Approval to initiate collection proceedings, (complaint for foreclosure and money judgment) in circuit court
for liens filed on behalf of the County in Code Enforcement Case(s) CE08100251 and CE12020070.
ITEM BACKGROUND:
On October 18, 2008, Code Compliance posted a Stop-Work-Order at 785 Bostwick Drive, Key Largo, for
roofing without permits and approvals and assigned case number CE08100251. Research revealed the
following facts:
• A permit application was received by the building department to replace trusses and add porch on
February 5, 2004. After review the permit was placed in pending status for insufficient plans and was
voided on March 11, 2004.
• A permit was issued on April 18, 2008 for interior renovations. This permit did not include the roof
trusses or any exterior renovations.
A Notice of Violation/Notice of Hearing was mailed to the property owner on December 23, 2008. A
Hearing was held on January 29, 2009 and the Special Magistrate found the property owner in violation of
the two charges as cited and ordered a compliance date of March 19, 2009. On March 26, 2009 a review
hearing was held and Special Magistrate ordered a daily fine in the amount of$200.00, ($100.00 for each
code violation), for each day a violation remains uncorrected beginning April 23, 2009. On June 25, 2009
another review hearing was held and Special Magistrate issued an order imposing penalty and authorizing
recording lien.
On August 5, 2009 the order was recorded in the Official Records of Monroe County as a lien and as of
August 1, 2013 the daily fines in the amount of$200.00 per day have accrued for 1560 days for a total of
$312.000.00 and continue to accrue.
While researching the status of this case research revealed that the entire house has been rebuilt/renovated
and enlarged without benefit of permit(s), approval(s) and inspection(s) and was advertised for rent. A
Notice of Violation/Notice of Hearing initiating a second Code Case (CE12020070) was served on the
property owner on March 23, 2012. A Hearing was held on May 31, 2012 and the property owner did attend.
The Special Magistrate found the property owner in violation of all (five) charges as cited and issued an order
for a one-time fine in the amount of$5,000.00 to be paid in 180 days for the flagrant nature of the violations
and the unsafe nature of the violations; ordered an immediate cease and desist of all use of the property; that
all tenants and occupants must vacate the property by June 3, 2012; ordered that the property be secured
against intrusion to protect against the elements and unauthorized entry, so that the property will not become
a nuisance by June 15, 2013; and ordered the County to take necessary steps to have the utilities disconnected
from the property. The Special Magistrate also set a compliance date of June 7, 2012 imposing fines in the
amount of$2,500.00 per day ($500.00 per day per violation) beginning June 8, 2012 and continuing until the
property owner complied with the Order by correcting the violations.
On June 18, 2012 the FINAL ORDER was recorded in the Official Records of Monroe County as a lien and
as of August 5, 2013 the daily fines in the amount of$2,500.00 per day have accrued for 423 days for a total
of$1,057,500.00 and continue to accrue.
On July 18, 2013 the Special Magistrate approved a motion to authorize collection proceedings and issued
Order(s) authorizing the County to institute foreclosure and/or money judgment proceedings to recover the
amount of the lien(s) on both cases.
As of August 5, 2013 the total amount of the (2) liens filed pursuant to the Code Cases was $1,369,500.00
and daily fine(s) in the amount of$2,700.00 per day continue to accrue. The $5,000.00 one-time fine was
paid on July 15, 2013. As of August 5, 2013, there have been no permits applied for, either After-the-Fact or
for demolition of the structure. There has been minimal effort on the part of the Property Owner to gain
compliance.

mitigation fees, or restoration of the property to original
condition may be required. The minimum fee for an After The
Fact permit is $500 . 00 (five hundred dollars) as per
Monroe County Code Section 629 (a) (1) . All permits will
require final inspection(s) .
TO AVOID FINES AND/OR COSTS OF prosecution as per Chapter 162 F.S.
all violations noted above must be corrected by
IT IS YOUR RESPONSIBILITY TO CALL YOUR INSPECTOR AND REQUEST A
RE INSPECTION. If you fail to correct the above described violation (s) by
the above date, or if you wish to contest the alleged violation (s) , you must
appear before the Special Magistrate as stated below.

