Resolution 143-2020 1 + T� 31— 3 4 MONROE COUNTY,FLORIDA 5 MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 6 RESOLUTION NO. 143 -2020 7 8 9 10 A RESOLUTION BY THE MONROE COUNTY BOARD OF 11 COUNTY COMMISSIONERS EXTENDING TILE 12 DURATION OF RESOLUTION NO. 225-2018 WHICH 13 AUTHORIZED THE PLACEMENT, LOCATION, 14 DURATION, TYPE OF HOUSING AND GAINFUL 15 EMPLOYMENT OF RELIEF WORKERS PURSUANT TO 16 MONROE COUNTY LAND DEVELOPMENT CODE 17 SECTION 103-1(e) FOR PROPERTY LOCATED AT 30320 18 OVERSEAS HIGHWAY, BIG PINE KEY, MONROE 19 COUNTY, FLORIDA WITH PARCEL ID 00111410-000100, 20 AND ALSO KNOWN AS THE VOLUNTEER VILLAGE. 21 22 WHEREAS, the Board of County Commissioners is the legislative body of Monroe 23 County,Florida;and 24 25 WHEREAS, the Monroe County Mayor declared a State of Local Emergency on 26 September 5, 2017 due to Hurricane Irma, a"threat of danger to the populace inhabiting Monroe 27 County" and that the County"may require expedient action in order to protect the health, safety 28 and welfare of the community;"and 29 30 WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys 31 on September 10, 2017,causing substantial damage to and loss of property;and 32 33 WHEREAS, the Monroe County Mayor issued other declarations a State of Local 34 Emergency on September 13, 2017, September 20, 2017, September 25, 2017, September 26, 35 2017 October 3, 2017, and October 11, 2017, due to Hurricane Irma, a"threat of danger to the 36 populace inhabiting Monroe County"and that the County"may require expedient action in order 37 to protect the health, safety and welfare of the community;" and 38 39 WHEREAS, Monroe County experienced a natural disaster, Hurricane Irma, which 40 caused significant damage to residences,businesses and infrastructure throughout the County;and 41 WHEREAS, pursuant to Section 103-1(b) of the Monroe County Land Development 42 Code, it is the purpose of this section to provide regulations that allow for the relaxation of the 43 use prohibitions in Chapter 130, Land Use Districts, and Chapter 138, Rate ofGrowth Restrictions Page I of 3 1 (ROGO/NROGO), to: (1) Provide regulatory authority to allow temporary emergency housing 2 not subject to the ROGO permit allocation system,for temporary occupancy by residents displaced 3 by natural or manmade disaster damage...; and 4 5 WHEREAS, pursuant to Section 103-1(a), temporary emergency housing means 6 recreational vehicles (or similar approved sheltering units) used for temporary occupancy in 7 response to natural or manmade disasters, including, but not limited to, hurricanes and tropical 8 storms, where such RVs (or other approved sheltering units) are provided to residents or relief 9 workers as part of emergency relief efforts; and recreational vehicle (RV) means the same as that 10 term is defined in F.S. § 320.01; and 11 12 WHEREAS, pursuant to Section 103-1(e), temporary emergency housing may be 13 provided for temporary occupancy by emergency relief workers involved in reconstruction 14 activities subject to certain conditions;and 15 16 WHEREAS, the County has experienced significant damage to numerous homes, and 17 must utilize available locations to provide secure temporary housing for the disaster recovery of 18 the community; and 19 20 WHEREAS, on August 15, 2018, the BOCC adopted Resolution No. 225-2018 21 authorizing the placement, location, duration and type of temporary emergency housing for 22 emergency relief workers on property located at 30320 Overseas Highway, Big Pine Key with 23 Parcel ID 00111410-000100; and 24 25 WHEREAS, Resolution No. 225-2018 authorized temporary housing on the subject 26 property fot a duration of two (2) years from the date of issuance of the required building permit 27 for placement of the temporary housing;and 28 29 WHEREAS, building permit number 19100488 was issued on February 20, 2019 for 30 placement of the temporary housing on the site,therefore the duration of Resolution No.225-2018 31 expires on February 20,2021; and 32 33 WHFREAS, the Long Term Recovery Group has been housing workers at the subject 34 property who are doing ongoing work on various Hurricane Irma recovery projects in the County, 35 and has requested an extension to the authorization for temporary emergency housing;and 36 37 WHEREAS,the BOCC wishes to extend the duration of the temporary emergency housing 38 for emergency relief workers on property located at 30320 Overseas Highway,Big Pine Key with 39 Parcel ID 00111410-000100; 40 41 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 42 COMMISSIONERS OF MONROE COUNTY,FLORIDA: 43 44 Section 1. Location. The approved location for placement of temporary emergency 45 housing for emergency relief workers is 30320 Overseas Highway, Big Pine Key with Parcel ID 46 00111410-000100 and legally described as: Page 2 of reel 1 TRACT no. 3, as per unrecorded sketch of Tropic-Island Ranchers, Big Pine Key, Florida and now particularly described by metes and bounds as follows: On the island of Big Pine Key, Monroe County, Florida, begin at the center of Section 26, Township 66 South, Range 29 East; thence run due Westerly 548.75 feel to the POINT OF BEGINNING; thence continue due Westerly 299.375 feet; thence nun due Southerly 160.0 feet; thence run due Easterly 299.375 feet; thence run due Northerly 160.0 feet to the PONT OF BEGINNING. Parcel II Easement for the purpose of vehicular and pedestrian ingress and egress as reserved in Special Warranty Deed from Carnival Fruit Company, a Florida corporation, to Bruce H. Seigal and Leda Grodsky Seigal, his wife, dated August 27, 1990, recorded August 27, 1990 in Official } Records Book 1142,at Page 1544,of the Public Records of Monroe County,Florida. 3 Section 2. Duration. The temporary emergency housing may remain on the subject 4 Properly for an additional two (2) years, for a total of four(4) years, from the date of issuance of 5 the required no-fee building permit authorizing placement of the temporary housing unit(s). The 6 expiration date of the authorization is therefore February 20, 2023. The duration may only be 7 extended at the discretion of the BOCC by an additional resolution. 8 Section 3. Type of Housing.The temporary housing shall be an approved sheltering unit, 9 including but not limited to, recreational vehicles (RVs), modular units, trailers, fold out shelters 10 and site-built structures. 11 Section 4. Gainful Employment.
