The parties agree that: n m ry a CO o A. The OSCA will pay the Grantee $19,474.95 as a 50/50 matching grant-in-aid pursuant to Specific Appropriation 2217 of the 1998-99 General Appropriations Act for establishment of a civil traffic infraction hearing officer program in Monroe County. Upon receipt of a written request for release of funds, the OSCA will make a lump sum payment to the Grantee. B. The Grant Manager will oversee the establishment,administration and operation of the civil traffic infraction hearing officer program. C. The Grantee will use grant monies provided under this Agreement to establish a civil traffic infraction hearing officer program in accordance with the requirements of§§318.30-318.38, Fla. Stat. (1997) and rule 6.630, Florida Rules of Traffic Court. I. The Grantee will use grant funds to pay up to $50 per hour for services of a full- or part-time hearing officer appointed by the chief judge, and for other expenses necessary to implement the program, including hearing officer training, office rental, furniture, and administrative staff salaries. 2. The Grantee will submit a written requisition to the OSCA for release of grant funds no later than December 7, 1998. 3. The Grantee will submit a detailed, written plan for use of grant funds and implementation of the hearing officer program to the OSCA no later than December 7, 1998. 4. The Grantee will comply with hearing officer caseload reporting requirements, to be implemented by the OSCA on January I, 1999. The Grantee's failure to comply with the reporting requirements will be grounds for termination of this Agreement. 5. The Grantee will encumber grant funds provided under this Agreement by June 30, 1999. The Grantee will return any unexpended portion of grant funds, along with interest accrued, to the OSCA for reversion to the General Revenue Fund unallocated no later than September I, 1999. The Grantee will not use grant funds for lobbying the Florida Legislature, the judicial branch, or a state agency. D. This Agreement is subject to the following terms and conditions: 1. The Grantee will maintain proper documentation of all monies spent in a manner sufficient for proper pre- and post-audit. The Grantee will maintain all expenditure records for 4 years following the conclusion of this Agreement. 2. The Grantee will maintain all records made or received in conjunction with this Agreement in accordance with rule 2.051, Florida Rules of Judicial Administration, and Chapter 119, Fla. Stat. (Supp. 1998), as it may apply. 3. The Grantee will release grant funds in accordance with the requirements of §215.422, Fla. Stat. (1997). 4. (For amounts up to $25,000) Prior to termination of this Agreement, the Grantee will submit to the OSCA and the Auditor General a sworn statement attesting to Grantee's compliance with the requirements of this Agreement. (For amounts greater than $25,000 up to $100,000) Prior to termination of this Agreement, the Grantee will submit to the OSCA and the Auditor General an audit performed in accordance with the rules of the Auditor General promulgated pursuant to §11.45, Fla. Stat. (1997),or a statement prepared by an independent certified public accountant attesting to Grantee's compliance with the requirements of this Agreement. (For amounts greater than $100,000) Prior to termination of this Agreement, the Grantee will submit to the OSCA and the Auditor General an audit performed in accordance with the rules of the Auditor General promulgated pursuant to §1 1.45, Fla. Stat. (1997) 5. If, in the judgment of the OSCA, the Grantee fails to comply with the terms of this Agreement, the OSCA may terminate the Agreement on 5 days written notice by certified mail. In the event of termination, the Grantee will return all grant funds to the OSCA for reversion into the General Revenue Fund unallocated. Page 2 of 3 • This Agreement constitutes the entire understanding of the parties. All modifications to the Agreement must be in writing. This Agreement is effective on the date of execution and will terminate on June 30, 1999.
