Graham for Lot 3-Block 1 of Sea-Air Estates on Vaca Key for use as mulch storage area and distribution site available for public access. Attached is the duplicate original of the License, now executed and sealed by all parties, which should be returned to your Licensor. cc: County Attorney County Administrator w/o document Finance Director File LICENSE FOR USE OF REAL PROPERTY AGREEMENT made, effective as of September 1 1992, by and between Dr. Douglas N. Graham, of Marathon , Monroe County, Florida, hereinafter Licensor, and Monroe County, a political subdivision of the State of Florida, Public Service Building, College Road, Stock Island, Key West, Florida, hereinafter Licensee. In consideration of the mutual promises contained in this agreement, the parties agree as follows: Section 1 . Licensor hereby grants to Licensee a license to occupy and use, subject to all the terms and conditions of this agreement, the following described property: Block 1, Lot 3 Sea-Air Estates - Vaca Key A Section 2. The described property may be occupied and used by Licensee solely for the placement and storage of mulch' for the manual pick-up (no heavy equipment) by members of the general public during the period beginning on September 1 1992 and continuing until this agreement is terminated as provid- ed herein. Section 3. Licensee shall pay Licensor for this license at the rate of $ 1 .00 per month, the first payment due on the date set forth in Section 2 and thence payable on the first business day of each month thereafter. Section 4. Either party may terminate this agreement at any time, without regard to the payment periods , by giving written notice to the other, specifying the date of termination, such notice to be given not less than 30 days prior to the date specified in such notice for the date of termination. Section 5. Licensee will at all times defend, indemnify and hold harmless the Licensor against all actions , claims, demands , liabilities , and damages , that may, in any manner , be imposed on or incurred by Licensor as a consequence of, or arising out of, the use of the premises by Licensee. Section 6. This license agreement shall be governed by the laws of the State of Florida. Venue for any cause of action arising out of this agreement shall be in a court of competent jurisdiction in Monroe County, Florida.
