AGENDA ITEM WORDING: Approval of a Resolution to update and revise the membership of
the Monroe County Substance Abuse Policy Advisory Board(SAPAB).
ITEM BACKGROUND: This Resolution outlines and clarifies the composition of the membership
of the SAPAB and indicates which member positions are required by Code, Statute or have been
historically included.
Due to the Criminal Justice Mental Health Substance Abuse (CJMHSA) Reinvestment grant
expiring on December 31, 2019. The membership no longer needs to meet the requirements of F.S.
394.657 that served for CJMHSA Planning Council matters but membership must be in accordance
with Florida Administrative Code (F.A.C.) 11D-9.005 since this Board allocates funds received
through the Edward Byrne Memorial Justice Assistance Grant(JAG)Program. Additionally, due
Misdemeanor and Probation Services now being provided through Court Administration and in
consultation with the Court Administrator and in consideration that it is not legally necessary to have
a representative from misdemeanor probation, the position of"Representative from Misdemeanor
Probation/Correctional Services is being removed from the SAPAB membership.
The SAPAB was established May 9, 1990 to address substance abuse problems, identify additional
resources needed to address these problems, develop a prevention strategy and coordinate drug
control efforts. The SAPAB currently reviews applications for funding as provided through the
Edward Byrne Memorial Justice Assistance Grant(JAG)Program and Clerk's Drug Abuse Trust
Fund. The SAPAB membership, in order to serve as the primary body for coordinating drug abuse
efforts undertaken with funds provided by JAG, must be in accordance with 11D-9.005, Florida
Administrative Code (F.A.C).
The Monroe County BOCC at it August 17th 2016 (Agenda Item# C.19) meeting designated the
SAPAB to also serve as the County's Planning Council as it is necessary for the Florida Department
of Children and Families, Office of Criminal Justice, Mental Health and Substance Abuse
(CJMHSA) Reinvestment Grant program and authorized the expansion of the current SAPAB
membership to meet the requirements of F.S. 394.657 for Planning Council activities. The
CJMHSA Planning Council met quarterly, August 22, 2016 through December 31, 2019, to review

the progress of the grant and offer recommendations. The CJMHSA Reinvestment Grant Expired
December 31, 2019.
The SAPAB membership is based upon members who serve by reason of their job
position/title and shall continue to serve unit they are no longer in that position or until termination
of the SAPAB.

8/17/2016(Agenda Item # C.19): Approval for the Substance Abuse Policy Advisory Board
(SAPAB) to also serve as the Planning Council and approval to add to the membership of the
SAPAB in order to meet the statutory requirements of F.S. 394.657. The Florida Department of
Children and Families Office of Substance Abuse and Mental Health has modified the Criminal
Justice, Mental Health and Substance Abuse (CJMHSA) Reinvestment Grant(Program)to allow for
not-for-profit community providers designated by the County's Planning Council to apply for a
Planning, Implementation or Expansion Grant. The Guidance Care Center(GCC), as a not-for-profit
community provider, has approached County staff in order to be designated to apply for grant
funding under this Program.

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA that:
A. Resolution 284-2016,which sets forth the membership is hereby rescinded and replaced
with this resolution.
B. The SAPAB shall be designated as the County Planning Council as set forth in F.S. 394.657
when it is necessary to meet for the CJMHSA grant programs and include additional
members as set forth below.
C. The SAPAB membership is based upon members who serve by reason of theirjob
position/title and shall continue to serve until they are no longer in that position or until
termination of the SAPAB or Planning Council;

11D-9.001 Definitions.
As used in these rules, except where the context clearly indicates a different meaning, the following terms shall have the meanin;
indicated:
(1)"Act"means the Omnibus Crime Control and Safe Streets Act of 1968,34 U.S.C.3701,et. seq.,as amended.
(2)`BJA"means the Bureau of Justice Assistance,Office of Justice Programs,U.S.Department of Justice.
(3)"JAG"means the Edward Byrne Memorial Justice Assistance Grant Program.
(4)"JAG-Countywide"means the 60%funding stream formerly known as the Byrne Program.
(5)"JAG-Direcf'means the 40%funding stream formerly known as the Local Law Enforcement Block Grant Program.
(6) "Criminal Justice System" means agencies established by state and local units of government to apprehend, prosecute, an( a.
adjudicate criminal offenders,including correctional agencies established to carry out the sentence imposed upon criminal offenders. y
(7)"Department''means the Florida Department of Law Enforcement.
(8) "Eligible Application" is an application for Act funds, which meets the requirements of rules llD-9.001, 11D-9.002, I D-9.w E
and llD-9.006,F.A.C.
(9)"Local Applicant"means any governing body of a city or county,however styled,including that of a consolidated or metropolitai
government and including an Indian Tribe which performs law enforcement functions as determined by the Secretary of the Interior. CL
(10)"OCJG"means the Office of Criminal Justice Grants,Business Support Programs,Florida Department of Law Enforcement.
(11) "State Applicant"means any unit of the executive,legislative or judicial branches of state government which performs function N
related to the purposes of the Act. W
(12) "Statewide Strategic Plan" means a comprehensive plan developed in consultation with key stakeholders, as identified in thi to
Omnibus Crime Control and Safe Streets Act, Section 502 (6)(a),detailing how grants adminstered under the JAG-Countywide and JAG R
Direct Programs will be used to improve the criminal justice system.
(13)"Substance Abuse and Violent Crime Identification Matrix" means a set of statistical factors and values used by the Departmen
to ascertain the degree of the drug problem or violent crime within any particular county relative to any other particular county. j

