A RESOLUTION BY THE MONROE COUNTY BOARD OF COM-
MISSIONERS APPROVING AN EXEMPTION FROM THE
NONRESIDENTIAL PERMIT ALLOCATION SYSTEM PURSUANT
TO POLICY 101.3.4 OF THE YEAR 2010 COMPREHENSIVE
PLAN FOR ST. JUSTIN MARTYR CATHOLIC CHURCH TO
INCREASE THEIR PREVIOUSLY EXEMPTED EDUCATION
CENTER FROM 5 , 000 SQUARE FEET TO' 6, 500 SQUARE
FEET, AT 105500 OVERSEAS HIGHWAY, ON PROPERTY
DESCRIBED AS PART OF LOT 19 AND LOT 20, ISLAND
OF KEY LARGO, MONROE COUNTY, FLORIDA, MILE MARK-
ER 105.
WHEREAS, the Building, Planning and Environmental Re-
sources Departments have received a permit application filed
by St. Justin Martyr Catholic Church for the construction of a
6,500 square foot Education Center at 105500 Overseas Highway
on property described as part of lot 19 and Lot 20, Island of
Key Largo, Monroe County, Florida, Mile Marker 105.5; and
WHEREAS, the proposed development involves the construc-
tion of a 1,500 square foot addition; and
WHEREAS, Policy 101.3.4 of the Year 2010 Comprehensive
Plan, allows the Board of County Commissioners to exempt feder-
ally tax-exempt nonprofit organizations from the nonresiden-
tial permit allocation system after a finding by the Planning
Commission that such activity will not adversely agfeg. ~e

WHEREAS, on October 28, 1998, the Planning ;:'~iEi9io~
heard the request of St. Justin Martyr Catholic ChJSc~f~ ~
exemption and recommended approval of the request to the9ga~
of County Commissioners based on the following Findings of
Fact and Conclusion of Law:
1. St. Justin Martyr Catholic Church is a federally tax-ex-
empt nonprofit organization; and
2. The approved addition will be servicing the needs of
current Monroe County residents, and thus, will not have
any impact on hurricane evacuation times; and
3. The approved addition complies with County level of ser-
vice standards; and
4. Staff is currently reviewing the Education Center addi-
tion for compliance with all other pertinent standards of
the County 2010 Comprehensive Plan and Land Development
Regulations; and
Therefore, we conclude that the proposed development will
not adversely affect the hurricane evacuation objectives
of the Comprehensive Plan; and
WHEREAS, the Board of County Commissioners has
considered the recommendation and Findings of Fact of
Planning Commission and adopts the Findings of Fact as
own; NOW THEREFORE,

BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COMMISSIONERS,
that the preceding Findings of Fact support their decision to
APPROVE the request filed by St. Justin Martyr Catholic
Church, a federally tax exempt institution, for exemption to
the nonresidential permit allocation system with the following
condition:
That the Education Center addition be found in complete compli-
ance with the Monroe County Year 2010 Comprehensive Plan and
Land Development Regulations prior to issuance of any building
permit for the improvement.
PASSED AND ADOPTED by the Board of County Commissioners
of Monroe County, Florida, at a regular meeting of said Board
held on the 9th day of December ,1998.