PLEASE TAKE NOTICE that a Public Hearing will be conducted by the Special
Magistrate in the above case on 01/29/2009 at 9 : 00 AM at the
Monroe County Government Regional Center, 2798 Overseas Hwy. , Marathon,
Florida. The purpose of this hearing is to determine if in fact, a viola--
tion currently exists, the appropriate action to be taken, and any fines or
penalties to be imposed. YOUR FAILURE TO APPEAR MAY RESULT IN A FINE OR
PENALTY BEING IMPOSED AGAINST YOU AND A LIEN BEING IMPOSED ON YOUR PROPERTY
You may appear in person d/or be represented by an -torney. If you are
represented by an attorney, your attorney is required to file a written
notice of appearance with this office prior to the hearing.
*IF YOU DECIDE TO APPEAL any decision by the Special Magistrate, you will
need to ensure that a verbatim record of the proceedings is made, which
shall include the testimony and evidence upon which the appeal is to be
based.
Should you seek a continuance of your administrative hearing, the presiding
officer may grant a continuance of a hearing for good cause shown. Except in
cases of emergency, requests for continuance must be made at least FIVE working
prior to the date noticed for the hearing. A request for continuance
DOES NOT GUARANTEE a postponement of your hearing. Contact the office of the
Liaison for the Special Magistrate to submit your request .
Pursuant to F.S . Chapter 162 . 09 (2) (d) , your failure to correct the
violation(s) may result in the impositon of a fine, not to exceed $1, 000
per day per violation for a first violation, $5, 000 per day per violation
for a repeat violation, and up to $15, 000 per violation if the Special
Magistrate finds the violation to be irreparable or irreversible in nature.
In addition to such fines, the Special Magistrate may impose additional
fines to cover all costs incurred by the local government in enforcing
its codes and all costs of repairs pursuant to subsection (1 ) .

This case was heard at public hearing before the Code Enforcement Special Magistrate
on January 29, 2009, at the Monroe County Government Regional Center,located at 2798
Overseas Highway,Marathon,Florida. Having fully considered the evidence presented at

FINDINGS OF FACT AND CONCLUSIONS OF LAW
1. The Respondents are the owners of record of property located at:
BK 4 LT 6 TWIN LAKES KEY LARGO. RE#:00548510-000000.
2. The Respondents were duly noticed of the hearing;and
3. The above-described property is in violation of the Monroe County Code as described
in Exhibit"A,"which is attached hereto and incorporated herein.
Therefore it is
ORDERED AND ADJUGED:
1. Respondents are found to be in violation of the Monroe County Code as described in
Exhibit "A", and are ordered to correct all violations on or before March 19, 2009 (hereinafter
referred to as the "Compliance Date") and attend a compliance/review hearing to be held on
March 26, 2009.
2. Upon complying, Respondents shall notify the Code Inspector in this case, who
shall re-inspect the property and, if the property is determined by the Code Inspector to be in
compliance, notify the Code Enforcement Department.
3. Noncompliance by the Compliance Date may result in the imposition of a fine for
each Code violation and for each day after the Compliance Date that Respondents are in
violation.
4. Pursuant to Section 162.07, Florida Statutes, costs in an amount to be determined at
the conclusion of this case are hereby levied for the administrative recovery of the costs of
prosecuting and investigating this matter. Costs will continue to accrue until compliance is
achieved.
5. In the event of nonpayment of fines and costs imposed on Respondents, a certified
copy of an order imposing fine may be recorded in the public records and shall thereafter
constitute a lien against the land on which the violation or violations exist and upon any other
real or personal property owned by the violators.

This case was heard at public hearing before the Code Enforcement Special Magistrate
on June 25, 2009 at the Monroe County Government Regional Center,located at 2798 Overseas
Highway,Marathon,Florida. The Special Magistrate fully considered the evidence presented at
hearing,including testimony of witnesses under oath.
1. The Respondent is the owner of record of property located at:
BK 4 LT 6 TWIN LAKES, KEY LARGO. (RE#: 00548510-000000).
2. On January 29,2009 an Order finding Respondent in violation of Section 6-4(b) and
9.5-111(1)of the Monroe County Code,was entered.
3. On March 26, 2009 an Order Imposing Fine was entered.
4. The Respondent was ordered to correct the Code violations by April 23,2009
(hereinafter referred to as the"Compliance Date"), and was informed that failure to do so could
result in the imposition of a fine for each Code violation and for each day after the Compliance
Date that Respondent was in violation.
5. Respondent was also ordered to pay the costs of the prosecution and investigation of
this matter.
6. As of June 25, 2009 the Respondent had not corrected the Code violations.
Therefore it is
ORDERED:
1. Respondent shall pay to Monroe County, Florida, a fine in the amount of$100.00
(ONE HUNDRED DOLLARS) for each Code violation, for each day a violation remains
uncorrected beginning April 24, 2009 and the costs of the prosecution and investigation of this
matter; and
2. MONROE COUNTY MAY RECORD A CERTIFIED COPY OF THIS ORDER IN
THE PUBLIC RECORDS, WHICH SHALL THEREAFTER CONSTITUTE A LIEN

