ITEM BACKGROUND: The Applicant, Association of Ocean Pointe Unit Owners, Inc., is
requesting a boundary determination to confirm the administrative interpretation of the Senior
Director of Planning and Environmental Resources that the Land Use District Map (LUD)
designation of Native Area (NA) and Future Land Use Map (FLUM) designation of Residential
Conservation (RC) for a portion of the property is in error and should have a designation of
Suburban Residential (SR) and Residential Low (RL). The determination would give the entire
portion of the property with buildings a LUD designation of SR and a FLUM designation of RL.
Pursuant to MCC §102-21(b)(2)h. it is the authority and duty of the Director of Planning to render
interpretations of the boundaries of the official Land Use District (Zoning) Map and Future Land
Use Map.
The boundaries of the FLUM and Zoning for the subject property and surrounding area as shown in
the current Monroe County GIS database are as follows (subject property outlined):

Based on the information supplied by the Applicant, pursuant to a Final Judgement in the previous
Legal Case No. 83-20330-CA-17-33, the Senior Director of Planning and Environmental Resources
has determined that a drafting error occurred on the official Zoning Map and the FLUM.

Based on the Final Judgement, all of the property under the major development plan referenced
should in fact be one zoning. The zoning "RU-3" required under this condition no longer exists
under the current Land Use District designations. For consistency the amended boundaries of the
Zoning Map and FLUM for the subject property and surrounding area as shown in the GIS database
should be as follows:

To resolve the error, the Board of County Commissioners must confirm the interpretation of
Planning Director before the boundary determination interpretation is effective.
Additionally, it should be stated that the Applicant is requesting the boundary determination in part
move forward on resolving possible Code Enforcement violations regarding Vacation Rental use,
which is permitted in the SR zoning district, but not in the NA district.
Pursuant to MCC §102-158(e), typographical or drafting errors: amendments to the text to correct
typographical or drafting errors may be adopted by the BOCC without posted notice or public
hearing at any regular meeting and notice of such amendments shall be transmitted to the State Land
Planning Agency within 30 days.
