AGENDA ITEM WORDING: A Public Hearing for citizens and municipalities to provide input
on an application for non-matching grant funds to repair the Tavernier Breakwater in the amount of
$2 Million utilizing Community Development Block Grant- Disaster Recovery Infrastructure Repair
Program funding from the Florida Department of Economic Opportunity (DEO) funded through the
Federal Housing and Urban Development Agency (HUD), after a duly noticed 10 day public
comment period; after a 10 day public notice and Approval to submit grant application to DEO.
ITEM BACKGROUND:
Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys on September 10, 2017,
causing the destruction and significant flooding of low-lying areas throughout the Florida Keys.
Congress appropriated $616 Million for the State of Florida in the aftermath of Hurricane Irma. The
Department of Economic Opportunity (DEO) developed a Community Development Block Grant -
Disaster Recovery (CDBG-DR) Action Plan and allocated $85 Million for the Infrastructure Repair
and Mitigation Program. In the second round of funding, DEO allocated an additional
$147,411,853 for the program. In this second round of funding, Monroe County will seek funding
to repair the Tavernier Breakwater at a cost of$1,600,000. This project will provide and install 2.5'-
4' boulders across a 1,500 jetty span which was damaged by Hurricane Irma. The breakwater is
designed to protect the low lying, low income subdivision that is subject to frequent and persistent
flooding due to storms, tides, and sea level rise. The inflow of vegetative debris due to the lack of the
protective barrier has degraded water quality within the residential canal system.

The State of Florida has, mafde significant investments in miti atio,n over the past 25 years to ensure that
infrastructure is able to with, stand the impacts of mind and flood events. Hurricane Irma was a success
story for the state in that infrastructure damage assessments were not as high as initially projected due
to this major statewide investment. DEO will continueto strengthen the state's infrastructure by creating
an Infrastructure Repair and Mitigation Program that allows communities to use CDB -CAR to leverage
other funding sources such as,the Lazard (litigation Grant Program (H ,GP), 406 Public Assistance (40
PA) Mitigation Program,, Somme corrnmunities are not able to fully utilize thiese other resources following a
disaster because reserve cash funds are exhausted by disaster recovery efforts and they cannot meet local
match requirements. allowing local' governments to leverage CDB - R funding as match will enable
communities, especially smaller and rural local governments, to better utilize all resources available to
there.
In the development of policies and procedures, cost benefit will be addressed, DEC acknowledges
infrastructure activities may have unintended risks that could potentially effect communities. With this
understanding, l EO will follow guidance provided in the Federal Register to avoid disproportionate
impacts on vulnerable populations and environmental injustice.. Additionally, DEC recognizes the
importance of'resiliency against future storms and will em ploy adaptable and reliable technologies to
guard against premature obsolescence of infrastructure, iID,EO will describe the iimplem, entation of

Dear Mrs. Herron,
It is with great pleasure that Monroe County is submitting this application for funding for the Community >
Development Block Grant Program-Disaster Recovery, Rebuild Florida: Infrastructure Repair and I
Mitigation Program.Monroe County is requesting$2,000,000 to repair the Tavernier Breakwater Structure
that protects 48 homes in a Low to Moderate Income (LMI) area. 0.
e(
The Breakwater Structure is located in the Tavernier area of Key Largo, long known as a working class W
neighborhood where teachers, first responders, and other service industry workers reside. This area CD
"'
experienced some of the highest and most aggressive storm surges during Hurricane Irma, destroying many
CD
homes and causing significant flood and wind damage to others. During Hurricane Irma, the storm surge t I
toppled the boulders over the breakwater, which prior to the storm was providing a significant level of
resiliency and storm surge protection to the homes. With the breakwater structure now severely damaged, et
this low-lying subdivision is subject to frequent and persistent flooding due to storms, astronomical high o,
tides, and sea level rise. Their homes are threatened now with storm surge and high waves that will come
crashing through their living rooms in a storm event and potentially causing complete loss of their homes. >
In addition, the breakwater provided a barrier to the heavy loading of floating seaweed coming in from the
ocean during the extreme heat of the summer that now clogs their canals, causing severe water quality
problems, respiratory and health issues and environmental disaster. Repairing the breakwater would help
maintain better water quality in the canal systems near the breakwater, helping residents avoid respiratory
distress and other health problems.
0
The Rebuild Florida programs are offering an array of community solutions to rebuild a stronger, safer,
and more resilient Florida Keys. As an "Area of Critical State Concern" and a rural county, this priority 2
coastal hardening project strongly emphasizes the grant's purpose to preserve low-income housing while C
mitigating against future damage to make the community more resilient. We encourage you to give this
project favorable consideration for funding. 04

This project will repair 1500 linear feet of damage to a manmade coastal breakwater structure that was damaged from Hurricane Irma that previously provided
protection from storm surge. The project also proposes the installation of a weed gate to control the inflow of noxious floating seaweed into the waterways. dp
This project is designed to protect the low lying, low income subdivision from storm surge that is subject to frequent and persistent flooding due to storms,
tides, and sea level rise.To determine the service area, the engineering consultant reviewed the basic geography of the area and determined the likely flow of i-
flood waters into the area protected by the breakwater.A functional breakwater will also help protect the health of the residents by helping to maintain the Cl)
water quality by reducing the generation of noxious gases from decaying seaweed that currently enters over the breakwater structure. M

