AGENDA ITEM WORDING: Discussion and direction to confirm priorities for the County's Less
Than Fee Program.
ITEM BACKGROUND: At the November 2019 BOCC meeting, the Board directed staff to bring
an item to the Board at the January meeting for discussion and direction of the priorities for Less
than Fee (LTF) land acquisition program. Under the LTF program, the County purchases
development rights from the owner of a lot without a house where the owner owns a house on the
adjacent parcel. The owner remains the title owner of the undeveloped parcel and unifies the title of
that lot with the lot containing the house. The lot stays on the tax rolls and the owner maintains the
vacant parcel. This approach is seen as a more cost effective way for the government to retire
development rights rather than purchasing lots outright.
The County's current priorities for the LTF program, as set forth in Resolutions 438-2018 and 175-
2018, are to purchase development rights on lots on Big Pine and No Name Keys. Due to the
enhanced growth restrictions imposed as a condition of the Incidental Take Permit with the Federal
government, those two islands pose the most immediate risk of spurring property rights claims. The
secondary priority is to purchase development rights on Tier III lots — regardless of location — that
have the lowest values based upon appraisal numbers provided by the Property Appraiser's Office.
The tertiary priority is to purchase lots valued at less than $100,000 since the program caps offers at
price.
The waiting line for processing applications is testament to the program's success. Some owners of
higher-valued properties have offered to expedite their applications by reducing their prices to match
the lowest-priced applications. This willingness has raised the question of whether the County
would be able to retire more development rights for less money and reduce the waiting period for
those applicants with higher-valued lots if the County established a reduced, fixed price that allowed
the applicant to jump to the head of the line.
Staff also seeks direction on how to handle lots that have accessory structures already built upon
them. Whine these lots pose less risk of a successful takings claim than completely undeveloped

lots but there is still a potential claim that must be defended, if filed. Currently, the County extends
the same purchase offer, regardless of whether the lot has accessory structures. One alternate
approach would be to prioritize completely undeveloped lots over lots partially developed with
accessory structures. Another approach would be to discount the purchase offer by the assessed
value of the accessory structures.
