Zoning Resolution Z-10W ZONING RESOLUTION NO. Z-10 WHEREAS, the Board of County Commissioners of Monroe County, Florida desires to amend the Monroe County Zoning Regulations, as adop- ted by Resolution No. Z-1, by adding thereto a new paragraph to be known as paragraph B-3, Paving and Excavating, under sub -section 3, Section 29, Permits -Use and Occupancy -Permit Fees, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Monroe County Zoning Regu- lations, as adopted by Resolution No. Z-1, be, and the same are hereby amended by adding the following paragraph under sub -section 3, Section 29, Permits -Use and Occupancy -Permit Fees: B - 3 PAVING AND EXCAVATING (A) PAVING 1. Prior to paving any street, road, driveway or parking lot in the unincorporated area of Monroe County, Florida, a permit for said paving shall be obtained from the Monroe County Building and Zoning Department. 2. Fees for said paving permit shall be $3. 00 per thousand dollars, or any portion thereof, of the estimated cost. (B) EXCAVATING 1. Prior to excavating, for any purpose, within the right- of-way of any private or dedicated street or road in the unincorporated area of Monroe County, Florida, a per- mit for said excavating shall be obtained from the Mon- roe County Building and Zoning Department. 2. , Fees for said excavating permit shall be $3. 00 per thou- sand dollars, or any portion thereof, of the estimated cost. "3. As a condition to obtaining a permit for excavating within the aforementioned rights -of -way a bond, acceptable to the County Attorney or the Attorney for the Building and Zoning Department, must be posted. Said bond shall be based on an estimated cost, to resurface the excavating area, of not less than $5. 00 per square yard. C) PENALTIES 1. If any person commences work prior to obtaining the re- quired paving or excavating permit, the minimum penalty r shall be double the permit fee. If` any person, after due notice, shall fail to obtain the required permit he shall be guilty of a misdemeanor. Dated July llth , 1967.
