I WHEREAS, in accordance with Land Development Code Section .102-159(a), the
2 App]icant held community ineeti ngs regarding the proposed arnendnients on Deceniber H, 2018
3 and April 30, 2019; and

5 WHEREAS,the Monroe COLLMY Development Review Committee (D ) considered the
6 proposed amendment at a regularly scheduled meeting held on June 25, 2019; and

8 WHEREAS, at a regularly scheduled meeting held on July w31, 2019, the Monroe County
9 Planning Corninission held a public hearing for the purpose of considering the proposed
10 amendment to the Land Use District (Zoning) Map and provided for public comment; and
11
12 WHEREAS, the Monroe County Planning Conin-iission adopted Resolution No. P30-19
13 recommending approval of the proposed Zoning inap amendment-, and
14
15 WHEREAS, at as regularly scheduled meeting held on the 22"' day of January, 2020, the
16 Monroe County Board of County Commissioners held as public hearing,considered the staff report,
17 and provided for public comment and public participation in accordance with the requirements of
18 state law and the procedures, adopted for public participation in the planning process-, and
19
20 WHEREAS, based upon the docurnentation submitted and infc)rmation provided in the
21 accompanying staff report, the BOCC nIakes the following Findings of Fact:

23 1, The proposed map amendment is consistent with the provisions of the Monroe County
24 Code�
25 a. As required by MCC §102-158, the niap aniendnient. does not relieve particular
26 hardships, nor confer special privileges or fights on any person, nor permit an
27 adverse change in COMMUnity character, as analyzed in the Monroe County
28 Year 2030 Comprehensive Plan,,
2,9 b. As required by MCC §102-158(d)(7)b., the rnap arnendinent is needed due to
30 changed projections, changed assumptions, new issues and recognition of as
31 need lbr, additional detail or cornprehensiveness; and
32 2. 'rhe proposed map ,taiendinew is consistent with the provisions and intent of the
33 Monroe County Year 2030 Cornprehensive Plasm:
34 a. The Urban Residential (UR) Land Use (zoning) District corresponds with the:
35 Residential High (R14) Future Land Use Map designation and is consistent with
36 the respective density and intensity standards as set forth in Policy 101.5.25;
37 b The UR Land Use (Zonirig) District is consistent with the purpose of the RH
38 Future Land Use Map designation, as set orth in Policy 101 ,54,
39 c. The proposed arn.endn-ient is not inconsistent ,,xith the Stock Island/Key Haven
40 Livable COrnfuLl ni Keys Plan; and
41 3. The proposed map amendment is not inconsistent with the Principles f(..)r Guiding
42 Development in the Florida Keys Area of'Critical State Concern;

I NOW, THEREFORE, BE 11' ORDAINED BY THE BOARD OF COUNTY
2 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

4 Section I. The Monroe County Land Use District(Zoning) map is hereby amended as follows:

6 The property located at 6325 First Street and 6125 Second Street, Stock Island, with
7 Parcel ID Nos. 00124560-000000 and. 00124550-000000 shall be designated as
8 Urban Residential (UR) as shown on Exhibit 1, attaclied hereto and incorporated
9 herein.

11, Section 2. Sever ability. If any section, subsection, sentence, clause, item, change, or.
12 provision of this ordinance is field inva,rlid, the remainder of this ordinance shall not
13 be affected by such validity,

16 conflict with this ordinance are hereby repealed to the extent ot'said conflict,

Land Use District(Zoning)Map from Urban Residential Mobile Home(URM) to Urban
Residential (UR), for property located at 6325 First Street and 6125 Second Street, Stock Island,
mile marker 5; as proposed by Smith/Hawks, PL on behalf of Wreckers Cay Apartments at Stock
Island, LLC; providing for severability; providing for repeal of conflicting provisions; providing
for transmittal to the State Land Planning Agency and the Secretary of State; providing for
amendment to the Land Use District(Zoning) Map; providing for an effective date.
