AGENDA ITEM WORDING: A Public Hearing for citizens and municipalities to provide input
on an application for non-matching grant funds to repair the Rock Harbor Jetty in Key Largo in the
amount of $1,200,000 utilizing Community Development Block Grant - Disaster Recovery
Infrastructure Repair Program funding from the Florida Department of Economic Opportunity
(DEO) funded through the Federal Housing and Urban Development Agency (HUD), after a duly
noticed 10 day public comment period; after a 10 day public notice and Approval to submit grant
application to DEO.
ITEM BACKGROUND:
Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys on September 10, 2017,
causing the destruction and significant flooding of low-lying areas throughout the Florida Keys.
Congress appropriated $616 Million for the State of Florida in the aftermath of Hurricane Irma. The
Department of Economic Opportunity (DEO) developed a Community Development Block Grant -
Disaster Recovery (CDBG-DR) Action Plan and allocated $85 Million for the Infrastructure Repair
and Mitigation Program. In the second round of funding, DEO allocated an additional
$147,411,853 for the program. In this second round of funding, Monroe County will seek funding
to repair the Rock Harbor Jetty in Key Largo. This project will repair 500 linear feet of jetty span
and a weed gate damaged from Hurricane Irma and is designed to protect the low lying, low income
subdivision that is subject to frequent and persistent flooding due to storms, tides, and sea level rise.
The inflow of vegetative debris due to the lack of the protective barrier has degraded water quality
within the residential canal system.

The State of Florida has, mafde significant investments in miti atio,n over the past 25 years to ensure that
infrastructure is able to with,stand the impacts of mind and flood events. Hurricane Irma was a success
story for the state in that infrastructure damage assessments were not as high as initially projected due
to this major statewide investment. DEO will continueto strengthen the state's infrastructure by creating
an Infrastructure Repair and Mitigation Program that allows communities to use CDB -CAR to leverage
other funding sources such as,the Lazard (litigation Grant Program (H ,GP), 406 Public Assistance ( 0
PA) Mitigation Program,, Somme corrnmunities are not able to fully utilize thiese other resources following a
disaster because reserve cash funds are exhausted by disaster recovery efforts and they cannot meet local
match requirements. allowing local' governments to leverage CDB - R funding as match will enable
communities, especially smaller and rural local governments, to better utilize all resources available to
there.
In the development of policies and procedures, cost benefit will be addressed, DEC acknowledges
infrastructure activities may have unintended risks that could potentially effect communities.With this
understanding, l EO will follow guidance provided in the Federal Register to avoid disproportionate
impacts on vulnerable populations and environmental injustice.. Additionally, DEC recognizes the
importance of'resiliency against future storms and will em ploy adaptable and reliable technologies to
guard against premature obsolescence of infrastructure, iID,EO will describe the iimplem,entation of
DECwill first consider EMI as the national objective for infrastructure projects, The urgent need national
objective will only be used if the project is not ILPv11,but is needed to alleviate emergency conditions.When

To be eligible to receive funds, Monroe County must consider the needs of all municipalities within
the incorporated as well as unincorporated area of the county. This meeting serves as a public
meeting to hear public comment. The County has met the CDBG-DR and DEO requirements for
notice and documentation. As per the grant requirements, public notice of this public meeting and
public notice of the 10-day public comment period was published in the Citizen, as the newspaper
of general circulation in Monroe County and also posted to the County's website. The notices are
attached for reference. Deadline for Comments is June 10, 2020.

It is with great pleasure that Monroe County is submitting this application for funding for the Community N
Development Block Grant Program-Disaster Recovery, Rebuild Florida: Infrastructure Repair and
Mitigation Program. Monroe County is requesting $1,200,000 to repair the Rock Harbor Breakwater to
Structure that protects 89 homes in an LMI area.

The Breakwater Structure is located in the Rock Harbor area of Key Largo, long known as a working class
neighborhood where retires on fixed income and industry workers reside. This area experienced high storm
surges during Hurricane Irma, destroying many homes and causing significant flood and wind damage to
others. During Hurricane Irma, the storm surge toppled the boulders over the breakwater, which prior to
the storm was providing a significant level of resiliency and storm surge protection to the homes. With the
breakwater structure now severely damaged,this low-lying subdivision is subject to frequent and persistent
flooding due to storms, astronomical high tides, and sea level rise. Their homes are threatened now with s
storm surge and high waves that will come crashing through their living rooms in a storm event and U
potentially causing complete loss of their homes.
In addition,the breakwater provided a barrier to the heavy loading of floating seaweed coming in from the
ocean during the extreme heat of the summer that now clogs their canals, causing severe water quality
problems, respiratory and health issues and environmental disaster. Repairing the breakwater would help
maintain better water quality in the canal systems near the breakwater, helping residents avoid respiratory
distress and other health problems.

