Resolution 025-2020 ilea, 9(2„,\ 1(::-' L'f' L:\\-- — r: - ' -'4'- ,,,, ,,, 4.,,.:, . ts- r., RESOLUTION NO. 025 -2020 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS APPROVING THE RESERVATION OF SIXTEEN (16) AFFORDABLE HOUSING ALLOCATIONS CONSISTING OF 6 LOW INCOME,5 MEDIAN INCOME,AND 5 MODERATE INCOME CATEGORY ROGO ALLOCATIONS FOR PROPOSED AFFORDABLE EMPLOYEE HOUSING DWELLING UNITS ON CUDJOE KEY ON PROPERTY MORE PARTICULARLY LEGALLY DESCRIBED AS SITUATED ON LOT 30, SACARMA, A SUBDIVISION OF GOVERNMENT LOTS 3 AND 4 IN SECTION 29, TOWNSHIP 66 SOUTH, RANGE 28 EAST, RECORDED IN PLAT BOOK 2, PAGE 48, OF THE PUBLIC RECORDS OF MONROE COUNTY, FLORIDA, AND CURRENTLY HAVING PROPERTY IDENTIFICATION NUMBER 00174960-000000, UNTIL JANUARY 22,2021, FOR BUILDING PERMIT ISSUANCE. WHEREAS,the State of Florida and all local governments in the Florida Keys(each subject to Area of Critical State Concern mandates relating to housing affordability)recognize the need for affordable housing throughout the state and particularly in the Florida Keys where developable land for housing is extremely limited and expensive;and WHEREAS,the challenge of providing affordable housing opportunities in the Florida Keys is one requiring sensible and responsive use of residential dwelling unit allocations, including implementation of long-term preservation mechanisms;and WHEREAS,due consideration should be given to relevant factors such as the capacity for allocation recipients to promptly transform allocation awards/reservations into finished and occupied affordable/workforce housing units;and WHEREAS, Monroe County Land Development Code("LDC") Section 138-24(b)(2) allows the Monroe County Board of County Commissioners ("BOCC") to authorize reservations for "specific affordable or employee housing projects participating in a federal/state housing financial assistance or a tax credit program or receiving some form of direct financial assistance from the county upon written request from the project sponsor and approved by resolution of the BOCC";and WHEREAS, Mobile Homes Holdings Coco, LLC, is proposing to develop the aforesaid subject property with sixteen(16)affordable employee housing units and is applying for Federal assistance for the U.S. Department of Housing and Urban Development("HUD")under the Community Development Block Grant — Disaster Recovery ("CDBG-DR") program for development of sixteen new affordable employee housing dwelling units;and WHEREAS, LDC Section 138-24(b)authorizes the reservation of affordable housing ROGO allocations by the BOCC for specific housing programs,which includes projects participating in a federal/state housing financial assistance;and 1 WHEREAS,the reservation of affordable housing allocations for the above anticipated project, does not exempt the project from applicable requirements for the Monroe County Comprehensive Plan, Monroe County Land Development Regulations, the Florida Building Code, floodplain design requirements, or any other regulatory requirements; and WHEREAS, Mobile Homes Holdings Coco, LLC, shall obtain all required approvals from the Monroe County Planning&Environmental Resources Department for the project; and WHEREAS, Mobile Homes Holdings Coco, LLC, shall obtain permits for the affordable housing dwelling units by January 22, 2021; if the permits are not issued by that date, the allocations shall revert back to Monroe County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,FLORIDA: Section 1. The foregoing recitals are true and correct, and are hereby incorporated as if fully stated herein. Section 2. The Monroe County Planning and Environmental Resources Department shall reserve sixteen (16) affordable housing ROGO allocations consisting of 6 low-income, 5 median-income, and 5 moderate-income category affordable housing ROGO allocations, for the aforesaid Monroe County project on Lot 30 Sacarma,a subdivision of Government Lots 3 and 4 in Section 29,Township 66 South,Range 28 East, Cudjoe Key, Monroe County, Florida, recorded in Plat Book 2, Page 48 of the Public Records of Monroe County,Florida, until January 22,2021. Section 3. The developer must obtain the building permit for the sixteen (16) affordable/employee housing on or before January 22,2021. Section 4. The developer shall comply with all Monroe County requirements, all applicable Building Code requirements,and any other oversight agencies. Section 5. The Planning and Environmental Resources Department and Building Department staffs are authorized to expeditiously process permit related applications for the above referenced project when received.
