GRANT OF EASEMENT
THIS Greta of Easement made this 2"day of MAY _ ,2011 between the United
Sues of America,herein called the Government,acting dRottgh the Depal nor[of the Navy,herein called the
Glaun, and Maaoe Corny, a political subdivision of the State of Flaida,herein Sled the Grantee, whose
address is 11C0 Simonton Street,Key West,Florida,33040.
WHEREAS,the Government owns all parcels which abut Towhee Land,Ham Drive,Flamingo Drive,
andLimpkah Lane within Boca aka Ocean Shores Subdivision;and
WHEREAS, the Government owns all but two parcels which ably Pelican Lane within Boca Cibica
Shores subdivision;and
WHEREAS,Las 1 and 2 of Blair 15 within the Boca Chia Sines Subdivision,which art Pelican
-- - - Lane,are privately owned;and
WHEREAS, the Goveniment is willing to grant Motive Canny an easement across its propety to
Stall,service,and maintain utility lines,and to provide public access to Lots 1 and 2 of Block 15,in exchange for
Monroe County abandoning die dedicated, plated toads within Bop C1tica sines subdivision to the
Goven menft and
WHEREAS,the utility and public access easements will aces Las 10 and 11 of Block 14,and Lot 15 of
Block 15(as filter described in EXHIBIT A),which ale owned by theGovannaht:and
WHEREAS,the Secretary of the Navy has laud that the granting of such easement on the tans and
conditions hereinafter stated is not incompatible with the public interest
NOW THEREFORE, this Giant of Easement wmrseh that, in consideration of abadanmat of
plated toads(specifically,Towhee Lane,Pelican lane,Ham Drive,Flamingo Drive,and Lin-plan Lane within
the Bop Chat Oman Shoes Subdivision,Geiger Key,Mauve Canty,Key West,Merida)by the Grantee to
the Government,the Government hereby gnats to Monroe County and its sucassas and assigns,a perpetual
non-exclusive easement to Stall,service,and maintain utility lines and saviors and to provide access to Lots 1
and 2 of Block 15, through that portion of the Government Ixopaty hereinafter desahbed, and as shown in
Exhibits"A"and'B" attached hereto and made pat haeo6 together with alp niOns and privileges necessary a'

convenient for the full enjoyment or use thereof for the aforesaid purpose,including the right of ingress and egress
thereto and thaefiom,along under and across the said property.
A strip of land,20 fed in width,lying and as shown in Exhibits"A"and'B" attached hero and made
part hereof 10.00 feet on both sides of the following descnbed centerline,Commence at the Southeast coma of
La 10,Block 14,Boca Chica Ocean Shores,according to the Plat thereof as recorded in Plat Book 5,Page 49 of
the Public Records of Monroe Canty,Florida,thence bear N20°3623"E for a distance of 10.04 feet to the Point
of Beginning;
Thence bear N64°1908"W for a distance of 192.66 feet
Thence bear N75°5244"W for a distance of 31.30 feet;
Thence bear S72°0427W for adistance of 45.32 feet
Thence bear N90°00'00"W 33.69 feet to a point on the Easterly bmadary line of Lot 2,Block 15 of said Plat and
the Point of Terminus.
Together with:
The sidelines of the above described strip of land shall be extended and shortened to terminate at East baudary
lines of Lots I and 2,Block 15 and the East boundary line of La 10 Block 14,all in Boca Chica Ocean Shores
Subdivision,according to the Plat thereof as recorded in Plat Book 5,Page 49 of the Public Records of Monroe
^,c:y,Florida
THIS EASEMENT is granted subject to the following terms and conditions:
1. All work in connection with the installation,service,and maintenance of the access and utility IS
easement and to provide access to Las 1 and 2 of Black 15, shall be done without castor expanse to the
Government and in accordance with plans approved in advance by the Commanding Officer, Naval Facilities
Engineering Command Southeast,hereinafter referred to as the Commanding Officer.
2. All work shall cease and the Public Works Officer at Naval Air Station Key West shall be notified if
any buried debris or hazardous material is encountered during the installation, service,and maintenance of the
access and utility line easement with access to Las 1 and 2 of Block 15.
3. The Grantee shall maintain the Remises in good condition at all times and shall promptly make all
repairs thereto that may be necessary for the preservation of the condition of the Premises and the continued
maintenance of the ns and utility line easement with access to Lots I and 2 of Block 15.
4. The Grantee's rights hereunder shall be subject to such reasonable riles and regulations as may be
prescribed by the Government to assure that the exercise of shrh tights will not interfere with Government
activities at Naval Air Station Key West or with the secured Government perimeter at the Boca Chica Ocean
Shares Subdivision

5. Upon the termination of this easement all inprovenhents installed or constructed shall become
property of the U.S.Navy.
6. If at any fume time, the Government daamma that the access and utility line easement,or any
portion thereat unruly itae feres with my of its activities,it shall have the right to teammate this easement in wide
or in pan,to the extent necessary to eliminate such interference;Provided that,it shall convey to die Grantee,without
charge, a snhst;ner easarea permitting the Grantee to relocate the easement cc a portion thereof, on ailment
Govemmnat property,at the Grantees cost and expense The salon ire easement shall txxtain the same tams and
conditions as those of this easement,and shall bear the same expiration date,if any.
7. Grantee shall comply with all applicable Federal,State and Local laws,regulations,and standards that
are a may become applicable to the Grantee's activities on the Premises.
8. Grata shall rnt be responsible for the cost and expense for any environmental pemtits required for
operations under this easement. Copies of all required opaalion permits shall be provided to the Public Wodts
Officer a Naval Air Station Key West.
9. Grantee shall,to the extent allowed under Florida Statute§76828,indemnify and hold hamiless the
Got/tamed from any costs,expenses,liabilities,fins a penalties restating from discharges, emissions a spills
arising from Grantee's occupancy,use a operation of the Fasem=or any other anion by the Grantee giving nice to
Goveiii fiat liability, civil or criminal, or responsibility under Federal, State or Local environmental laws. This
provision shall survive the expiation a termination of this Easement,and the Grantee's abligafios haunt shall
apply whatever Government corms costs or liabilities for Grantee's actions. Nothing herein shall be consmred as
expanding any liability of Grantee beyond that provided in Florida Stat to§76828 relating to sovereign immunity.
10. Grantee shall,to the extent allowed order Florida Steam§76828,indemnify and hold ham less the
Govanmetfom and against all delis,claims,judg ets,costs and expenses asserted by any person who is injured,
or white property is damaged as a result of or arising out of the use or omiparxy of the Easement by Grantee or
otherwise(excepting mamas caused by thenegligaxe or irmmonal an of the Gove mmt or its agents,employees,
a contractors). Nothing herein shall be construed as expanding any liability of Grantee beyond that provided in
Florida Statute§76828 relating to sovereign immunity.
11. All a any part of the easement maybe taminated upon false by the Grantee to comply with any of
is tams and wii& s,upon abandonment of the rights grated herein,or upon non-use of such rights for a period
of two consecutive years.
12. The Government may use the Premises of this easement for any pnpose that does not unreasonably
interfere with the use andenjoyment bythe Grantee of the tights granted by thiseasement
