ITEM BACKGROUND: The Monroe County Social Services Department was contacted by the Monroe County Sheriff's Office (MCSO) following an incident in which the MCSO had responded to a crime scene at a private home. The MCSO requested assistance with biohazard clean-up of the crime scene since the homeowner had been incapacitated and was unable to make the arrangements necessary for remediation of the biohazard. The Social Services Department has a welfare account, approved by the Board, that is available for miscellaneous public services including: various home and plumbing repairs, moving expenses, pest control, debris removal, wheelchair ramps, grab bars, A/C units, installation fees, beds/mattresses, hospital beds, ADA accessible toilets, household cleanings. However, since crime scene cleanup was not one of the listed services, the Clerk of Court has requested a finding by the Board that payment of crime scene clean-up expenses serve a public purpose when the property owner/occupant is incapacitate, deceased, or unavailable and there are no other public or private means of payment. The State crime victims compensation fund can provide some funds with such expenses but that program is limited in scope and cannot be counted upon to cover the expenses. The proposed resolution would make that finding, allow for payment of the existing invoice, and establish a procedure for the handling of future cases. The Monroe County BOCC (The Board) finds that a public purpose exists for the County to pay for cleanup expenses for a crime scene located on private property in certain, limited circumstances where the property owner or occupant is incapacitated, deceased, or otherwise unavailable to obtain the services necessary to ameliorate any biohazardous 0 crime scene and payment by the Board is a last resort. Section 2. The Board will add to the authorized uses of miscellaneous welfare c account the cleanup of hazardous crime scenes. c Section 3. The Board authorizes the Sheriff and his deputies to continue to work with and refer any future cases of crime scene cleanup referrals to the Monroe County Social Services staff. Upon a request by the Sheriff, the Director of Social Services is authorized to incur expenses necessary to clean up a crime scene on private property if the 0 Director determines that the property owner or occupant is incapacitated, deceased, or otherwise unavailable to obtain the services necessary to ameliorate any biohazardous materials at a crime scene, and that there are no other public or private source of funds available to cover that expense. The Director shall document her findings and 2 determination in a detailed memo to the County Administrator, who must also approve such expenditure. Section 5. This resolution may be applied retroactively to May 1, 2020.