11D-9.002 Funds Availability.
(1)JAG-Countywide. The amount of funds available shall be that amount allocated each federal fiscal year to the State of Florida b,
the federal government under the Act and appropriated by the legislature.
(2)The Department shall attempt to obligate all of the funds available in the current federal fiscal year,but may obligate part or all o
the funds in a later federal fiscal year,when permitted by Federal law and applicable Florida Statutes.
(3) The Department shall establish a Substance Abuse and Violent Crime Identification Matrix, comprised of population and crimp
data, which shall be used, to determine the amount of funds allocated to each county in accordance with paragraph llD-9.002(4)(c)
F.A.C., of this subsection. Through analysis of statewide databases,the Department shall determine the rate, trend and magnitude of thi
following group indices and their identified variables for the most recent five years of available data in each of Florida's counties:
(a)Violent Crime Index.
1.Number of Burglary Offenses.
2.Number of Larceny Offenses.
3.Number of Robbery Offenses.
4.Number of Murder Offenses.
(b)Juvenile Involvement in Drugs Index.
1.Number of juveniles arrested for sale and possession of marijuana.
2.Number of juveniles arrested for sale and possession of cocaine.

3.Drug Arrest Index.Number of arrests for sale and possession of any drug.
(c)Cocaine Factor Index.Number of arrests for sale and possession of cocaine.
(4) Based on the rate, trend and magnitude of these indices in each county relative to every other county, the Department shal
generate a listing of the counties. Such listing shall be generated every two years.
(5)Each county shall be allocated a percentage of local share federal funds equal to one-half of the sum of that county's percentage
of statewide need as determined by the Substance Abuse and Violent Crime Identification Matrix plus that county's percentage of th
total state population.
(6) JAG-Direct. BJA determines eligibility of JAG-Direct funds. Distribution of JAG-Direct funds will be determined by using th
latest available UCR data and distributed to local units of government.

11D-9.005 Application and Award Procedures.
(1) Statewide Strategic Plan. The Department shall develop a Statewide plan to determine how grants received under the Edwarc W
Byrne Memorial Justice Assistance Grant Program will be used to improve the administration of the criminal justice system. The plat 2
shall:
(a)Be designed in consultation with local governments and representatives of all segments of the criminal justice systems as outlines CL
in the Act, Section 502(6)(A); U)
(b)Include a description of how the State will allocate funding within the JAG program areas identified in the Act, Section 501(a)(1)
(c) Describe the process used by State for gathering evidenced-based data and the use of such data in support of funding decisionsLO
W
and
(d)Be updated every 5 years.
(2)JAG-Countywide Notification Process for State Applicants.
(a)The Department shall notify in writing state agencies that are appropriated a portion of the JAG-Countywide funds as determines
by the Florida Legislature. Such notice shall identify the funding available, the purposes for which these funds may be used and the
procedures required for receipt of such funds.
(b) State agencies so notified shall be obligated the appropriated funds upon receipt of an application for such funds from the affectei
agency.
(c) Applicants who submit proposals to the Department for consideration shall submit a completed application package via th
Department's electronic grants management system.
(3)JAG-Countywide Notification Process for Local Applicants.
(a) The Department shall send notice of the funding cycle to the Chairman for the Board of County Commissioners in each county
The Department shall also provide a courtesy copy of said notice to the Chief Elected Official of the governing body of each city locate(
in each county so notified.
(b)The Chairman for the Board of County Commissioners in each county so notified shall return to the Department within 30 days o
receiving the funding notification, a statement of participation indicating the county's willingness to serve as the coordinating unit o
government for at least 51%percent of the units of government which also represent at least 51%percent of the population located in sail
county.In the event the county declines to serve as the coordinating unit of government,the Department shall request the governing bod,
of each municipality,in descending order of population,to serve as the coordinating unit of government.
(c) The county shall designate a county coordinator to serve as the primary point-of-contact for JAG-Countywide local applicatiol
planning and coordination. The county coordinator shall be responsible for: coordinating the 51% process, coordinating the county'
application submission, providing application instructions to approved agencies, and overseeing all applications within the county tc
ensure timely submission.
(d) Units of government receiving JAG Countywide funds must reach a written consensus on the use of those funds. This writeei
consensus shall be documented through submission of 51%letters which must:
1.Represent at least 51%of the units of government in the county;

