WHEREAS, the parties entered into an Agreement for the FL Keys Marathon Airport Non- Aeronautical Use Building (EOC) Project ("Agreement") to perform all work ("Work") in connection with the management during the pre-construction phase of the FL Keys Marathon Airport Non-Aeronautical Use Building("Project"),located in Monroe County,Florida;and WHEREAS, it has been determined that Payment and Performance bonds and Builder's Risk Insurance are not required at the pre-construction stage;and WHEREAS, the County desires to amend the Contractor's agreement to remove this requirement retroactive to the effective date of the Agreement,April 15,2020. NOW THEREFORE, in consideration of the mutual promises contained herein, the parties hereby agree as follows: I. Within Section 00750, General Conditions of Contract, the following Articles and paragraphs are amended as follows: a. Paragraph 2.2.7,part of paragraph 2.2,The Information and Services Required of the Owner, is amended to read as follows: "2.2.7 The foregoing are in addition to other duties and responsibilities of the Owner enumerated herein and especially those in respect to Ankle 6 (Construction by Owner or by Other Construction Managers),Article 9(Payments and Completion)and Article 11 (Insurance)." b. Within paragraph 5.4.1,Contingent Assignment of Subcontracts,section 5.4.1.2 is removed in its entirety. c. Within paragraph 9.3 Applications for Payment, the final sentence within paragraph 9.3.3 is amended to read as follows: "Such persons must seek payment from the Construction Manager." d. Paragraph 9.10.2(7)C, Final Completion and Final Payment, is amended to read as follows: "Warranties and guarantees." e. The second sentence of paragraph 9.11.1, part of Payment of Subcontractors, is amended to read as follows: "Unpaid subcontractors and materialmen may only seek payment from the Construction Manager" 1 f. Article 11.0, Insurance and Bonds, is amended as follows: i. The heading of Article 11.0 is revised to read: "Insurance" rather than "Insurance and Bonds." ii. Paragraphs 11.2 (Builder's Risk Insurance), 11.3 (Public Construction Bond) and 11.3.1 (stating that the Public Construction Bond must be issued by an A Rated Surety Company)are removed in their entirety. 2. All of the above changes are made retroactive to April 15. 2020. 3. All other terms and conditions of the Agreement remain unchanged and in full force and effect.
