10 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY
11 COMMISSIONERS ENACTING A 100-DAY TEMPORARY EMERGENCY
12 SUSPENSION OF THE ACCEPTANCE AND PROCESSING OF
13 APPLICATIONS TO THE PLANNING & ENVIRONMENTAL
14 RESOURCES DEPARTMENT; PROVIDING FOR AN EFFECTIVE DATE
15 OF MARCH 15,2020.

18 WHEREAS, the Board of County Commissioners is the legislative body of Monroe
19 County,Florida; and
20 •
21 WHEREAS, Section 252.38(3)(a), Florida Statutes, gives authority to political
22 subdivisions to declare and enact a State of Local Emergency for a period of up to seven (7)
23 days, thereby waiving the procedures and formalities otherwise required of the political
24 subdivision by law; and
25
26 WHEREAS,on March 1, 2020,the Governor of Florida issued Executive Order Number
27 20-51 directing the State Health Officer and Surgeon General to declare a Public Health '
28 Emergency due to the discovery of COVID-19/novel Coronavirus in Florida;and
29
30 WHEREAS,on March 9, 2020, the Governor of Florida issued Executive Order Number
31 20-52, declaring a State of Emergency for the Stale of Florida related to COVID-19/navel
32 Coronavirus; and
33
34 WHEREAS, COVID-19/novel Coronavirus poses a health risk to Monroe County
35 residents; and
36
37 WHEREAS, responding to the threat posed by COVID-19/novel Coronavirus may
38 require extraordinary and immediate actions by Monroe County in order to protect the public
39 health,safety, and welfare of county residents and visitors; and
40
41 WHEREAS, Section 11-1 of the Monroe County Code vests the Mayor with the
42 authority to declare a state of local emergency for a renewable period of up to seven(7)days and
43
44 WHEREAS, the Monroe County Mayor declared a State of Local Emergency on March
45 15, 2020, due to COVID-19/novel Coronavirus, to "initiate protective measures necessary to
46 ensure the health,safety, and welfare of residents and visitors;" and
•
1 WHEREAS, during this period of time, in an effort to maintain safety, the Planning &
2 Environmental Resources Department staff have had to alter office operations in a way that
3 allows staff to process applications already in progress(pending applications),but are not able to -
4 accept new applications for the Planning & Environmental Resources Department, unless
5 specified below; and

7 WHEREAS, during this period of time, in an effort to maintain safety, the Planning &
8 Environmental Resources Department cannot proceed to required public meetings/hearings, as
9 the County is following the Center for Disease Control and Prevention (CDC) and State
10 - Department of Health(DOH)Directives; and
11
12 WHEREAS, enacting a temporary suspension for 100-days is necessary to protect the
13 general welfare of the county;

15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
16 COMMISSIONERS OF MONROE COUNTY,FLORIDA:

18 Section 1. Monroe County is enacting a 100-day temporary emergency suspension of the
19 acceptance and processing any new Planning & Environmental Resources
20 Department applications for development approval, including ROGO and
21 NROGO applications, for a 100-day period beginning on March 15, 2020 and
22 ending on June 23,2020, except for the following applications:

24 1. Appeals to the Planning Commission; and
25 2. Department of Administrative Hearings (DOAH)Appeals; and
26. 3. Temporary Housing for Emergency Relief Workers; and
27 4. Temporary Non-Emergency Housing (site security for capital improvement
28 projects).

30 The Planning & Environmental Resources Department will accept new
31 applications for the specified applications listed above via email in order to meet
32 appeal deadlines and provide for housing needs if they arise, but applications may
33 not be fully processed until the Department is able to receive hard copy original
34 submissions, with the applicable fees, and until public hearings are back in
35 session. The Planning Director shall have the ability to determine if additional
36 application types will be accepted prior to conclusion of the 100-day temporary
37 emergency suspension.

39 Section 2. Pending applications submitted to the Department prior to March 15, 2020 will
40 continue to be processed during this temporary suspension and any required
41 deadlines for mandatory submission requirements and community meetings are
42 tolled for 100-days. Any existing pending application that requires public
43 meetings/hearings will not be moved to public meeting/hearing until further
44 notice. Existing pending applications that require in-person site visits or
45 inspections will not be processed until further notice.

1 Section 3. Planning Commission, Development Review Committee, and Historic
2 Preservation Commission hearings, and required Community Meetings are
3 suspended for a 100-day period beginning on,March 15, 2020 and ending on June
4 23, 2020, unless the Monroe County Mayor lifts the declared a State of Local
5 Emergency, or if the BOCC adopts a resolution, or the State executes an
6 administrative order, allowing for public hearings and/or public meetings to be
7 conducted(virtual or otherwise).

9 Section 4. Effective Date. This resolution shall become effective retroactive to March 15,
10 2020.

13 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
14 Florida, at a regular meeting held on the 15th day of April,2020.