2.Represent at least 5 1%of the population of the county;
3.Be signed by the chief official for the unit of government;
4.Identify each recipient,the amount,and the purpose for use of the funds; and
5. Include the total amount of the county's JAG Countywide allocation.
(4)JAG-Countywide Local Application Process.
(a) Each applicant is encouraged to appoint an Advisory Board,the membership of which shall include at a minimum the following
persons or their authorized designee: Chief Circuit Judge, State Attorney,Public Defender, Sheriff, Chief of Police of each municipalih
within the county or a Chief of Police designated by those Chiefs of Police as their representative, Jail Administrator, Clerk of the Court
Superintendent of Education and a representative of local drug treatment programs. An existing Board or Council whose membershi]
includes the listed representatives may be utilized in lieu of appointing a new Board or Council. The Advisory Board shall serve as thi
primary body for identifying priority areas for funding to improve criminal justice within the local jurisdiction.
(b) Applicants who submit proposals to the Department for consideration shall submit a completed application package which i
filled out via the Department's electronic grant management system.
(c) The Department shall review all applications for JAG-Countywide funds and shall reject any application not meeting th
requirements of these rules and applicable federal and state laws.
(5)JAG-Direct Notification Process for Local Applicants.To initiate a funding cycle,the Department shall send notice of the fundin;
cycle to the Chief Elected Official of the governing body of each unit of government identified by BJA as eligible to receive JAG-Direc
funds.
(6)JAG-Direct Local Application Process.
(a) Applicants who submit proposals to the Department for consideration shall submit a completed application package which i
filled out via the Department's electronic grant management system.
(b)The Department shall review all applications for Act funds and shall reject any application not meeting the requirements of these

ITEM BACKGROUND: The SAPAB was established May 9, 1990 to address substance abuse CD

problems, identify additional resources needed to address these problems, develop a prevention
strategy and coordinate drug control efforts. The SAPAB currently reviews applications for funding Ci
as provided through the Edward Byrne Memorial Justice Assistance Grant(JAG)Program and E
Clerk's Drug Abuse Trust Fund. The SAPAB membership, in order to serve as the primary body for
coordinating drug abuse efforts undertaken with funds provided by JAG, must be in accordance withCD
11D-9.005, Florida Administrative Code (F.A.C). The Monroe County Board of County
Commissioners at it August 17th 2016 meeting designated the SAPAB to also serve as the County's C14
Planning Council as it is necessary for the Florida Department of Children and Families, Office of
Criminal Justice, Mental Health and Substance Abuse (CJMHSA) Reinvestment Grant(Program)
and authorized the expansion of the current SAPAB membership to meet the requirements of F.S.
394.657 for Planning Council activities. `
The SAPAB met on August 22, 2016 to address matters relating to the Florida Department of Law
Enforcement(FDLE) Edward Byrne Justice Assistance Grant(JAG)program and the Clerk's Drug E
Abuse Trust Fund(CDATF)program and also met as the County Planning Council in order to meet
the Criminal Justice, Mental Health and Substance Abuse (CJMHSA)program requirements. This
resolution retroactively approves the membership of the SAPAB. The SAPAB membership is based
upon members who serve by reason of their job position/title and shall continue to serve unit they
are no longer in that position or until termination of the SAPAB or Planning Council.
PREVIOUS RELEVANT BOCC ACTION: On August 17, 2016 (Agenda Item Summary 41954,
C.19)the BOCC approved for the Substance Abuse Policy Advisory Board(SAPAB)to also serve
as the Planning Council and approved to adding to the membership of the SAPAB in order to meet
the statutory requirements of F.S. 394.657 and to meet the requirements defined by the Florida
Department of Children and Families, Office of Criminal Justice, Mental Health and Substance

Justice, Mental Health and Substance Abuse (CJMHSA) Reinvestment Grant(Program) to allow for
not-for-profit community providers designated by the County's Planning Council to apply for a
Planning, Implementation or Expansion Grant. The Guidance Care Center(GCC), as a not-for-profit
community provider, has approached County staff in order to be designated to apply for grant
funding under this Program. U

ITEM BACKGROUND: The County previously applied for this CJMHSA Grant and created and
established a planning board, but the Planning Council was subsequently abolished when the grant
ended. The CJMHSA Program requires the County's Planning Council to submit a certified letter
designating the not-for-profit community provider to apply for the Request for Application (RFA). o
The SAPAB is set to meet on August 22nd, and if this item is approved, Staff will add to the
membership so that the SAPAB will meet the planning council statutory membership requirements
as set forth in F.S. 394.657. The CJMHSA Program requires a match, which GCC has agreed to
provide. The SAPAB, as membership is modified, will be responsible for participation and
involvement in the program implementation for implementation and expansion grants, which may
require meetings to be held on a regular basis. Applications are due on September 21, 2016. The
CJMHSA program RFA is attached, the membership requirements for the Planning Council are <
included in Appendix K.
PREVIOUS RELEVANT BOCC ACTION: In August 15, 2007 the BOCC approved the
submission of an CJMHSA Reinvestment Grant application to the Florida Department of Children
and Families (DCF) for a one-year Planning Grant and were subsequently awarded the grant. In
2010 Monroe County again applied for and on November 3, 2010 was awarded a CJMHSA
Reinvestment Grant, a three-year grant, administered by the Monroe County Sheriffs Office.