This neighborhood is located within a cesus track of 63% LMI population. Of the 48 total
estimated units it can, therefore, be assumed that 30 units may be LMI.
5 Infrastructure Improvements, provide a brief description of how proposed improvements primarily serves housing serving Low-
and Moderate-Income populations as specified in CDBG-DR Action Plan.
This project would restore the breakwater structure protecting the residential neighborhood that currently is located within a 63%LMI census track. It
would alleviate wave action which can inundate residential roads and vulnerable structures causing saltwater inundation impacts to this C^
neighborhood. The proposed project area is partially located within the within the VE 13,VE 12,VE 11,and AE 10 FIRM Flood Hazard Areas. This
project seeks engineering solutions to keep the neighborhood viable for long-term residential populations by protecting the shoreline from erosion @,
due to wave action and storm surge. The breakwater repair will improve navigability of the canals and waterways. The weed gate will prevent CD
vegetation from entering the residential canal system. This vegetation pollutes the water and causes long-term water quality degradation. Without O
these improvements the long term viability of this neighborhood is questionable(especially when storms threaten). i.

program and project management capacity.
The Monroe County has fully formed management teams that routinely manage large, complex construction projects.Upon approval by
the Board of County Commissioners and grant agreement execution,Monroe County will employ its standard procurement process to
solicit for construction vendor services in compliance with all federal procurement requirements. Such procurement process is highly
efficient and can be accomplished in 120 days from date of issuance of solicitation to contract execution. _
The County's engineering consultants are already in place under on-call contracts specifically for these type of services. E
Once the contracts for the contractors have been executed, the county will ensure a single point of contact for each vendor from the O
project management team. The Project Manager will ensure ongoing coordination throughout the design and construction phases by
requiring monthly progress reports and webinars that report progress on key milestones, provide invoices with proper documentation of

V. STORM DISASTER RESILIENCE
B
1 Describe how the proposed CDBG DR-funded program and/or project will pro-actively invest in resilience to damage from future storms as
specified in the Federal Register and Action Plan.
i,
Cl)
Monroe County,Florida is the southern most county in the continental United States, and is largely comprised of an island archipelago >
extending 112 miles from Key Largo south, and then west,to Key West. Since much of this island chain is at or near sea level, many of the
ground level residential homes experience storm surge during storm events, damaging many of them beyond repair, causing loss of
affordable housing for lower income families. The flooding occurs during tropical storms and hurricanes with a combination of onshore
winds, ground swell, and abnormally high tides that inundate coastal neighborhoods, removing shelter for local residents until repairs can
be made or replacement homes built. U
c
The breakwater structure built along the shoreline decades ago provided much needed protection from storm surge and high winds,
protecting the homes from catastrophic damage. However,Hurricane Irma was too much for the structure to bear and many of the U
boulders on the top toppled into the sea.The damaged structure now provides far less protection from storm surge, and also allows Cl)
O
floating vegetation into the waterways, contributing to noxious fumes and poor water quality.Repairs to the breakwater structure will
once again help provide protection from storm surge and high winds as it increases the resiliency of the neighborhood.

This effort is motivated by two significant events. The first was the release of the County's Green Keys!Sustainability Action Plan N
"GreenKe s!Plan" in 2016 which made recommendations concerning infrastructure resilience planning. The second was the Hurricane

