TASK ORDER
FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES
BETWEEN MONROE COUNTY AND BENDER&ASSOCIATES ARCHITECTS,P.A.
FOR EAST MARTELLO FORT A/C AND WINDOW UPGRADES
In accordance with the Agreement for Professional Architectural and Engineering Services,made
and entered into on December 19, 2018 between MONROE COUNTY, ("County") and
BENDER &ASSOCIATES ARCHITECTS,P.A.,("Consultant"),where professional services
are allowed if construction costs do not exceed $2,000,000.00,or for study activity if the fee for
professional services for each individual study under the contract does not exceed $200,000.00
("Agreement"),the panics enter into this Task Order.
All terms and conditions of the Agreement apply to this Task Order, unless this Task Order
amends,adds,or modifies a provision or an Article of the Agreement of which will be specifically
referenced in this Task Order and the amendment, addition, or modification shall be precisely
described.These additions apply only to the project referenced in this Task Order.
This Task Order is effective on the 201h of May,2020.
WHEREAS,the Stanley Papio Gallery at the East Martello Fort is currently air-conditioned space
but has air quality issues that need to be resolved,and
WHEREAS, the County has received a grant from the Tourist Development Council to address
and correct the air quality issues in the gallery.
NOW,THEREFORE,in consideration of the mutual promises and covenants set Forth below,the
parties agree as follows:
1. In accordance with Article II,SCOPE OF BASIC SERVICES of the Agreement,the
Consultant will provide design services through construction administration services for
the A/C and window upgrades in the Stanley Papio Gallery at the East Martello.
Services provided shall include:
• Prepare base documents/floor plans
• Conduct research and provide draft report on effects of A/C on historic masonry
structures and possible remedies and strategies
• Coordinate Indoor Air Quality(IAQ)study and determine and analyze results and
strategies and provide draft report.
• Conduct stakeholder meetings with Key West Art&Historical Society(KWAHS)
and County Project Management to determine program requirements.

• Provide design of system and locate equipment according to building code,HARC
guidelines and FEMA requirements
• Provide Construction Documents
• Provide Bidding Phase assistance including answering RFIs from prospective bidders
• Provide Construction Administration services during construction including review of
shop drawings,attending meetings and answering RFIs from the contractor
2. In accordance with Article VII paragraph 7.1.1 of the Agreement,the County shall pay
the Consultant a lump sum total of Fifty-Seven Thousand One Hundred and 00/100
dollars($57,100.00)paid on a percent complete basis for the following phases:
a. Schematic design(30%complete construction drawings)-$5,710.00,upon
document review and approval by the Director of Project Management.
b. Design Development(65%complete construction drawings)-$8,565,00,upon
document review and approval by the Director of Project Management.
c. Construction Documents(100%compete construction drawings)-$22,840.00,
upon document review and approval by the Director of Project Management.
d. Bidding Phase-$2,855.00 upon completion of bid process.
e. Construction Administration-$17,130.00,upon completion and closeout of
project.
All other Terms and Conditions of the Agreement remain unchanged and in full force and effect.