FINAL ORDER
This case was heard at public hearing before the Code Compliance Special Magistrate on
May 31, 2012. Respondent Nick Martinez was present and did not contest the violations set
forth in the Notice of Violation/Notice of Hearing, which was served on March 23, 2012 and is
incorporated by reference as if fully set forth herein. Having fully considered the evidence
presented at hearing, including testimony of witnesses under oath,the following findings of fact
and conclusions of law are ORDERED:
The Respondents are the owners of record of property located at 785 Bostwick Drive,
Key Largo, Florida, RE#: 00548510-000000. They were duly noticed of the hearing.
The Respondents are found to be in violation of the Monroe County Code as described in
the Notice of Violation/Notice of Hearing in this case. Pursuant to section 162.07, Florida
Statutes, costs in an amount to be determined at the conclusion of this case are hereby levied for
the administrative recovery of the costs of investigating and prosecuting this matter. Costs will
continue to accrue until compliance is achieved and the case is closed. Furthermore,the
Respondents are ordered to correct all violations described in the Notice of Violation/Notice of
Hearing on or before June 7 2012 (hereinafter referred to as the"Compliance ate")
In the event the violations are not corrected on or before the Compliance Date, daily fines
in the following amounts,per violation,will begin to accrue on the day after the Compliance
Date for each noncompliance:
110-140.1(1) $500.00
122w4.(a)(8) $500.00
130-186 $500.00
23-72 $500.00
6-144.(7)b $500.00
A one-time fine in the amount of$5,000.00 is ORDERED, given the flagrant nature of
the violations,and the conditions causing the violations are found to present a threat to the public
health, safety, and welfare. It is further ordered that the County is authorized to make all
reasonable repairs which are required to bring the property into compliance and to charge the
Respondents with the costs thereof, including administrative recovery of the costs of
investigating and prosecuting this matter. The one-time fine is payable within 180 days after the
date of this Final Order.
The Respondents are ORDERED to immediately cease and desist any and all occupation
of the property as a residence and all leasing,renting, or advertising of the property as available
for lease or rent. The Respondents are ORDERED to ensure that all tenants and occupants have
vacated the property no later than June 3, 2012.
The Respondents are ORDERED to terminate water and electric service to the property,
within 7 days after the date of this Final Order.
The Respondents are ORDERED to secure the property against intrusion to protect
against the elements and unauthorized entry, so that the property will not become a nuisance.

Substantial compliance with this provision shall be had not later than June 8, 2012, and full
compliance not later than June 15, 2012. The Building Official shall determine whether the
property has been sufficiently secured as ordered herein.
In the event of nonpayment of fines and/or costs imposed on the Respondent(s), a certified copy
of this Order may be recorded in the public records and shall thereafter constitute a lien against
the land on which the violation or violations exist and upon any other real or personal property
owned by the violator. The County may institute foreclosure proceedings if the lien remains
unpaid for three months and/or may sue to recover money judgment for the amount of the lien
plus accrued interest. Please make checks payable to Monroe County Code Compliance and mail
to: Monroe County Code Compliance, Attn: Office of the Liaison, 2798 Overseas Hwy., Suite
330, Marathon, FL 33050.

