AMENDMENT 1 TO AGREEMENT BETWEEN
MONROE COUNTY AND
KLEIN HORNIG LLP
THIS AGREEMENT, made and entered into this 22°d day of January,2020, by and between the BOARD
OF COUNTY COMMISSIONERS OF MONROE COUNTY,FLORIDA,("COUNTY"), a political
subdivision of the State of Florida whose address is 1100 Simonton Street,Key West, Florida 33040, and
KLEIN HORNIG LLP ("ATTORNEY")regarding the retention of ATTORNEY by COUNTY to provide
legal advice and services.
WHEREAS, the COUNTY and ATTORNEY entered into an Agreement on July 17, 2019
("AGREEMENT")whereby the ATTORNEY agreed to provide legal representation to the COUNTY;and
WHEREAS, the ATTORNEY provided a 2020 Rate Increase notification to COUNTY on December 16,
2019, which requires an amendment to the rates and approved time keepers listed in paragraph 6.3 of the
Agreement;and
WHEREAS, the COUNTY has other on-going acquisition projects in which the ATTORNEY'S expertise
and legal representation will be required and therefore the scope of work will be revised to allow for
representation on other projects as directed by the County Attorney in writing;
NOW THEREFORE, in consideration of the mutual covenants and provisions contained herein, the
parties agree as follows:
1. Paragraph 6.3 Hourly Rates, and Changes to hourly rates will be amended to read as follows:

The ATTORNEY has agreed to rates as more fully set forth below:

With the written approval of the County Attorney, additional time keepers may be
utilized by the ATTORNEY and billed at the following rates in accordance with Exhibit

Paralegals $220-$240

ATTORNEY will charge no more than the hourly rate quoted above throughout the duration of the
matter, unless otherwise agreed in writing and approved by COUNTY in the same manner as Agreement.
The hourly rate to be changed by the lawyers and paralegals are reviewed annually and should ATTORNEY
determine that a rate adjustment is warranted for this engagement the COUNTY will be notified in advance
of any change.
2. Paragraph 4 will be amended to read as follows:
4. SCOPE OF THE WORK
Our representation is limited to providing legal services and advice to Monroe County,
Florida("Client")in connection with:
Compliance with relocation requirements under the Uniform Relocation Act and Section
104(d) of the 1974 Housing and Community Development Act and other related issues in
connection with the acquisition of parcels and as part of Monroe County's recovery efforts
from Hurricane Irma as directed in writing by the County Attorney.
3. In all other respects,the remaining terms of the agreement entered into July 17,2019, and not
inconsistent herewith, shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day and date
first written above.