The Rebuild Florida programs are offering an array of community solutions to rebuild a stronger, safer, W
and more resilient Florida Keys. As an "Area of Critical State Concern" and a rural county, this priority C
coastal hardening project strongly emphasizes the grant's purpose to preserve low-income housing while 0

V. STORM DISASTER RESILIENCE

Monroe County,Florida is the southern most county in the continental United States,and is largely comprised of an island archipelago 0
extending some 112 miles from Key Largo south,and then west,to Key West. Since much of this island chain is at or near sea level,many m
of the ground level residential homes experience storm surge during storm events,damaging many of them beyond repair,causing loss of

affordable housing for lower income families. The flooding occurs during tropical storms and hurricanes with a combination of onshore O

winds,ground swell,and abnormally high tides that inundate coastal neighborhoods,removing shelter for local residents until repairs can X
be made or replacment homes built. X

The breakwater structure built along the shoreline decades ago provided much needed protection from storm surge and high winds,
protecting the homes from catastrophic damage. However,Hurricane Irma was too much for the structure to bear and many of the U
boulders on the top toppled into the sea.The damaged structure now provides far less protection from storm surge,and also allows w

floating vegetation into the waterways,contributing to noxious fumes and poor water quality.Repairs to the breakwater structure will
once again help provide protection from storm surge and high winds as it increases the resiliency of the neighborhood. (y

I. INTRODUCTION
The Florida Department of Economic Opportunity (DEO)has allocated an additional
$100,229,945 in Infrastructure repair funding through the Community Development Block CL
Grant-Disaster Recovery (CDBG-DR) Program by the U.S. Department of Housing and Urban
Development (HUD)to address unmet disaster recovery needs related to damage from
Hurricane Irma. Eligible applicants in the following counties and zip codes may apply for
funding based on the terms and conditions in this application:

Units of General Local Government (UGLG) including counties and municipalities located in o
the designated areas that experienced Hurricane Irma storm damage are eligible to apply CL
for funding based on the terms and conditions in this application. Applicants must provide a
detailed description of damage caused by Hurricane Irma. Applications should include plans
to mitigate against future damage and show how the proposed project will make the
community more resilient in the future. Projects requesting funds for damage caused by
deferred maintenance will not be considered.

CDBG-DR funding for this application covers Florida's infrastructure efforts for Hurricane Irma
(September 2017, Presidential Disaster Declaration 4337).

II. BACKGROUND
Following a major disaster, Congress can appropriate funds through the CDBG-DR program to
satisfy a portion of unmet need that remains after other federal assistance such as the Federal
Emergency Management Agency(FEMA), Small Business Administration (SBA) or private
insurance have been allocated. DEO is the lead agency and responsible entity for administering
the CDBG-DR funds allocated to the state.
HUD uses the best available data to identify and calculate unmet needs for disaster relief, long-
term recovery, restoration of infrastructure and housing and economic revitalization. Based on

this assessment, HUD announced that the State of Florida would receive an allocation of
$615,922,000 in disaster recovery funds to assist in recovery from the hurricane, on April 10,
2018, HUD notified the state of Florida that it will receive an additional allocation of
$791,000,000. Furthermore, the state of Florida received an additional $38,637,745 to assist
meeting the unmet infrastructure needs on January 27, 2020. W

To ensure the funds assist the most impacted areas as outlined in the Federal Register, 80 cv
percent of funding awarded to the state will go to the HUD-identified Most Impacted and
Distressed (MID) counties and zip codes.
III. GENERAL INFORMATION
The availability of the funding was formally announced by publication in the Federal Register,
Volume 83, Number 28, Volume 83, Number 157,Volume 85, Number 17 on February 9,August
14, 2018 and January 27, 2020 respectively.The Federal Register may be accessed online at:

Federal requirements clearly state that funds may be used only for disaster relief and long-
term recovery in communities affected by the specified disaster. Requirements provide that

funds be directed to areas with the greatest need. All CDBG-DR funded eligible activities .�
must tie to storm damage as specified in and not prior to the Presidential Disaster
Declaration 4377 for Irma on September 10, 2017 (https://www.fema.gov/disaster/4337).

