ITEM BACKGROUND:
Wreckers Cay Apartments at Stock Island LLC is requesting a reservation for two hundred-eighty
(280) affordable housing allocations consisting of seventy (70)low income, seventy (70) median and
one hundred-forty (140) moderate income Affordable housing allocations pursuant to Monroe
County Code Section 138-24(b)4.
Wreckers Cay Apartments at Stock Island LLC is proposing to develop the property with—two
hundred-eighty (280) affordable employee housing units.

Related Applications
The Applicant has also requested the following:
• A Comprehensive Plan Text Amendment to incentivize the supply of affordable housing near
employment centers, the County shall provide for the development of site-specific land use
mechanisms, limited to density increases up to a maximum of 40 affordable dwelling units per
buildable acre, transfer of ROGO exemptions within the Lower Keys, modification to height, and
alternate off-street parking requirements, to augment the development potential to address the
inadequate availability of affordable housing in the Lower Keys
• A corresponding Land Use District (Zoning) map amendment for the Property from Urban
Residential Mobile Home (URM)to Urban Residential (UR)for a portion of the Property;
• A text amendment to the Land Development Code Section 130-157 to allow for increased
density for properties with MU and UR zoning districts, within Stock Island that apply for and
receive a site specific subarea policy as established in the Comprehensive Plan;
• A development agreement for the redevelopment of properties collectively known as
"Wrecker's Cay," involving 280 affordable dwelling units, and the transfer of 80 market rate
TREs, 18 transient TREs, and 672sf of NROGO exempt floor area. The ten year agreement
includes a proposed conceptual site plan, with the proposed development pursuant to the
proposed amendments to the Comprehensive Plan and Land Development Code (described
above);
• A right-of-way abandonment for a portion of Laurel Ave.; and
• A right-of-way abandonment for a portion of MacDonald Ave and 1"Street.

Relevant land Development Code Section:
Monroe County Code Section 138-24 (b) Reservation of affordable housing allocations.
Notwithstanding the provisions of Section 138-26 for awarding of affordable housing allocations,
the BOCC may reserve by resolution some or all of the available affordable housing allocations for
award to certain sponsoring agencies or specific housing programs consistent with all other
requirements of this chapter. Building permits for these reserved allocations shall be picked up
within six months of the effective reservation date, unless otherwise authorized by the BOCC in its
resolution. The BOCC may, at its discretion, place conditions on any reservation as it deems
appropriate. These reservations may be authorized by the BOCC for:
(1) The county housing authority, nonprofit community development organizations, pursuant to
Section 139-1(e), and other public entities established to provide affordable housing by entering into
a memorandum of understanding with one or more of these agencies;
(2) Specific affordable or employee housing projects participating in a federal/state housing
financial assistance or tax credit program or receiving some form of direct financial assistance from
the county upon written request from the project sponsor and approved by resolution of the BOCC;
(3) Specific affordable or employee housing projects sponsored by nongovernmental not-for-profit
organizations above upon written request from the project sponsor and approved by resolution of the
BOCC;
(4) Specific affordable or employee housing programs sponsored by the county pursuant to
procedures and,guidelines as may be established from time to time by the BOCC;
(5) Specific affordable or employee housing projects by any entity, organization, or person,
contingent upon transfer of ownership of the underlying land for the affordable housing project to
the county, a not-for-profit community development organization, or any other entity approved by
the BOCC, upon written request from the project sponsor and approved by resolution of the BOCC;
or
(6) Rental employee housing projects situated on the same parcel of land as the nonresidential
workplace for the tenants of these projects, upon written request from the property owner and
approved by resolution of the BOCC.
PREVIOUS RELEVANT BOCC ACTION:
On August 21, 2019, at a regularly scheduled meeting, the BOCC held a public hearing to consider the
transmittal of the proposed comprehensive Plan text amendment (File 2018-120), considered the staff report,
and provided for public comment and public participation in accordance with the requirements of state law
and the procedures adoption for public participation in the planning process. The BOCC transmitted the
proposed amendment to the State Land Planning Agency(DEO) for review and comment.

25 WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys is one
26 requiring sensible and responsive use of residential unit allocations, including implementation of long-term
27 preservation mechanisms; and cw

29 WHEREAS, due consideration should be given to relevant factors such as the capacity for allocation
30 recipients to promptly transform allocation awards/reservations into finished and occupied 2
31 affordable/workforce housing units; and 3:

33 WHEREAS,the developers have legitimate needs for some assurance that allocations are in fact and
34 will remain available and/or justified for a reasonable time so that follow-through on initial commitments
35 will in fact be justified; and

37 WHEREAS, in accordance with Section 138-24(b)(4) of the Monroe County Land Development
38 Code allows the BOCC to authorize reservations for "Specific affordable or employee housing
39 programs sponsored by the county pursuant to procedures and guidelines as may be established from time
40 to time by the BOCC," and

42 WHEREAS,the reservation of affordable housing allocations for the anticipated project, does not
43 exempt the project from applicable requirements for the Monroe County Land Development Regulations,
44 Building Code and other regulatory requirements; and

Pursuant to Monroe County Land Development Code Section 138-24(b)(4), my client,
Wreckers Cay Apartments at Stock Island,LLC("Applicant")respectfully requests the reservation
of Two Hundred Eighty (280) affordable Rate of Growth Ordinance ("ROGO") allocations for
Applicant's project on the properties located in Key West, Florida 33040 at 6125 Second Street
(RE # 00124560-000000), 6325 First Street (RE # 00124550-000000), and 5700 Laurel Avenue
(RE# 00124540-000000) (collectively, the "Property").
Applicant is applying to develop Two Hundred Eighty(280)affordable units consisting of
