ITEM BACKGROUND: On March 25, 2009, the Planning Commission approved an allocation award for
Mamie Caputo for building permit application#05304736 provided the applicants' Lot Aggregation Restrictive
Covenant was approved by the Growth Management Division Director. The Lot Aggregation Restrictive
Covenant was approved and subsequently recorded in the Monroe County Public Records on September 15,
2009 prior to the issuance of the building permit on October 27, 2009. Based on the Building Department
records, the permit has no inspections for the project and the building permit has received House Bill 7207
extension which does not expire until April 27, 2014. A site visit conducted by staff on July 19, 2013,
confirmed construction has not commenced on the property.
The applicant is requesting the allocation award be rescinded and that the building permit be voided and closed,
only upon the Board of County Commissions approval to remove and release the Lot Aggregation Restrictive
Covenant recorded in the Monroe County Official Records Document#1758868, Book#2431, Page#1092. If
the BOCC releases the restrictive covenant, the applicant will then be required to submit new applications for
building permits,ROGO allocations and be subject to the regulations in effect at that time.
The residential rate of growth ordinance (ROGO),Monroe County Code Section 138-28,Evaluation criteria has
a provision for lot aggregation point assignment; however, the code does not address rescinded allocation
awards or building permits.
PREVIOUS RELEVANT BOCC ACTION: On June 23, 1992, the BOCC adopted Ordinance No. 016-
1992.; and Ordinance #009-2006 (Revised Residential Rate of Growth— Tier Ordinance) on March 15,
2006.

RELEASE OF RESTRICTIVE COVENANT FOR LOT AGGREGATION
Whereas, Steven L. and Marni Caputo filed a lot aggregation restrictive covenant on September
15, 2009, in OR Book 2431 at Page 1092 on the following property in favor of Monroe County,
Florida to restrict development to one dwelling unit on the following property:
Lots 8 & 9, Block 3, Winston Park, Key Largo, according to the plat thereof
recorded at Plat Book 4, Page 104 of the public records of Monroe County,
Florida;
and
Whereas, the Board of County Commissioners approves the removal of the lot aggregation
restrictive covenant provided no development has commenced on the property; and
Whereas, the property owner has rescinded the allocation award and building permit by affidavit
attached as Exhibit A hereto conditioned upon the Board of County Commissioners approval to
remove the restrictive covenant and executing a release;
Now, therefore, on this 21st day of August, 2013, Monroe County, by and through its Board of
County Commissioners, hereby releases the above legally described property from the lot
aggregation restrictive covenant recorded in OR Book 2431 at Page 1092 of the Official Records
of Monroe County.

Affiants Marni and Steven L. Caputo,husband and wife,hereby state as follows:
1. Marni Caputo is the owner of the following described property:
Lots 8 & 9,Block 3, Winston Park,Key Largo, according to the plat thereof recorded at
Plat Book 4, Page 104 of the public records of Monroe County, Florida(Property)
2. Affiants filed a lot aggregation restrictive covenant (Restrictive Covenant) on September 15,
2009, in OR Book 2431 at Page 1092, on the Property in favor of Monroe County, Florida to
restrict development to one dwelling unit on two platted lots in return for lot aggregation points
in the residential permit allocation system(ROGO).
3. Affiants received a ROGO allocation(05304736) for the Property on March 25, 2009, and the
building permit (05304736) for the Property was issued on October 27, 2009. The building
permit expires April 27,2014.
4. Affiants request that the above allocation award be rescinded and the above building permit
be voided and closed, only upon the Monroe County Board of County Commissioners (BOCC)
approval to remove and release the Restrictive Covenant, thus reinstating the possibility of
building two dwelling units on two lots, subject to the Monroe County Land Development
Regulations and Rate of Growth Ordinance.
5. Affiants have not commenced any building or development activity on the property.

6. If the Restrictive Covenant is released by the BOCC, and the allocation and building permit
rescinded and voided, no development activity will occur on the property until and unless new
building permits authorizing development are obtained.
7.Affiants understand and agree to the following:
1) Upon release of the Restrictive Covenant, the current building permit and ROGO
allocation will be void, and affiants will have no further use or rights to them on this
Property or any other property.
2) The above described Property consists of vacant parcels of land which cannot be
developed without development approval.
3) Any future proposal of residential development is subject to ROGO.
4) Any proposed development in the future will be subject to the land development
regulations in effect at that time.
5) Required approvals for any building permits to be issued in the future may not be able to
be obtained.
6) New applications and fees for any development proposal will be required.
7) The parcels have not been authorized for storage or accessory uses or any other use. All
vehicles, trailers, and other items sitting or stored on the property will be immediately
removed and the properties shall remain vacant until required permits for any activity are
obtained.

Dear Tiffany:
Per the attached warranty deed, I am the owner of the property the above permit was
issued to on October 27, 2009 and printout is attached. I have also attached is a copy of the
front sheet of the property record showing myself as the current owner. On December 22,
2011,there was an extension applied to the permit which expires on April 27,2014.
The attached Restrictive Covenant combines Lots 8&9, Block 3 of Winston Park which
was recorded on 9/15/2009.
This letter will serve as a request to rescind the allocation award/building permit which
was granted to the property. I also request that the Lot Aggregation Covenant that was
recorded in the Monroe County Clerk of Courts be removed from these two properties.
Please note on the attached Property Appraisers Cards that the two lots have not been
combined under one Parcel ID Number.
I am making this request as I would like to construct a residence on each property which
would increase the tax revenue to the County along with generate work with the Construction
Industry.
I understand by the above being approved,the allocation and permit will be rescinded
and I will be required to submit a new application, plans and other required items to the
Monroe County Building Department and Planning Department for their review and approval.