All projects must be directly related to Hurricane Irma. CDBG-DR funds cannot be used to
replace or reimburse any available funding, such as FEMA Individual and Public Assistance
(IA/PA). However, in certain situations, CDBG-DR funds can serve as an eligible match.
IV. HUD CDBG-DR PROGRAM AND PROJECT FUNDING DIRECTIVES 2
In response to HUD directives, the action plan directs DEO to fund projects and programs
that:
1. Provide the maximum feasible priority to activities that will benefit low-and moderate-
income families.
The aggregate use of the CDBG-DR funds made available under this application shall
principally benefit low-and moderate-income families in a manner that ensures that at least
70 percent of the grant amount is expended for activities that benefit such persons. o
2. Focus first on unmet housing needs.
Federal Register Volume 83, Number 28 dated February 9, 2018 states:
"Grantees must propose an allocation of CDBG—DR funds that primarily considers
and addresses unmet housing needs. A Grantee may also allocate funds to address
unmet economic revitalization and infrastructure needs, but in doing so, the
grantee must identify how unmet housing needs will be addressed or how its
economic revitalization or infrastructure activities will contribute to the long-
term recovery and restoration of housing in the most impacted and distressed o

V. THRESHOLD AND SCORING CRITERIA
DEO will apply a two-phased process to review applications. ,
First, proposals must first pass HUD CDBG-DR Threshold Compliance Criteria.
Second, DEO will review and score each proposal based on Scoring Criteria. v,
If a proposal does not meet any of the Threshold Criteria, DEO cannot proceed to score it
for funding consideration.
The maximum score for Scoring Criteria is 115points.

contractors to the subrecipient;

B. Sharing resources whereby a group of UGLGs apply as a region. For example:to achieve
greater impact and efficiency, a group of UGLGs may apply as a region to manage a project
with a regional impact. For regional applications, DEO requires that there be one lead
designated applicant who will contractually serve as the subrecipient and be responsible for
the management of the grant.The subrecipient acting as the lead cannot sub-grant funds to
other local governments.

IX. ELIGIBLE ACTIVITIES
To be eligible for consideration of funding, UGLGs must propose programs or
projects that align with CDBG-DR and DEO requirements and priorities as outlined in

• Restoration of infrastructure damaged by Hurricane Irma (including water and sewer o
facilities, streets, provision of generators, removal of debris, drainage, bridges, etc.); CL
• Water and sewer facilities have been identified as areas of critical importance. Projects
involving these type facilities will be eligible for ten (10) points during the scoring
process.
• Repair to public facilities such as emergency community shelters;

• Demolition, rehabilitation of publicly or privately owned commercial or industrial
buildings;
• Economic revitalization which includes any CDBG-DR eligible activity that demonstrably
restores and improves some aspect of the local economy.
Subrecipients must identify how unmet housing needs will be addressed or how its
infrastructure activities will contribute to the long-term recovery and restoration of housing U

X. CDBG-DR COMPLIANCE
All UGLG applicants with proposals approved for CDBG-DR funds under this application
must execute a subrecipient agreement with DEO which will specify all terms and
conditions for successful program and/or project and compliance management of a grant.

C. Citizen Participation Requirements
All applicants must submit evidence of a publicly noticed meeting to discuss the proposed
project and application for the Rebuild Florida Infrastructure program. Counties eligible to
receive funds must consider the needs of all municipalities (and federally recognized tribes)
within the incorporated as well as unincorporated area of the county(and reservations
contiguous to the county).

Evidence of public meeting with city and tribal governments must meet the following .�

Prior to submitting an application for CDBG-DR funding, applicants are required to post a
public notice in a newspaper of general circulation and to their website that states the types
of projects to be undertaken, the source and amount of funding available for the activities,
the date by which comments must be made and a contact person for a copy of the proposed y
application. Applicants must provide for a 10-day comment period, which must be published
prior to the submission of the application.
Evidence of the public notice must meet the following requirements:
■ Documentation of newspaper advertisement.
■ Print-out of county webpage showing public notice.

■ Documentation that the needs of non-English speaking citizens have been met where a o
significant number of non-English speaking citizens can be reasonably expected to
participate. In this case, documentation will need to be translated into Spanish and

D. Use of CDBG-DR as Match

Additionally, funds may be used to meet a matching, share, or contribution requirement
for any other federal program when used to carry out an eligible CDBG-DR activity.This
includes programs or activities administered by the Federal Emergency Management
Agency(FEMA) or the U.S. Army Corps of Engineers (USACE). By law, the amount of o
CDBG-DR funds that may be contributed to a USACE project is $250,000 or less. Note
that the Appropriations Act prohibits supplanting the use of CDBG-DR funds for any

activity reimbursable by, or for which funds are also made available, by FEMA or USACE.
E. System of Record and Compliance Verifications `V

DEO will provide a CDBG-DR System of Record that will serve as the repository for all
program and project compliance documentation to satisfy monitoring and audit
requirements. In addition, the System of Record will enable DEO to review document
files and conduct Duplication of Benefits, Verification of Benefits and related -
verifications required to comply with CDBG-DR regulations.
Subrecipient awardees are required to assemble and review all compliance
documentation and upload them to the System of Record in an orderly manner. DEO y
will provide training to subrecipients on how to manage their CDBG-DR programs and
projects with the new system of record.
F. Cost Reasonable and Anti-Fraud,Waste and Abuse
DEO seeks to balance the HUD requirement that all projects meet the standard of cost
reasonable and avoid waste, fraud and abuse with providing sufficient funding to
