ITEM BACKGROUND: Staff contracted with Schneider Electric in 2019 to review the electric
system at the Monroe County Detention Center(jail). That study recommended replacement of
several electric distribution system components. Staff was in the process of contracting the
replacement of the main electric breaker on an emergency basis when the main electric busway
failed catastrophically on 17 April 2020. As staff brought generator power to the building, they
discovered that a number of the other Schneider recommended improvements would ensure reliable
backup power in the facility.
The power outage makes replacement of the main breaker even more urgent. Staff recommends
using Schneider to complete all of the repairs since they have completed the analysis and will be
performing the main breaker repair. Any other provider will charge a separate mobilization expense.
Using Schneider to sole source the additional repairs will avoid added mobilization, complete the
repairs faster, and ensure there is a single point of accountability as the repaired system is re-
energized.

BACKGROUND CL
This office has been advised that back-up electrical power is not available in the Monroe County
Detention Center and that currently the only back--up power available is that supplied by a generator E
at the Administration Building. However, in the event of the unavailability of electrical supply from
the power grid, the generator at the Administration Building would be inadequate to supply electrical
power to both the Administration Building and the Monroe County Detention Center. It is my further
understanding that the generator supplying back-up power to the Monroe County Detention Center
is currently undergoing repairs by All Power Generators Corporation pursuant to a preexisting
competitively procured contract between Monroe County and that firm governing Emergency
Generator Inspections and Repairs. However, the electrical panels and distribution systems to which
the generator would be supplying power are incapable of handling the power load delivered thereby.
Consequently, in the event of the loss of centralized power, the Monroe County Detention Center LY
would be devoid of electricity to operate essential equipment including HVAC systems and to
effectively maintain critical security equipment. Monroe County has therefore proposed to contract
with Schneider Electric USA, Incorporated Services for the repair of the electrical panels and

distribution systems on an emergency basis due to the time sensitive nature of the need and the
absence of the opportunity to competitively procure the sen-ices.

DISCUSSION
Based upon the information provided above, I conclude the foregoing circumstances constitute an r_
emergency situation that permits a departure from the normal competitive solicitation process under
the Monroe County Code and the Monroe County Purchasing Policy. In this regard, Subsection 2-
347(k)(1), Monroe County Code provides as follows: T

It is my considered opinion that the lack of the ability to access back up power at the Monroe County
Detention Center in the event of an outage from the electrical grid constitutes an "emergency" for
purposes of Section 2-347, Monroe County Code and Chapter 7(B), Monroe County Purchasing r-
Policy.The lack of electrical power when needed poses an immediate danger to the public health and
safety as it places in jeopardy the health and safety of late enforcement personnel, the staff at the :2
Monroe County Detention Center and the residents of that facility. The lack of electrical power when n
needed further presents a danger of loss of public and private property that requires immediate

government action as it risks destruction and damage to public property- most notably the Monroe
County Detention Center itself. Finally, the lack of electrical power when needed may cause an
interruption in the delivery of an essential governmental service by preventing Monroe County from CL
performing its obligation to house residents of the facility. ru

Consequently, the foregoing circumstances constitute an emergency for purposes of Section 2-347,
Monroe County Code and Chapter 7(B), Monroe County Purchasing Policy. Owing to the contract
amount and pursuant to Chapter 7(B)(2)(b), Monroe County Purchasing Policy, the purchase under
emergency circumstances must "be approved by the Mayor, or if the Mayor is not available then the
Mayor Pro Tern,or if the Mayor and the Mayor Pro Tern are not available then County Commissioners y
in order of priority based on longest consecutive tenure on the Board of County Commission" and
"the purchase must be ratified after-the-fact by the Board of County Commissioners". Thus, the
contract for emergency services requires the signature of the Mayor or, in her absence, one of the
officials identified above and must be ratified by the Monroe County Board of Commissioners at the CL
nest available meeting thereof.

Schneider Electric USA, Inc (SEUSA) Services Low Voltage Retrofill solution features a Masterpact cradle (if
applicable) and circuit breaker, along with a new racking mechanism and primary and secondary connections in
each switchgear cell. Existing cells are modified to accept the new cradle (if applicable) and circuit breaker,
including a custom-engineered connection between the cradle (if applicable) and the switchgear line and load
side bus. A retrofill solution is often used in lieu of the direct replacement option for larger devices, such as main
circuit breakers and tie circuit breakers.
Custom designs are available for any manufacturer's low voltage switchgear.

WORKSCOPE A: 4000A NW Retrofill
1. Schneider Electric USA, Inc. (SEUSA) Services will remove (1) existing 4000A Square D SE circuit breaker and
retrofill it with (1) 4000A Masterpact NW circuit breaker. As no short-circuit current rating is available at this time,
the breaker as quoted is rated 100kA at 480Vac. Should the subsequent study show that a breaker of a higher
rating is required, additional costs will apply. 0
2. SEUSA Services will supply and install all necessary components to connect the breaker to the existing
system. This includes: new copper bus, front door, bus supports, and breaker mounting plate.
3. A site visit will be required by a SEUSA Services Engineer to obtain the necessary measurements required for
the design. A bus outage of 8 to 10 hours will be required for this visit. SEUSA Services will require 2-3 week
notice to schedule this visit.
4. The customer will be responsible for supplying the following:
-Submittals, Plan Check, and City Permits if required.
-All existing electrical drawings of their system.

This work will be performed upon West Chester receipt of a purchase order and all pertinent equipment
information. Once received, SEUSA Services will contact the customer to coordinate the schedule. Initial
schedule would include 2-3 weeks to schedule on site measurements of internal components of existing =
equipment. Upon completion of site measurements, 16 weeks is the typical requirement for the design and
manufacture of the retrofill components required. Upon shipment of all retrofill equipment, a field installation
outage will be scheduled at customer's first convenience. A 2 to 4 weeks advanced notice is required for
scheduling onsite work. An outage of approximately 12 to 16 hours is expected to perform the work.
In the event of cancellation, Schneider Electric Services requests a minimum 1-week notice prior to the scheduled
start date. Additionally, the customer will be responsible for providing information on the upstream and
downstream over current protective devices so that the partial coordination study to determine the correct settings
of the new Masterpact breaker.