FINAL ORDER
This case was heard at public hearing before the Code Enforcement Special Magistrate
on January 29, 2009, at the Monroe County Government Regional Center,located at 2798
Overseas Highway,Marathon,Florida. Having fully considered the evidence presented at
hearing, including testimony of witnesses under oath,the following findings of fact and
conclusions of law are made:
FINDINGS OF FACT AND CONCLUSIONS OF LAW
1. The Respondents are the owners of record of property located at:
BK 4 LT 6 TWIN LAKES KEY LARGO. RE#:00548510-000000.
2. The Respondents were duly noticed of the hearing;and
3. The above-described property is in violation of the Monroe County Code as described
in Exhibit"A,"which is attached hereto and incorporated herein.
Therefore it is
ORDERED AND ADJUGED:
1. Respondents are found to be in violation of the Monroe County Code as described in
Exhibit "A", and are ordered to correct all violations on or before March 19, 2009 (hereinafter
referred to as the "Compliance Date") and attend a compliance/review hearing to be held on
March 26, 2009.
2. Upon complying, Respondents shall notify the Code Inspector in this case, who
shall re-inspect the property and, if the property is determined by the Code Inspector to be in
compliance, notify the Code Enforcement Department.
3. Noncompliance by the Compliance Date may result in the imposition of a fine for
each Code violation and for each day after the Compliance Date that Respondents are in
violation.
4. Pursuant to Section 162.07, Florida Statutes, costs in an amount to be determined at
the conclusion of this case are hereby levied for the administrative recovery of the costs of
prosecuting and investigating this matter. Costs will continue to accrue until compliance is
achieved.
5. In the event of nonpayment of fines and costs imposed on Respondents, a certified
copy of an order imposing fine may be recorded in the public records and shall thereafter
constitute a lien against the land on which the violation or violations exist and upon any other
real or personal property owned by the violators.

This case was heard at public hearing before the Code Enforcement Special Magistrate
on June 25, 2009 at the Monroe County Government Regional Center,located at 2798 Overseas
Highway,Marathon,Florida. The Special Magistrate fully considered the evidence presented at
hearing,including testimony of witnesses under oath.
1. The Respondent is the owner of record of property located at:
BK 4 LT 6 TWIN LAKES, KEY LARGO. (RE#: 00548510-000000).
2. On January 29,2009 an Order finding Respondent in violation of Section 6-4(b) and
9.5-111(1)of the Monroe County Code,was entered.
3. On March 26, 2009 an Order Imposing Fine was entered.
4. The Respondent was ordered to correct the Code violations by April 23,2009
(hereinafter referred to as the"Compliance Date"), and was informed that failure to do so could
result in the imposition of a fine for each Code violation and for each day after the Compliance
Date that Respondent was in violation.
5. Respondent was also ordered to pay the costs of the prosecution and investigation of
this matter.
6. As of June 25, 2009 the Respondent had not corrected the Code violations.
Therefore it is
ORDERED:
1. Respondent shall pay to Monroe County, Florida, a fine in the amount of$100.00
(ONE HUNDRED DOLLARS) for each Code violation, for each day a violation remains
uncorrected beginning April 24, 2009 and the costs of the prosecution and investigation of this
matter; and

FINAL ORDER
This case was heard at public hearing before the Code Compliance Special Magistrate on
May 31, 2012. Respondent Nick Martinez was present and did not contest the violations set
forth in the Notice of Violation/Notice of Hearing, which was served on March 23, 2012 and is
incorporated by reference as if fully set forth herein. Having fully considered the evidence
presented at hearing, including testimony of witnesses under oath,the following findings of fact
and conclusions of law are ORDERED:
The Respondents are the owners of record of property located at 785 Bostwick Drive,
Key Largo, Florida, RE#: 00548510-000000. They were duly noticed of the hearing.
The Respondents are found to be in violation of the Monroe County Code as described in
the Notice of Violation/Notice of Hearing in this case. Pursuant to section 162.07, Florida
Statutes, costs in an amount to be determined at the conclusion of this case are hereby levied for
the administrative recovery of the costs of investigating and prosecuting this matter. Costs will
continue to accrue until compliance is achieved and the case is closed. Furthermore,the
Respondents are ordered to correct all violations described in the Notice of Violation/Notice of
Hearing on or before June 7 2012 (hereinafter referred to as the"Compliance ate")
In the event the violations are not corrected on or before the Compliance Date, daily fines

within 7 days after the date of this Final Order.
The Respondents are ORDERED to secure the property against intrusion to protect
against the elements and unauthorized entry, so that the property will not become a nuisance.

Substantial compliance with this provision shall be had not later than June 8, 2012, and full
compliance not later than June 15, 2012. The Building Official shall determine whether the
property has been sufficiently secured as ordered herein.
In the event of nonpayment of fines and/or costs imposed on the Respondent(s), a certified copy
of this Order may be recorded in the public records and shall thereafter constitute a lien against
the land on which the violation or violations exist and upon any other real or personal property
owned by the violator. The County may institute foreclosure proceedings if the lien remains
unpaid for three months and/or may sue to recover money judgment for the amount of the lien
