AGENDA ITEM WORDING: Approval of a contract to purchase a less than fee interest in Block
9, Lots 1, 2, 15, and 16, Pirates Cove (PB 3-18) with parcel number 00494080-000000 and a
purchase price of $74,752 for density reduction purposes.
ITEM BACKGROUND: This acquisition is proposed pursuant to BOCC Resolution 438-2018 (the
Less Than Fee Acquisition Program) to protect property rights, to reduce density, and to reduce the
.
The subject property consists of four adjoining lots totaling 10,000 square feet on John Silver Drive
and Blackbeard Drive on the bay side of Key Largo near mile marker 98. The property is designated
Tier 3 Infill Area and zoned Improved Subdivision - Masonry. The property is wooded with
tropical hardwood hammock species and has no structures.
The Planning and Environmental Resources Department has confirmed that each lot has the potential
to be developed with one dwelling unit and the Land Authority has prepared and negotiated the
proposed purchase contract on behalf of the BOCC. The Seller has agreed to retire the development
rights for dwelling units and detached habitable space on the property. The purchase price for this
less than fee interest is $74,752. Since there is no separate market land value listed for Lots 1, 2, 15,
sed on the
$18,688 current market land value listed for a comparable lot in the same subdivision (Block 10, Lot
8). The estimated closing costs for this transaction will be approximately $1,250.
Once the proposed transaction closes, the Seller will continue to own the lots and may use them in
conjuction with her existing house on her adjoining parcels but will be precluded from developing
the lots with dwelling units or other detached habitatable space.
PREVIOUS RELEVANT BOCC ACTION: The Board budgeted funds for purchases which are
lawsuits through voluntary purchases.
