monroe County Mayor declared a State of Local Emergency on
22 September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe
23 County" and that the County "may require expedient action in order to protect the health, safety
24 and welfare of the community;" and
25
26 WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys
27 on September 10, 2017, causing substantial damage to and loss of property; and
28
29 WHEREAS, the Monroe County Mayor issued other declarations a State of Local
30 Emergency on September 13, 2017, September 20, 2017, September 25, 2017, September 26,
31 2017, October 3, 2017, and October 11, 2017, due to Hurricane Irma, a "threat of danger to the
32 populace inhabiting Monroe County" and that the County "may require expedient action in order
33 to protect the health, safety and welfare of the community;" and
34
35 WHEREAS, Monroe County experienced a natural disaster, Hurricane Irma, which
36 caused significant damage to residences,businesses and infrastructure throughout the County; and
37
38 WHEREAS, pursuant to Section 103-1(b) of the Monroe County Land Development
39 Code, it is the purpose of this section to provide regulations that allow for the relaxation of the
40 use prohibitions in Chapter 130,Land Use Districts, and Chapter 138,Rate of Growth Restrictions
41 (ROGO/NROGO), to: (1) Provide regulatory authority to allow temporary emergency housing,
42 not subject to the ROGO permit allocation system,for temporary occupancy by residents displaced
43 by natural or manmade disaster damage...; and -

1 WHEREAS, pursuant to Section 103-1(a), temporary emergency housing means
2 recreational vehicles (or similar approved sheltering units) used for temporary occupancy in
3 response to natural or manmade disasters, including, but not limited to, hurricanes and tropical
4 storms, where such RVs (or other approved sheltering units) are provided to residents or relief
5 workers as part of emergency relief efforts; and recreational vehicle (RV) means the same as that
6 term is defined in F.S. § 320.01; and

8 WHEREAS, pursuant to Section 103-1(e), temporary emergency housing may be
9 provided for temporary occupancy by emergency relief workers involved in reconstruction
10 activities subject to certain conditions; and
11
12 WHEREAS, the. County has experienced significant damage to numerous homes, and
13 must utilize available locations to provide secure temporary housing for the disaster recovery of
14 the community; and
15
16 WHEREAS, pursuant to Section 103-1(h), no clearing or filling of environmentally
17 sensitive lands may occur as a result of providing any type of temporary housing unit(s); and
18
19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
20 COMMISSIONERS OF MONROE COUNTY,FLORIDA the information and documentation
21 submitted support its decision to APPROVE the request for placement, location, and duration of
22 temporary housing for relief workers, subject to the following conditions:

24 Section 1. Location. The approved location for placement of twenty (20) temporary
25 emergency housing units for emergency relief works is 157 Toppino Industrial Drive, Rockland
26 Key with Parcel ID 00121980-000500 and legally described as:
27
A parcel of land in a part of Government Lots 5 &6, Section 21,Township 67 South, Range 26 East on
Rockland Key, Monroe County, Florida and being more particularly described as follows:'
Commence at the intersection of the Centerline of U.S. Highway No. 1 (State Road No. 5) and the West
abutment of the Rockland Key Viaduct; thence S 63 °09'20"W along the original Centerline of U.S.
Highway No. 1 for 2110.00 feet; thence North 970.73 feet; thence West for 739.09 feet to the Point of
Beginning; thence West, a distance of 457.98 feet; thence NORTH, a distance of 255.00 feet; thence
WEST, a distance of 365.00 feet; thence NORTH, a distance of 899.96 feet; thence East along a line
lying 2000.00 feet Northerly of and parallel with the South Line of Section 21 for 1110.53 feet; thence
S 27 °00'00"E, a distance of 73.48 feet; thence WEST a distance of 437.79 feet; thence S 06 °07'26"E,
28 a distance of 1095.81 feet to the Point of Beginning. •

30 Section 2.Duration.The temporary emergency housing may remain on the Property until
31 December 1, 2022. A no-fee building permit authorizing placement of the temporary housing
32 unit(s) is required. The duration may only be extended at the discretion of the BOCC by an
33 additional resolution.
34 Section 3. Type of Housing. The temporary housing shall be an approved sheltering unit,
35 including but not limited to, recreational vehicles (RVs), modular units, trailers, fold out shelters
36 and site built structures.

1 Section 4.Gainful Employment.For purposes of compliance with LDC Section 103-1(e),
2 the utilization of the temporary emergency housing shall be only used by relief workers gainfully
3 employed on the following projects listed below.

11 Section 5. Environmental Impacts. Environmental Resources shall review the proposal
12 prior to any work occurring on the site. Any unauthorized impacts to native vegetation on site will
13 need to be restored.

15 at a regular meeting of the Board held on the 20th day of November , 2019 .
