AGENDA ITEM WORDING: Discussion and direction regarding the Duck Key Non-
Conservation Density Reduction Lots that were not purchased by bid and other similarly situated lots
owned by the County.
ITEM BACKGROUND: On October 16, 2019, the Board authorized the County Attorney to
initiate the statutory process for disposing of County owned property with respect to eleven (11)
county-owned non-conservation density reduction lots on the condition that they be deed restricted
so that no residential housing could be built upon them. Pursuant to the process set forth in in F.S.
125.35, the lots were placed out for bid in December 2019. Bids were received on eight (8) of the
eleven (11) parcels on January 7, 2020.
On January 22, 2020, the Board approved sales of eight (8) of those lots and directed staff to bring
back a discussion item that included the option of public auction for the remaining three (3) lots on
Duck Key. Possible options for the Board to consider include:
1) Holding onto the lots and offering them for sale again, as is, at a later date, under the
statutory process;
2) Direct staff to initiate amendments to the land development code adding additions to the
list of approved uses for such lots, then offer for sale again;
3) Pursue adoption of an ordinance that would be permit an alternative method of sale, such
an auction. Such an ordinance would still need to meet the minimum standards set forth
in F.S. 125.35(3).
4) Pursue negotiations with a nonprofit corporation such to see if terms could be reached to
convey the property for a community use. F.S. 125.38 allows the County to convey to
such an entity without competitive bidding.
5) Take no further action and allow the property to remain under County ownership.
In addition to the remaining three Duck Key lots, the County owns seven (7) density reduction lots
on Big Pine Key, that may be determined to be surplus and sold by the County (additionally, the
County owns approximately 150 parcels that were purchased for conservation using the Florida

Communities Trust Grant, and over 1,000 ROGO lots dedicated for conservation). The County
could acquire parcels through the foreclosure of Code Compliance liens that may be candidates for
disposition.
Staff reviewed other procedures for disposition of surplus real property. The majority
use the sealed bid process. However, some counties authorize staff to engage a public auctionhouse
(live or online) while still meeting the requirements of F.S. 125.35.
PREVIOUS RELEVANT BOCC ACTION: On 10/16/19, the BOCC adopted Resolution 378-
2019. On 1/22/20, the BOCC asked staff to bring back this discussion item.
