A special meeting of the Monroe County Board of County Commissioners convened at
11:00 a.m.at the Harvey Government Center and via Communication Media Technology.
Present and answering to roll call were Commissioner Craig Cates, Commissioner Michelle
Coldiron, Commissioner David Rice, and Mayor Heather Carruthers. Commissioner Sylvia
Murphy was absent from the meeting. Also present at the meeting were Roman Gastesi, County
Administrator; Bob Shillinger, County Attorney; Kevin Madok, Clerk of Court; Pamela
Hancock, Deputy Clerk; county staff, members of the press and radio; and the general public.
CLERK
Al Kevin Madok, Clerk, gave a presentation and update of the Clerk's and the County's
Enterprise Resources Planning (ERP) system. The Clerk's 2020 excess fees of$1,500,000.00
will be used for the first phase of the ERP system implementation. This represents approximately
1/3 of the total implementation cost. Roman Gastesi, County Administrator; and Bob Shillinger,
County Attorney, addressed the Board. After discussion, the Board continued the item to the
May 20, 2020 BOCC meeting.
BUDGET AND FINANCE
B 1 Tina Boan, Sr. Director Budget& Finance, addressed the Board concerning
approval of various Resolutions for the Transfer of Funds. After discussion, motion was
made by Commissioner Rice and seconded by Commissioner Coldiron to adopt the
following Resolutions:

COUNTY ATTORNEY
C 1 Mr. Shillinger and Bryan Cook, Director of Employee Services, addressed the
Board concerning approval of a Resolution of the Monroe County Commission
establishing a policy to allow employees an option to waive emergency response work
pay earned between March 17, 2020 and April 11, 2020 during the County's response to
the COVID-19 pandemic. After discussion, motion was made by Commissioner Rice
and seconded by Commissioner Coldiron to adopt the following Resolution with the
following amendment:
2. Employees must fill out the attached form indicating their intent to waive
payment and provide that form to the Human Resources Department no later than 5 p.m.
on Monday, May 11, 2020 Friday, May 15, 2020. The attached waiver form is
incorporated into this resolution as Exhibit A.

CLOSED SESSIONS
D2 Mr. Shillinger announced an Attorney-Client Closed Session in the matter of AshBritt,
Inc. v. Monroe County, FL and Florida Department of Transportation, Case No. CA-K-17-802
and read the required language into the record pursuant to F.S. 286-011(8). Mr. Shillinger
advised that the following persons would be present at the meeting: the County Commissioners,
County Administrator Roman Gastesi; County Attorney Bob Shillinger, Assistant County
Attorneys Cynthia Hall, Christine Limbert-Barrows, special litigation counsel Jeff Hochman and
a certified court reporter.
Mayor Carruthers declared the open session of the meeting closed. After the closed
session, the meeting was re-opened.
D5 Mr. Shillinger announced an Attorney-Client Closed Session in the matter of Disaster
Solutions v. Monroe County, 16th Judicial Circuit Case No. 2019- CA-32-K and read the
required language into the record pursuant to F.S. 286-011(8). Mr. Shillinger advised that the
following persons would be present at the meeting: the County Commissioners, County
Administrator Roman Gastesi; County Attorney Bob Shillinger, attorney Jeffrey Hochman from
the law firm of Johnson, Anselmo, Murdoch, Burke, Piper& Hochman, P.A., Assistant County
Attorney Cynthia Hall and a certified court reporter.
Mayor Carruthers declared the open session of the meeting closed. After the closed
session,the meeting was re-opened.

D3 Mr. Shillinger announced an Attorney-Client Closed Session in the matter of Donald
Davis v. Monroe County, CA-M-04-379 and read the required language into the record pursuant
to F.S. 286-011(8). Mr. Shillinger advised that the following persons would be present at the
meeting: the County Commissioners, County Administrator Roman Gastesi; County Attorney
Bob Shillinger, Assistant County Attorneys Derek Howard(appearing remotely), Steve
Williams, Peter Morris, Cynthia Hall and a certified court reporter.
Mayor Carruthers declared the open session of the meeting closed. After the closed
session, the meeting was re-opened.
D6 Mr. Shillinger announced an Attorney-Client Closed Session in the matter of Roy's
Trailer Park, Inc. d/b/a Island Life Village v. Eric Noel and Marie Noel and Monroe County v.
John Doe and.lane Doe, unknown tenants in possession of Lots 1-108 ofRoy's Trailer Park, Inc.
d/b/a Island Life Village, Case No. 19-CA-175-K and read the required language into the record
pursuant to F.S. 286-011(8). Mr. Shillinger advised that the following persons would be present
at the meeting: the County Commissioners, County Administrator Roman Gastesi; County
Attorney Bob Shillinger, Assistant County Attorneys Peter Morris and Steve Williams and a
certified court reporter.
Mayor Carruthers declared the open session of the meeting closed. After the closed
session,the meeting was re-opened.
D1 Mr. Shillinger requested to continue the Attorney-Client Closed Session in the matter of
Sunset Garden Estate Land Trust 211012014, by and through its Successor Trustee, Simtrust
Group LLC, and Sunset Gardens Farm, LLC v. Monroe County, Florida, Case No. 19-CA-460-
P. Motion was made by Commissioner Coldiron and seconded by Commissioner Rice to
continue the closed session to the May 20, 2020 meeting. Motion carried unanimously.
D4 Mr. Shillinger announced an Attorney-Client Closed Session in the matter of Monroe
County BOCC v. Magnolia 101, LLC, et al., Case No. 13-945-P and read the required language
into the record pursuant to F.S. 286-011(8). Mr. Shillinger advised that the following persons
would be present at the meeting: the County Commissioners, County Administrator Roman
Gastesi; County Attorney Bob Shillinger, Assistant County Attorneys Peter Morris and Steve
Williams and a certified court reporter.
Mayor Carruthers declared the open session of the meeting closed. After the closed
session, the meeting was re-opened.
There being no further business, the meeting of the Board of County Commissioners was
adjourned.
