ITEM BACKGROUND: This item allows a no cost time extension of the Wood agreement retroactive from July 19, 2019 to April 30, 2020, to allow time for monitoring services of sediment removal from 2 additional canals and debris removal from 76 additional canals. NRCS approved Amendment No. 3 for a time extension from August 18, 2019 to December 31, 2019 to allow time for 76 new canals to be cleared and monitored of marine debris (work completed) and Amendment No. 4 for a 90-day time extension from December 31, 2019 to March 30, 2020 to allow time for 2 new canals to be cleared of sediment. PREVIOUS RELEVANT BOCC ACTION: 02/21/18 Ratification of a Memorandum of Understanding and Mutual Aid Agreement with the Florida Department of Environmental Protection (DEP) for $6 million for clearing of marine debris from canals and other navigable waterways within unincorporated Monroe County, to be reimbursed by the County to DEP, [and potentially to be reimbursed by FEMA to the County] retroactive to the last date executed by the parties. 05/16/18: Approved. The purpose of the amendment is to authorize reimbursement to Wood for monthly monitoring fees that are in excess of the 7.5% reimbursement cap. The amounts exceeding the 7.5% will be paid by the County and reimbursed by FDEP. The original agreement did not specify a limit, but referenced the NRCS grant which allows only a reimbursement to the County up to 7.5% of the marine debris removal fees. WITNESSETH: WHEREAS, on July 18, 2018, as subsequently amended, the parties entered into an Agreement, whereby the CONSUhTANT would provide monitoring for Hurricane Irma marine debris removal and related services, which services shall collectively be referred to as the "Project," funded by the NRCS Grant Agreement NRI84209XXXXCO27 between the United States 0 Department of Agriculture Natural Resources Conservation Service (NRCS) and Monroe County; and WHEREAS, Paragraph 1.19 of the Agreement between the parties stated that the term of the Agreement would run for one year, through July 17, 2019, but the County had the option of c extending the Agreement on the same terms as set forth in the Agreement with prior approval of the Board of County Commissioners; and WHEREAS, NRCS has approved Amendment 3 to the Grant Agreement to authorize a 135- day time extension of the original agreement to December 31, 2019, to allow time for 76 additional e canals to be cleaned; and 6 WHEREAS, the NRCS approved Amendmeent 4 to the Grant Agreement to authorize to authorize a 90-day time extension of the agreement from December 31, 2019 to March 30, 2020, to 0 allow time for 2 additional sediment removal canals to be cleaned; and a� WHEREAS, the CONTRACTOR.has indicated that it is available to perform the additional work under the NRCS Grant Agreement as extended by Amendments 3 and 4.
