ITEM BACKGROUND: On September 10, 2003, the Planning Commission approved an allocation award for Victoria Aleksandrowicz for building permit application #03301774 provided the applicant's Affordable Housing Deed Restriction was approved by the BOCC.The Affordable Housing Deed Restriction was approved by the BOCC August 18, 2004. Subsequently, the restriction was recorded in the Monroe County Public Records on September 15, 2004, prior to the issuance of the building permit on October 14,2004. Based on the Building Department records, the permit had one listed inspection. The inspection was for a temporary power pole which passed inspection. Subsequently, the permit expired and therefore, the ROGO allocation award has expired as well. A site visit conducted by staff on July 30, 2013,confirmed the property is vacant. The current property owner, Walter Alexander, is requesting the release of the Affordable Housing Deed Restriction recorded in the Monroe County Official Records in order to sell the property without a restriction. If the BOCC releases the deed restriction, the property owner or subsequent property owners will then be required to submit new applications for building permits,ROGO allocations and be subject to the regulations in effect at that time. The residential rate of growth ordinance(ROGO), Monroe County Code Sections does not address the scenario of expired building permits and expired allocation awards relative to an affordable housing deed restriction.