Units of General Local Government (UGLG) including counties and municipalities located in
the designated areas that experienced Hurricane Irma storm damage are eligible to apply CL
for funding based on the terms and conditions in this application. Applicants must provide a
detailed description of damage caused by Hurricane Irma. Applications should include plans
to mitigate against future damage and show how the proposed project will make the
community more resilient in the future. Projects requesting funds for damage caused by
deferred maintenance will not be considered.
2
DEO encourages all prospective applicants to read the Irma Community Development Block
Grant—Disaster Recovery(CDBG-DR) State Action Plan located at:
http://www.floridaiobs.orgZcommunity-planning-and-development/assistance-for-
governments-and-organizations/disaster-recovery-initiative.
CDBG-DR funding for this application covers Florida's infrastructure efforts for Hurricane Irma
(September 2017, Presidential Disaster Declaration 4337).
0
II. BACKGROUND
CL
Following a major disaster, Congress can appropriate funds through the CDBG-DR program to
satisfy a portion of unmet need that remains after other federal assistance such as the Federal
Emergency Management Agency(FEMA), Small Business Administration (SBA) or private
insurance have been allocated. DEO is the lead agency and responsible entity for administering
the CDBG-DR funds allocated to the state.
m
HUD uses the best available data to identify and calculate unmet needs for disaster relief, long-
term recovery, restoration of infrastructure and housing and economic revitalization. Based on
this assessment, HUD announced that the State of Florida would receive an allocation of
$615,922,000 in disaster recovery funds to assist in recovery from the hurricane, on April 10,
2018, HUD notified the state of Florida that it will receive an additional allocation of
$791,000,000. Furthermore, the state of Florida received an additional $38,637,745 to assist ._
meeting the unmet infrastructure needs on January 27, 2020.
To ensure the funds assist the most impacted areas as outlined in the Federal Register, 80 `V
r9
percent of funding awarded to the state will go to the HUD-identified Most Impacted and
Distressed (MID) counties and zip codes. o
m
III. GENERAL INFORMATION
The availability of the funding was formally announced by publication in the Federal Register,
Volume 83, Number 28, Volume 83, Number 157,Volume 85, Number 17 on February 9,August y
14, 2018 and January 27, 2020 respectively. The Federal Register may be accessed online at:
http://www.floridaiobs.org/community-planning-and-development/assistance-for-
governments-and-organizations/disaster-recovery-initiative .
Federal requirements clearly state that funds may be used only for disaster relief and long-
term recovery in communities affected by the specified disaster. Requirements provide that
Packet Pg. 2871
N.3.b
Rebuild Florida Infrastructure Repair Program Application Guide Page 5
March 2020
funds be directed to areas with the greatest need. All CDBG-DR funded eligible activities
must tie to storm damage as specified in and not prior to the Presidential Disaster
Declaration 4377 for Irma on September 10, 2017 (https://www.fema.gov/disaster/4337).
CL
All projects must be directly related to Hurricane Irma. CDBG-DR funds cannot be used to
replace or reimburse any available funding, such as FEMA Individual and Public Assistance
(IA/PA). However, in certain situations, CDBG-DR funds can serve as an eligible match.
IV. HUD CDBG-DR PROGRAM AND PROJECT FUNDING DIRECTIVES
In response to HUD directives, the action plan directs DEO to fund projects and programs
that:
1. Provide the maximum feasible priority to activities that will benefit low-and moderate-
income families.
The aggregate use of the CDBG-DR funds made available under this application shall
principally benefit low-and moderate-income families in a manner that ensures that at least
70 percent of the grant amount is expended for activities that benefit such persons.
2. Focus first on unmet housing needs. CL
Federal Register Volume 83, Number 28 dated February 9, 2018 states:
"Grantees must propose an allocation of CDBG—DR funds that primarily considers
and addresses unmet housing needs. A Grantee may also allocate funds to address
unmet economic revitalization and infrastructure needs, but in doing so, the
grantee must identify how unmet housing needs will be addressed or how its
economic revitalization or infrastructure activities will contribute to the long-
term recovery and restoration of housing in the most impacted and distressed
areas."
0
3. Projects or programs must address a clear unmet need:
• Tied to Hurricane Irma,
• Primarily serving low-to-moderate income (LMI) populations, and
cv
• Primarily serving housing activities.
0
0
V. THRESHOLD AND SCORING CRITERIA
DEO will apply a two-phased process to review applications.
First, proposals must first pass HUD CDBG-DR Threshold Compliance Criteria.
2
Second, DEO will review and score each proposal based on Scoring Criteria.
If a proposal does not meet any of the Threshold Criteria, DEO cannot proceed to score it
for funding consideration.
The maximum score for Scoring Criteria is 115points.
m
A. CDBG-DR Threshold Compliance Criteria
1. Projects must meet a CDBG-DR National Objective such as:
Packet Pg. 2872
N.3.b

Overview.pdf .
3. Projects or programs must address a clear unmet need:
• Tied to Hurricane Irma, c,
• Primarily serving LMI populations, and
• Primarily serving housing activities.
0
B. Scoring Criteria CL
Once a proposal is determined to satisfy CDBG-DR's Threshold Compliance Criteria,
then DEO will apply scoring based on the following Scoring Criteria. The maximum
Scoring Criteria score is 105.
Scoring will focus on the following categories:
• Overall LMI benefit(Percent LMI benefit of the activity)
• Project readiness
• Management Capacity
• Local Participation
• Project Nature
• Special Designation
cv
• Project Impact o
0
m
A chart on the next page further defines each category and lists the maximum point ,
allocation for each scoring category. In the event of a scoring tie, projects that have a
higher LMI or are located within HUD designated MID areas will be considered first.

Proposals for funding may only serve eligible counties and zip codes.
CL
DEO encourages eligible applicants to assemble teams that provide the necessary capacity to
successfully administer the proposed CDBG-DR projects and programs. Some team options to
consider are:
A. Leveraging the capacity of nonprofit and for-profit organizations who will serve as
contractors to the subrecipient;
2
B. Sharing resources whereby a group of UGLGs apply as a region. For example:to achieve
greater impact and efficiency, a group of UGLGs may apply as a region to manage a project
with a regional impact. For regional applications, DEO requires that there be one lead
designated applicant who will contractually serve as the subrecipient and be responsible for
the management of the grant. The subrecipient acting as the lead cannot sub-grant funds to
other local governments. c,
C. C. Eligible applicants can submit multiple project applications for a minimum of$500,000
per project.
If allocated funds by DEO, all UGLG partners must sign an Interlocal Agreement prior to
